THIS AGREEMENT is made this between ISAAC DEKING / KRAEST (hereinafter called the Illustrator), and _[YOUR NAME HERE]_ (hereinafter called the Author), collectively called the Parties.
1. General Provisions
a. The Illustrator agrees to produce an original illustration and typographic design if applicable (hereinafter called the Work) per the Author’s specifications. Subject to the following conditions, the Illustrator hereby grants the Author, a non-exclusive, non-transferable license to publish the Work in the personal gallery or for the intended purpose of the Work, as well as the production for ads, promotion, and marketing for the work, with notice given to the Illustrator. Any other usages must be discussed between the Author and the Illustrator, and expressed permission must be granted in writing by the Illustrator prior to any other usages. This may include, but is not limited to, being posted in a third-party gallery, uploaded as part of an unrelated collection of works, or used in content in other media. The Illustrator shall have the right to use the art for self-promotion, and may also enter and display the art in competitions and shows. The Illustrator agrees not to license the art in any manner that would be competitive with the Work, however, retains the right to monetise the art for sale and production.
b. The Illustrator shall remain the sole owner of the copyright in the Work. The Author shall enjoy only the rights set forth above, and nothing in this Agreement shall entitle the Author to make any claim to ownership of the copyright in the Work. The Publisher may not make any other use of the Work other than those authorised herein without prior written approval from the Illustrator. Fees for any additional uses will be negotiated separately.
2. Credits
a. The Illustrator shall be entitled to a credit in an appropriate location on the finished Work. Credit shall read as follows: Art © (year) by Kraest OR Art © (year) by Isaac DeKing
3. Terms and Conditions
a. The Illustrator will supply the author, electronically, the high resolution digital file of the Work (finished illustration and typography if applicable) per Author’s specification by the deadline: _[TBD]_.
b. If available, the Author will provide the Illustrator with their Twitter or Discord handle, allowing him to contact the Author with updates and progress sketches if available.
c. If the Illustrator determines at any time that the project is finished, for any reason, the Author agrees to pay an amount equal to the time spent on the Work.
d. If for any reason the Author needs the Illustrator needs to redraw the Work after the inking and linework has begun, the Author will be charged half again the total price of the Work.
4. The Illustrator’s Representations and Warranties
a. The Illustrator represents and warrants that he is the sole and exclusive owner of the copyright in the Work
b. The Illustrator represents and warrants that he has the legal authority to grant Publisher the license and that no other person or entity is required to give consent for the license to be valid.
5. Notice.
a. Any notice required or otherwise given pursuant to this Agreement shall be in writing by email or messenger.
