I’m going to keep it simple and divide my TOS into these sections

I… PAYMENT/PRICING
Currently I take payment only in money order and Pay Pal. For commissions $50 and under I will not begin working until I have received payment in full. For commissions over $50 I will take a down payment of $50 and the rest upon completion, I will work on the piece but the finished product will not be mailed or e-mailed (or posted without a watermark) until the rest of the payment has been received in full.

II… TIMING
It is understood that I have a life with all of its obligations, and so all commissioners must give me at least a month to work. When I begin working on a project I will give an estimated completion date; if I begin work but find that I can’t finish it by that date I’ll let the commissioner know as soon as possible. All estimated dates of completion will be determined based upon the complexity of the commission; so it’s all done on a piece-by-piece basis. If you have a deadline in mind (be it a holiday, a personal anniversary, or even a con) please give me at least a month (and more than a month is even better!!!) to complete it, and please let me know from the very beginning when you contact me so we don’t get stuck in a bind.
If I know I’m going to be experiencing a very “time-tight” period in my life (like finals, or the holidays) I will let all commissioners know before payment is received for their reference.
Traditional commissioners (like colored pencil pieces, “plushies”, or soft sculptures) should also keep in mind that once I complete a piece it will take an additional amount of time (usually between 2 – 4 weeks) to receive the piece in the mail.
III… SUBJECT MATTER ETC.
My main media is needlefelting and soft sculpture, “traditional” sculpture with Super Sculpey, pencil sketches, colored pencil, marker, and digital media.
What I absolutely will not draw (so don’t even ask): cub porn, rape situations, watersports/scat, and electronic devices/automobiles. I’m not good at machines so don’t even ask. Everything else is fair game, though.
IV… HOW THINGS WORK
So you want to commission me? Here’s how it works; you e-mail me at thewoylven[at]gmail.com with the subject line New Commission. I will need a detailed idea that you want me to execute; if you have a particular specie or character in mind I will also need a character sheet and references. Once I get your idea I will send you a price. Then you send me either the full payment or the down payment of $50 (depending on the complexity of the commission) and I work on it. I will maintain constant contact with you (the commissioner) throughout the whole process and I will update you with sketches and photos when necessary. Within a month I will finish the commission and I will post low-res pictures (some possibly with watermarks) on my art websites (FurAffinity and DeviantArt); if I still need payment I will wait for it, but after full payment is received I will either mail the full piece (if it is traditional media) or e-mail the high-res printable version (if it is digital.)
V… THE BORING STUFF
A) When you commission me, you are only paying me for the rights to that image, but you aren’t paying me to make an image for your own profit. That means that if you buy something from me I’m not going to make money off of it after you buy it, and the only way you can make money off of it is selling it to anyone else. You’re not paying me to make a design for your T Shirt company or whatever, so don’t ask.
B) When I say that I don’t draw rape, cub porn, watersports/scat, and machines, I mean it. Some of those things I am very uncomfortable with morally, others I’m uncomfortable with artistically; having someone pester me about it won’t change the situation.
C) I will maintain contact with you (the commissioner) with the whole process and I will give you every chance to steer the creative process of an image, but I don’t do “do-overs” or “mulligans.” Digital pieces are very easy to alter, so this almost doesn’t apply to them, but once it has been agreed that I should continue in a certain direction and finish a piece a certain way, that’s it. If I finish and you get your piece in the mail and it isn’t exactly the way you wanted it, I’m sorry, but that’s what we agreed upon.
D) If a prospective commissioner sends me a down payment and I do not receive the rest of the payment within a reasonable amount of time I will assume that the commissioner no longer wants the artwork. I will contact them and ask if they want a refund – if they do I will give it to them at the soonest possible date (Finance Gods willing), but I will keep any and all artwork that has been “abandoned”.
E) Conversely, if I cannot finish a piece for any reason I will contact the commissioner at the soonest possible date, let them know, and give them a full refund. They can keep any update photos or sketches I sent them, but I will keep the “abandoned” artwork.
F) Even though you have full rights to the image, I still maintain rights to display that image on any website I choose. I will never display the full-res printable version (that’s for the commissioner only) but I may choose the image (whether it be a painting itself or pictures or other images derived from the main piece) to use in a portfolio or on display in my website.
