Terms Of Service (TOS) for Commissions

Before contacting the artist for a commission, you are presumed to have read this document and agreed to the policies described herein. By sending payment, you have expressed your consent to be bound by these terms.
These terms of service (TOS) are relevant only to noncommercial projects and may be revised or supplemented without prior notice. The policies set forth below have been influenced by customs employed in the usual course of dealing between artists and clients, as well as the "Graphic Artists Guild Handbook: Pricing & Ethical Guidelines".

- Base prices displayed are subject to change based on the complexity, size, and medium required for each piece.
- A preliminary price quote will be provided by the artist after visual reference(s)/detailed character description(s) and the general idea for the commission are provided by the potential client.
- Commissions priced $40 and under must be paid in full before work on the image will begin. Payment plans are available for any commission over $40. Please inquire.
- Clients using a payment plan will not receive the original commission or unwatermarked, high resolution digital image until the last payment has been received.
Sketch Approval, Critique, & Revisions
- An approval sketch will be provided for all inked and colored pieces. Clients are strongly encouraged to review the sketch as soon as possible and give detailed feedback about any changes that may be necessary. Two full revisions of the sketch will be provided free of charge (or the equivalent in small revisions), but any additional revisions will be done at a cost of $5 per sketch.
- Critique and red-line is encouraged during the sketch phase. However, the artist reserves the right to reject the critique or red-line, in whole or in part, to use her best judgment when considering critique in light of her artistic skill level and will make all reasonable attempts to preserve the integrity of the piece.
- After the sketch has been approved, the artist will begin inking and/or coloring as the commission requires. Revisions requested after inks have begun will be done at a rate of $8 per hour.
- The artist reserves the right to use any rejected sketches in future projects
Cancellation of Commissions
- The artist reserves the right to cancel the commission at any time due to poor communication, rude or inappropriate behavior, or pressing life circumstances (illness, serious injury, etc.).
- If no work has been done on the commission when the artist cancels, the client will receive a full refund.
- If the commission has been started when the artist cancels, the client will receive a refund less the value of the work done on the piece.
- If the client wishes to cancel the commission during the sketch phase, 50% of all monies paid will be refunded.
- No refund will be issued if the client requests cancellation during or after the coloring phase.
Commission Discussions
- All discussions about commissions must take place through the artist's email, dreamhorsestudiosart AT gmail DOT com, to ensure that all information is kept neatly in one place.
- Please have an idea for your commission in mind before contacting the artist. It is extremely frustrating to go through lengthy negotiations just to find out that a potential client was merely "kicking the tires" without any actual intent to purchase a commissioned piece.
Commission Updates

- The queue is updated in "real time" to keep all clients up-to-date with progress on their respective images.
- Additional updates may be made via e-mail or on the artist's Facebook Fan Page: http://www.facebook.com/DreamHorseStudios
- Commissions are not always done in chronological order. Larger commissions will naturally take longer to complete than less-involved projects, and several projects may be underway at the same time. This is to keep the artist "fresh" and engaged in her work, thereby ensuring the best possible product for each client.
The Finalized Commission
- The artist retains all rights to the completed image and any "work product" (sketches, revisions, etc.) related to the project, including the right to make prints and include the image in her portfolio.
- The artist reserves the right to publish the finished commission on any personal website, art gallery, or journal. She will gladly delay the public "reveal" of any piece intended as a gift at the client's request.
- The client does not have the right to make prints of his or her commission except for personal use (i.e. printing off a digital commission for display in a private dwelling), or to profit from the artwork in any way beyond the physical sale of an original traditional piece.
- The client is welcome to resize or crop the piece for use as an icon, wallpaper, or other digital graphic for non-commercial purposes on social networking sites, bulletin boards, and so forth, but may not alter the work in any other way.
- The client is encouraged to display a watermarked version of his or her finished piece in any online gallery of his or her choosing, but must give proper credit to the artist.
- If the client so desires, ownership of rights can be negotiated for an additional fee.

Hopefully, the clarified sections detailing my ability to cancel the commission or deal with revisions at an hourly rate will cut down on the number of people who have more than taken advantage of my generally kind disposition in previous months. Purchasing a commission does not give anyone the right to become overly clingy or possessive, to micromanage every miniscule little detail, or to treat me with blatant disrespect. After an unpleasant dealing with a client that resulted in some unsavory circumstances, I decided that it's time to outline the expectations for the artist and the client so that everyone knows exactly what to expect with the commission experience.
