I don't normally speak out on administrative issues, as I generally respect user privacy first and foremost. Every so often I will step out of line and speak my piece, as generally a situation sort of stands out amongst the norm. This is one of this times.
Last night, it came to attention that Techie9098 (Techie Foxx) had cobbled together over 12,000+ mature images into a torrent, and dropped it onto the web. Worse, he had the balls (freeeakin' huuuge!) to demand/request donations for that. For his "services". Despite being illegal, despite being against Paypal's TOS, that's just a violently stupid move.
So this is a public shunning for Techie9098. SHUN!
This sort of behavior will not be tolerated on Fur Affinity.
I care about the artists and the people who post here, and I will not allow art thieves on this site. When we find you (yes, when) you will be banned, and we will not give you a second chance.

You're going to have trouble finding a lawyer who'll take the case, and when you do, he's going to cost you out the ass. You'd have to have had all the legal paperwork documenting your copyright done before the case, and you'd have to have legal papers saying that their copying of said image severely affected your ability to make money.

Regarding the DNP, e621 have been ignoring requests from artists to be added to their list for years and are also refusing to take art down.
And as long as image board sites aren't advertising their cache of ripped/reposted work on FA, promoting the fact they ignore artists requests, DNPs and takedowns, etc. they'll be allowed to stay.
Isn't that kiiiiiiinda like saying as long as a criminal doesn't go around saying HEY I STOLE DIS THANG it's okay that they did it?

Actually it's still art theft to redistribute work you don't own because you're violating the copyright of the person who does own it.
if u distribute via fileshare u should be alright as long as ur not getting cash, also FA does have the download feature so kinda obliterates it being called theft its just screaming its allowed to be distributed. also real theft entails u take it alter it and such i kinda admit i did do that once and will be holding myself to not do so again but i do know now what it is. so if u want to point out any more facts that i might have missed please be my guest.

And if you get down to facts, it is in FACT theft to redistribute someone's work, all adding profit does is make it easier for an artist to get money out of you for the theft.
Just because you may not get sued for distributing art not belonging to you via fileshare does not make it right, it's still a violation of the artist's rights.
Also being able to see and download a work because an artist is nice enough to upload their work so you and others can SEE it does not grant you the right to redistribute it. Kindly go and do some research into copyright and copyright violations, a work doesn't need to be altered to be stolen.

Art theft is not simply the act of altering a work without permission. Art theft begins when you take a work and claim it as your own no matter what the context whether you're making a motivational poster or a graphic for a skateboard or whatever.
If it's not yours and you ain't got permission from the originator, it's theft. Downloading something for personal use, or for archival purposes, is different, but any time you submit someone else's work as your own for either praise or profit you are stealing.
And in any case most artists can and do watermark their work with "Do Not Distribute" or ask to be placed on Do Not Post lists on imageboards meaning that if you put their stuff up, expect it to get taken down. No questions, no arguments.

Cos if you are seriously asking then, no, posting artwork to a publically accessible website doesn't make it public domain.
Public domain is a whole different kettle of fish to publically posted, when something is put into the public domain (which can only happen via a direct statement from the artist) it becomes free for anyone to use/alter or otherwise treat as clip art.
