Adoptable Rules/TOS
*UPDATED Feb. 2014*
Firstly, if any of this seems off to you or unfair, I'm open to helpful feedback! I'm still somewhat new to the whole adoptables thing, but I think it could be a lot of fun and I want to be as fair as possible. And sorry if this gets overly/unnecessarily long-winded; I just like to play it safe so there is no confusion in the future.
- - - - - The following rules apply to any adoptable I post, unless otherwise noted: - - - - -
- The character is yours upon receiving full payment via paypal only. I retain rights to the art itself as well and credit for the design. You will receive a larger image without a watermark and anything else described in the descriptions to the adoptables. Please do not upload anything but the watermarked version, this is helpful for both of us!
- Some adoptable auctions may be somewhat ladder-style in that I will offer a free commission if the bidding reaches a certain price. Refer to my general commission information, HERE for my terms and conditions BEFORE placing a bid, just so you know what to expect from me!
- You have 24 hours after the end time of the auction to pay (or after the moment your offer is confirmed and my paypal is sent to you, for non-auction sales), or if it's a special adoptable auction that has ended for $100 or more, you may make two payments within the span of one to two weeks (unless otherwise noted). If you fail to make the payments in time for ANY reason, what payment you have sent will be refunded and the character will be re-listed, OR sold to the previous highest bidder. Or kept :P
- The above means that if you've been outbid, you COULD still win if the highest bidder is unable to pay in the time given, so if you've placed a bid, but have been outbid, I'd encourage you to hold on to the money until the auction says it's been officially sold, though you're not obligated to of course!
- Do not bid unless you mean it. This should be a given, but it's common for people to bid then hide and/or back out last-minute. If it happens too frequently, I will likely ignore any future bids you make. You don't take your bidding seriously, nor will I. If it happens more than a few times, you may be blocked.
- When placing a bid, confirm you've read this by saying "I've read the rules and agree to your terms" along with your bid. It is only required once.
- If you'd like an avatar made of your new adoptable (cropped from the original image you bid on) for free, just ask! It only takes me a few minutes :)
- You're free to post your adoptable to your own gallery, of course! Credit as the artist/creator is required.
- You may rp with, rename, or change anything at all that you'd like on your adoptable. Rights to the original design are mine and if you edit the character to the point where it's no longer recognizable as the original, please consider contacting me to buy it back.
- Keep in mind that selling adoptables is never a fully legal sale, but consider my feedback with others if you are worried about your design being taken back. This will only happen if you break any of my rules here; it is your job to make sure you comprehend them. Never will they be taken back for any other reason.
- Do not buy my adopts only to resell for a higher price. Do not resell, period for at least a year, and first contact ME to find whether or not I would like to buy them back, otherwise I will not sell to you again. I want them to go to good homes, not to be used for profit or to be passed around. If you must resell (after it's been a year and you have confirmed with me), sell for the original price or lower. If you have gotten many commissions of the character, please only sell for the price you originally paid for each piece.
- Do NOT give my adoptables away without making SURE the person receiving it/them has read my rules AS WELL and they have messaged me saying they agree to my rules. Please also make sure they know not to resell/give away for another year. This is to prevent my characters from being passed around so much that I have no idea who they belong to anymore or if they are being used for profit.
- I reserve the right to refuse to ever deal with you again if you bid/ask for one only to ignore my reminders if you've not paid in a timely manner. I do not tolerate buyer's remorse/wannabe-buyer's remorse, OR excuses. I do not make exceptions, I don't care if you are a friend or if you've done me "favors" or drawn me gift art, etc. The rules are the rules.
- If my TOS is broken, I have the right to buy back the art & design or resell it for you, at which point you must delete all submissions made by yourself and never submit art/commissions of them again. Any separate accounts made for them should be deleted or at least cleared of any art of the design. When you have KEPT to my rules, but want to sell back to me, if I have the money/am interested, I will send you the same amount as what I sold it to you for, plus the costs of any commissions purchased of said character. I will expect the artists themselves to tell me how much the commission was, so be sure to remember the galleries of each artist commissioned.
If any of this disagrees with you, then simply don't buy from me.
- - - - - Auction-specific rules: - - - - -
- If you are outbid, please hang on to the amount of money you've bid until the auction is over and auction is marked as PAID, just in case the high bidder is a troll or back-out bidder. If they bid the auction really high then backed out, I will likely just re-list the auction rather than sell for the base price. If the auction starts at, say, $50, and they started bidding low but the bidding got up to say $200, I'd rather just re-list it than sell it for the base price since other potential bidders would just look at the high price and not even attempt to bid. I hope that makes sense 6_9 Also, I've heard of some people "teaming up" and having one person bid very high against their friend who wants the adopt, only to "back out" at the end as a way to help their friend get a cheap price. This is not fair. So many scams involving adoptables = why this TOS is so long. P:
- If you are the first bidder, bid in response to the comment I leave on the auction submission, it will look something like "Bid here". After that, bid in response to the PREVIOUS HIGHEST BIDDER so that they know they've been outbid, otherwise your bid won't count. Any comments on the art itself may be left as a regular comment, not in response to the bidding stream.
- If you plan on bidding, bid now. Don't wait til near the end of the auction. This isn't eBay; no sniping allowed! The auction may be extended by several hours if I see this happening. In fact, most of my auctions now say that they will end on such-and-such day, but may end at any point during that day.
- Obviously... don't argue or change topic in a bidding stream. Preferably, don't converse with the people you're bidding against or say anything that might cause a fight. I don't care if you know the person or not, if you have a history, etc, I won't tolerate ANY bidder being abused or threatened out of an auction.
- I don't want involved in your personal drama or excuses. Anyone not following the rules in this journal will not have exceptions made for them depending on their individual sob stories. I have no way of knowing whether it's true or you're just making it up, so no one will get special treatment.
Sorry if any of this sounds harsh, but I've witnessed just about everything I've mentioned happen before in adoptable sales, and I wanted to be perfectly clear what I will and will not tolerate. If any of this sounds unfair, don't be afraid to suggest changes! As I said, I'm new to this :)
Also I agree with the comment above mine about auction sniping. I have seen extensions of anywhere from 10 minutes to 2 hours depending on the auction.

What if I commission an artist to draw my adopt and they alter the adopts appearance even though I never requested it? Does that count even though it was never my doing nor intentions?
so from what i have read, im just renting a character
