that site appears to contain adult art from many artists, including Me, Zen, Wookiee, TarinFox, Blotch, and many other well known artists.. They did not aquire permissions from me for displaying my art there, so any other artists that see their art there my be copyrighted infringment aswell. Im attempting to contact the site and site owners/administrators, but without luck so far...
its even more frustrating that they are making money off our art aswell with membership fees !

Im working hard to reach the people responsible for this, but we may need help to overwelm them with Cease & desist, & warnings to the problem before we can succeed against such a possibly large porn site.

The sad thing is aswell that its a paid membership needed to get in, so chances are there are ALOT more art stolen from us by them to make them money illegally !

That would be my best suggestion at the moment. Considering this is the third time. They Have ignored the prior cease and desist orders and thus with prior knowledge they have engaged in illegal sale of unauthorized copies of copywritten material. Don't play softball... Kick em where it hurts.

I had no clue people were stealing art, apparently they're a larger company too? to they seem to be anyways. so i don't think they'd want to soil their name.

1) DMCA is a US law. Firestorm is, last I checked, Canadian. This means that he cannot use the US laws on copyright as a basis for infringement, but the Canadian ones, which the process is, I'm sure, different.
2) This assumes that both the infringing company and the servers are located in the US. As the trial against Pirate Bay proved, it's really hard for a non-US company which has all it's assets in an non-US location, or ones that doesn't have prior legal agreements with the US, to do anything about it. Firestorm would have to go to the country of origin of the company's laws to see if they are, indeed, breaking the copyright laws. If they aren't, there's probably not much he'll be able to do.
I personally think that he should file a complaint with the company first, and threaten to bring in the RCMP if nothing is done since copyright law is a federal law, and let them deal with the issue. They have more resources and knowledge on how to deal with international infringements of various kinds, much like the FBI in the US.
I still think that he should open a complaint.

Well first, we need to send them a cease and desist, second off contact a lawyer,
possibly start a furry class action, someone needs to find who and what was stolen,
place an actual VALUE on our art, sue them out for a fuckton of money, and divvy up the money between our artists. Make the government take their member list, and charge each artist's commissioned price for that type of work, with a bonus considering it was to be used in a large, mass media scale.
Basically ream them. c_C They probably can't even afford it as a whole.
I don't know US law but I'm afraid that you can't do anything... I mean... putting your sign on an artwork does mean that it's done by you and you have copyrights... but that doesn't mean that others can't copy your works or earn money selling them... Do restrict that you would have to include a full license info to each of your art of use one of the CreativeCommons licensing pictures or something like that... I mean... there are no clear statement on the art that solely you can make money of it... Like I said, I'm not familiar with the law but that's what I heard. Ok you signed it, you're the owned but nowhere is written that reselling is prohibited.
True ownership is as easy as an artist having the original file on their HD which timestamps the original 'creation' date. An artist can also show the uploaded art with a timestamp in certain galleries (such as FA).
The problem is that even if you can prove that you made the art you still can't do much... You probably need cash to do anything and still it's not easy... They can also claim that they got spoken permissions from you... What now? They are lawful but very hard to prove if you don't have any witnesses.
Well I suppose it's good to contact with the admin but I wouldn't expect much of change. It's like piracy for music, books, programs or any kind of digital material. You can complain but you can't do much... So I think the only good solution is to not give a fuck... Just inform people who should solve this problem (not site but server admin)... Although if doesn't help I don't see any better solutions.
I do agree that not much can be done. However, 'spoken' permisssion does not fly in the court of law. It is heresay. A verbal contract is not sufficient evidence of permission in regards to copyright infringement. Written proof would be required or a witness of said verbal contract. Without it, it does become he-said, she-said, which is not a viable defense. Any reasonable person would not provide verbal permission for another entity to profit from their work so the burden of proof lies with the person violating copyright to establish they received permission (video recording, witness, written contract, ect).
Will much be done? Likely not, but not giving a fuck sends the wrong message---that it's ok to let it happen because there's nothing artists can do about it.
