Hi guys
I need to make a journal to address a pressing issue with commissions. So this is for all my friends and commissioners, and my future commissioners especially. PLEASE PLEASE PLEASE read this through and take note of it now if you have or are considering of commissioning me. This is something that really needs to be known and pointed out as I have had numerous problems with this in the past. Thank you. Also... THIS IS NOT DIRECTED AT ANYONE IN PARTICULAR. THIS IS NOT A JOURNAL TO BASH ANYONE OR POINT ANYONE OUT. PLEASE, DO NOT TAKE THIS AS SOMETHING TO BE TAKEN INTO YOUR OWN HANDS AND MAKE ANYONE ELSE FEEL BAD. IT IS NOT MY INTENTIONS. THANK YOU
When you commission me, it is my artwork you are paying me to draw. I sketch it, I ink it, I color it, it is copyrighted to me. The characters may be owned and copyrighted to another party USED WITH PERMISSION ALWAYS but it is my artwork. You may post it in your gallery if you wish as long as I am credited for my work AND linked in the submission context properly. Now then, what needs to be addressed here is I do retain the right to post any commission in my gallery. What you need to understand is that the art I do for commissions I also use to not only advertise for future commissions, but to display my skill levels as well. Normally my commissions take me hours upon hours to complete. I put a TON of work into each and every piece. I work hard at what I do, and I try so hard to please everyone with the art that I produce. This is what I do. This is my job. And I am very proud of what I do. I will also almost ALWAYS post any of my art that I do in my galleries. First off, you need to know this for what I am about to address in the following.
I have been asked by a few people (not just one, but quite a few) that have commissioned me that I remove pieces of artwork that they commissioned from me out of my gallery for one reason or another. Either due to no longer taking an interest in the piece, no longer wanting their character to be displayed, or due to significant others dislikes of it, or for reasons unknown. I have yet to remove any of them that was asked of me, because of reasons stated above. PLEASE understand that while I know that it was your idea for the picture, and you may own the characters I drew in the picture, that it is STILL my picture. It is my work, my time that was spent on it, the product of my labor. Please have courtesy for me and my career here.
Now then... there is an easy way to avoid ever having to come across this issue with me. THINK carefully about asking what kind of commission you want drawn. I take commissions everyday, and work on them many hours of my day. Its a job for me. So by all means, I hope this doesn't scare people away from commissioning me. But, when commissioning me, think about it first. Do not have me draw something for you that you would not like on display in my galleries for as long as I need it there. I will display it. I will give you credit for your characters. Keep that in mind. If you have an insecure significant other, don't have me draw a yiff picture with my character. Simple as that. If you don''t have a mate at the time, and I draw the picture for you, don't ask me to remove it later cause you have one in your life now. If you don't want your character displayed for public viewing, DO NOT have me draw them. Make sure what you commission from me is something that can be displayed for all to see. I will not remove pictures from my gallery. I am sorry, I don't feel right doing that, and I also feel that it is not entirely fair for people to ask that of me. Please consider that when asking for a commission from me. Thank you.

I do understand their point of view too... but this is something that I stand firmly behind, and its not like I am totally not willing to make adjustments, but it is something that I refuse to do. I am not wanting to stir up ANYTHING... not at all... I dont want a bunch of drama started, but this is an issue that I have had to deal with many times in the past, and while I understand people's thoughts on it, they should understand mine as well. Its nothing new, this is a rule of mine I have always had, I thought I just needed to explain it better is all. I don't want to cause problems or hurt anyone, but its just how I feel about it.

The thing is that one of people already had an argument with a common friend of ours, and he feels really shitty I think even though he somewhat tried to hide it from me, I just wish there was a way that would fix everyone's problems but that is asking too much in this world.
Really, right now everything is so hard for me, living is hard for me at this moment, so I want something easy. D:
Now the posting. I haven't got any piece commissioned until today, but i would be feeling a huge "insert insult here", if i were to tell an artist to what to do with their own work. Come on! Art is like a child to the artists. Do these people tell mothers what to do with their childs? I know it's not the same, but somewhat related. Art is created not poping into beeing, and the creator has the full, 100% rights to do with it what she/he wants!
So they were asking to take down some pieces? The best solution is: You do it untill now!! This journal is like a "monumental stone" to indicate, that they aren't have the right to ask you anything with the finished art up from today! You did well to create this journal. Commissioners tend to think they own a commissioned work. BIG mistake. They share it with the Creator! The artis has full right to the picture...always!
Or will you want to get your art as watermarked from now on? I saw pictures allowed to post only in watermarked, and i never seen the clean work in my life... Don't piss up artist by telling them what to do. Only the site admins have such a right to ask art to be removed, or they simply do it, because they can. This isn't a site that has "Flag for deletion" option, and i hope it'll never will have such.
Also why i hasitate to join the "Camp of Commissioners" is that i unwillingly become a part of something that has a rotten side already...Yep, rotten. I wouldn't dream on, telling someone who was nice enough to visualize my dream, to not show it! It's their work, and i could feel lucky enough that i got it done! Some people just didn't have enough politeness in themselves. After the commissioned piece is done: Pay it, take it, enjoy it. Bussiness with the artist is done, no re-funds, and complainings!
So just be brave and stand out for your art from now on! I (and many others here) fully support you in that!

But yeah I don't understand people that askes others to remove their own art even if it's there character. But I won't say to much as I tend to get afraid of offencing people. Bad enough I do that alot lately. xD

So it's up to you to show it in your gallery or not. Except you make a promise to do not. But why?
If you draw it you have every right to display it yourself and make sure that those who commision it only display it with the acknowledgement that you drew it.
Hell, on the few occasions I get manage to get request/kiriban/prize artwork from people I make it a policy to ask whether it's allright to display it in my gallery in the first place, and have a referal link as a part of that, it's just basic courtesy.

of course you wanna keep the artwork up cause your proud of it and worked you butt off plus it shows other people what you can do. but for the person who comission you i can understand them aswell cause they have payed you to do a job and end or the day even thou if your artwork it there picture, if that makes sense.
but i think if i was in your shoes that i 'd like to keep the artwork up for show
you could either dont mention there name or put there name or linky on the image somewhere.
maybe on your comission page you should have this mentioned so people know where they stand better

It makes sense. You worked hard and posted the fruits of your labor. Just because the owners of the characters no longer wish it to be displayed in your gallery means nothing since it is YOUR work and is copyrighted to YOU.
I will respect a commissioner's wish to keep a piece private if they ask me before it's completed. If it's been done for a few days/months/whatever and has been posted since completion? I'm not going to remove it. You should have thought about that earlier.

Without fully getting into a creator/commissioner bill of rights, which as you know I have very strong views on, I will say this:
I would suggest that you consider meeting in the middle when it comes to dealing with commissioners. As an intelligent person, I completely understand your position and agree with it. As a buyer of art ( "duh" moment eh? lol ) , as well as one greedy son of a bitch, I also understand a buyer's viewpoint about something they commission not being freely available to the non-paying public.
For example, as a buyer, I believe that if my money pays for something... off the top of my head, a 2000 X 2000 size image, that the full size image I paid for should not be available to everyone else for free. After all, I paid for it! I completely understand if a smaller size of lower quality is posted, but just handing out the full size version would probably irritate me to no end.
At any rate, I know there are some people out there that believe commissions are strictly a one on one kind of thing, and don't want the work they purchased available to everyone and their mother for viewing, even if it's a lower quality and size than the original. This is where the compromise part comes in.

I would suggest that you add a caveat to your commission page, and that being the following paragraphs:
"I reserve the right to post finished commissions in my galleries as examples of my commission work at a lower size and resolution than the original. By commissioning me, you agree to this. Once posted, the piece will NOT be removed without an additional fee of 25.00 being paid up front. My art is posted on multiple websites, and removing a specific piece takes time to do... time I could be spending on other commissions or my own artworks.
If you would like a private commission that will not be posted anywhere, there is an additional non-refundable fee of 25.00 <i>per piece</i> as compensation for work that I cannot use as commission references to expand my gallery and gain additional exposure."
Plain spoken, straightforward, and more money in your pocket for removal or private commissions. What do you think?
But anyways.... Its such a hard subject to address correctly... but I totally see your point ^^ and I do agree to some extent. pieces I make with my friends of course that I trust, I would have an easier mind of keeping it off my galleries, but most of my commissions are done with people I have no previous relationship with and it makes me nervous not being able to post my work. idk...maybe I am being unfair, but its just how I feel. Like for instance though, with you, I would not hesitate to make a private piece for cause I know you wont screw me over.... I would charge extra, but I would hate to do that, but I would cause I fully trust you completely. but if someone I do notk know... someone new commissions me with those terms, how am I to know that they wont screw me over with it?

I feel like a Devil's Advocate, and that's weird since we have quite a history and I've never once asked you for a private piece. I dunno... I guess even though I'd probably never use it ( details in a forthcoming note ) , it would be nice to know that the option was there should I choose to use it someday. *shrug* Oh, and the 25.00 bit was just a random price off the top of my head. The point was that if you did it on rare occasions, at the very least, you may as well make some extra green on the side.
exactly ^^ if I were to do a private piece, they better be willing to pay me ungodly amounts.... muah ha ha ha...LOL... but seriously, there are only a few people that I would do that for now... so the chances of me actually getting a piece with that circumstance is pretty low low low... but yeah ^^
So, in conclusion, not only are you NOT being a bitch, you are completely within your legal rights as the creator of the art in question.
Further, I would be a very sad Telarian if I couldn't see sexyhappyfuntime Kimmy Arts because people were being jackasses.

wow... what a flippin ass nugget >.> people like that are horrible >.> I have had a few that want me to remove a picture that I did for them, cause they were mated and their mate flipped out about it, and its like, well... you should have thought of that first before you had me draw it =D LOL... it has happened a few times, other ones wanted me to remove it cause they wanted to be the only one that posted the image in question, and that was a BIG BIG FAT no... lol X3
