Commission TOS

If you wish to get in contact with me I try to check FA at least once a day. For quicker responses I have an MSN account. Canook[at]live.com
By commissioning me, you are agreeing to the following terms and conditions:
Payment:
Payments are made through paypal. Do not include any additional notes, as paypal does NOT endorse the sale of artwork/commissions and it can end with your/my paypal being banned. Paying through the gift/personal tab is not advised as paypal will shut down your account if you have too many of those types of payments.
I do not accept money-in-post. Unless you can hand me the money in person, I do not accept this type of payment.
All prices are in USD, and must be paid up front. Work will not begin until payment is received. If your single commissioned piece is over 30$, I will accept half of the payment upfront. I must receive the other half after the sketch is completed.
Commission Procedure:
In order to commission me you must have at least one image of the character, with color. (without is acceptable if ordering a commission without color) I will only accept text references if you also have an image to go with it. SL screencaps are only accepted if they are clear, and of a larger resolution. I do not accept image compilations, as in; a bunch of photographs or artwork you found off photobucket or some other website to 'make your character'. I will accept them only if it is for a prop, or a new outfit.
You must note me what you would like for you commission, and include all information and reference images in the note. You absolutely must not send me any payment until we have discussed and both agree on the commission.
I will note you your sketch once I've completed it, and at this point in time you must request any revisions. You are able to ask for changes in the sketch phase, however, if you ask for excessive changes, there will be a fee. You may only have one complete resketch, you will be charged for others. Once you have approved the sketch, you may absolutely not make any more changes to the pose or composition of the piece.
If you decide that you want a completely new pose, or a different character it counts as a resketch and you may be charged. Please review the sketch carefully before approving. Very minor changes may be made on the inks.
No changes will be made once the colors have been laid down unless I have made a mistake with the colors.
Content:
There are quite a few fetishes I will draw, but there are a lot more that freak me out. When in doubt, please ask first.
If an extremely complex character is requested, there may be additional charges.
I won't draw in another style. eg; Disney, Sonic or another artist's. You are hiring me for my art, not for someone else's. If you would like art in someone else's style, then please commission them.
I reserve the right to refuse your commission for any reason.
Rush Orders/Deadlines:
If you would like your commission to be done by a certain date, please let me know in your initial request. It may cost extra.
Permissions & Private Artworks:
I retain all rights to my art unless I state otherwise. This means that I can post it to my FA/DA/other art site accounts, website, and offer it in art CD's and books/prints should I choose. Please state ahead of time if you wish for your commission to be withheld from my galleries and my own personal use, as there will be a fee charged. This does not mean you own the rights to the image.
You are allowed to post your commission in your gallery, but it must be linked and credited back to me. You are also able to print the image, use it for a personal tattoo, or as a graphic in a personal website or blog layout. If you're using it on a website or blog layout, I must be visibly credited and you must inform me of it when you note me about your commission.
You aren't allowed to use it commercially, as I still own the rights unless discussed before I accept your commission. You may not sell t-shirts, prints, or any other items with the image on it. If you want the rights to your image, it will have to be discussed before I begin to work on your commission, as you need my permission in writing.
Refunds:
I absolutely do not give refunds for pieces once they are complete. If you are unhappy with the piece, I have given you ample time to voice your concern
If you need a refund for whatever reason, then you must request it before I've started your commission.
By commissioning me you agree to these terms and conditions.
