Auction Terms of Service

By commissioning me through Auction, you are agreeing to the following terms and conditions:
Payment:
Payments will only be accepted through paypal. When sending money, please do not include any additional notes or information, as Paypal does not endorse the selling of adult art/commission work and I would just like to avoid the trouble. I also request that you do not send the payment as Gift or anything else under the personal tab.
All payment must be sent as USD, and must also be paid up front. The commission will not be started until payment is received and cleared.
Auction Commission Procedure:
Auctions are only held through journals. Please follow any procedures indicated on those journals to participate in those auctions. All details will be held through notes. Revisions are not offered through portrait or speedpaint auctions unless stated otherwise. Upon completely, a high res version--both a print-friendly full size and a web-friendly smaller size--will be noted to you.
Content:
Auctions are subject to whatever themes or content restrictions I provide with any given auction. Things you will NOT see me offering include, but are not limited to, obese, diaper-play, futa/herm/dick girls, guro, and extreme fetishes (ask if you are uncertain about any auction perimeters).
I reserve the right to refuse a requested auction content for any reason.
Revisions:
Revisions will not be offered for portrait or speed paint auctions. For Illustrations and YCH auctions, I will send the sketch/flats version of the piece to allow any necessary changes or revisions. All illustration auctions will allow one re-sketch as needed. Past this point, you will be charged $10 per additional sketch or heavy change.
Once the sketch is approved, no further revisions will be made.
In the chance that I make a mistake (such as wrong colors, missed item/marking, etc), I will give compensation with a new image to match the degree of the mistake made. Given the nature of how I finish commissions, I do not have the option to go back and edit w/o major redoing.
Rush Orders/Deadlines:
Many auctions are scheduled for completion or work hours prior to payment. Understand that usually there is no way for me to push forward the scheduled work date (as I generally schedule them for immediately after bidding/payment time ends). If you would like to push the time back (to be able to watch me stream your work, etc), please ask. Any illustration or YCH auctions will be given top priority over any other trades, commissions, etc I may have. These SHOULD be finished within a week from payment (but please allow up to a month's wait-time before inquiring). Any delays will be mentioned and explained. If by chance there is a deadline you need me to work with, feel free to let me know.
Permissions & Private Artworks:
I retain all rights to my art. This means that I can post it to any art accounts or websites I would like, as well as use it for portfolios, art CDs, prints, books, or any other merchandise should I desire. If you would like for me to refrain from posting your image on my galleries or for personal/selling use please state so when sending the commission form. There will be a +100% charge fee for requesting to withhold it from my galleries (yes, meaning if you pay for an auction piece and it reaches 500, I expect you pay 1000 total to refrain from posting it from any of my galleries--or I will not accept. I REALLY REALLY HATE having to deny posting my own art. If you don't like it, buy elsewhere). You MUST still credit me for all work should you post this image anywhere yourself. This does not mean you own the rights to the image in any way.
You are allowed to post your received artwork in your gallery, but it must be linked and credited back to me. You may also use it for anything personal, such as printing it for yourself, using it as a personal tattoo, or as a graphic in a personal website or blog layout. When using it on a website or blog, I must be visibly credited. Please do not modify my art in any way without permission first.
Commercial use of my artwork is strictly prohibited, and these rights will NOT be sold with auction pieces. You may not sell t-shirts, prints, or any other items with my artwork on it.
I will not give up claiming rights for any price.
Refunds:
If you need a refund for whatever reason, then you must request it before I've started your auction piece. Given the nature of how quick (and usually in one sitting) auctions are done, once I have started, I will NOT give refunds of any kind. Requesting a refund on an auction will result in a suspension from participating in my next auction.
If I, for whatever reason, find myself incapable of finishing your piece or am taking an unnaturally long time to complete it, I will refund you in full.

Hnn, and, yep! ;u; Exactly why it was mostly copy-pasta'd.
From what I hear, she copy-pasta'd it from Teekay, and Teekay got it from someone else... it's, like, a never ending commission TOS copy-pasta chain. Or something. xD
It's pretty much the same as Fetalstar's, only with slightly different rewording to fit me. ;u;

I once did a lot of research on things like Doujinshis and such and the selling of them. While America is more strict about such things, the Japanese see fanart, prints, doujinshi, and whatever else simply as advertisement and even a form of flattery. (So fanart/commissions of anime, manga, and Japanese based video games are pretty okay.)
So, the way I see it, while it is technically illegal, I doubt I will get many fanart commissions to begin with. (Especially on a site like FA.) If I do get some, I'm sure the one or two fanart images I do sell will not get me in any sort of trouble.
And I wouldn't put it past people, I've done a guro commission with Stich & Sailor Chibi Moon (before I knew this) and the person came back with another one with Lilo&stich characters, so there are probably people out there who will want fanart type things. :U
