So the new jury will have to just decide on the death penalty instead of starting from square one. And opens a subsequent media circus over the years of legal appeals to follow no matter what sentence is now imposed.
There are 2 failures in this instance. 1) the jury failed in its duty to come to a decision. Without being inside the jury chamber, only they can answer to this issue. 2) This is also a legislative failure. In some states, if the jury cannot agree on a death sentence, then the minimum sentence - life w/out parole is imposed. It prevents exactly this type of problem.

I mean, did a possible death sentence ever make people refrain from doing crimes? so why not ignore it and make it into a life sentence... but being unable to decide between the two, and thus not being able to finish it off despite it all laying out there is nothign but fail. and if I were one of the relatives of the victims* I'd surely try to sue the jury for whatever comes to mind.
like, having sex in any other than the missionaries' position. or sleepign naked, or tieing your rhino to a lamp post.
*assuming that woman comitted a homicide, that is.
The real crime in regards to the hung jury is the fact that the prosecution could put a stop to this by taking the death penalty off the table. The judge cannot sentence Arias to death. Only a jury can do that. But the judge CAN sentence her to life without parole and this would save the county, state and the victim's family an ENORMOUS amount of pain and money.
What scares Arias is not prison. It's being ignored. I say lock her up, throw away the key and ignore her.
I remember a CSI: New York episode where they caught some serial killer who wanted to be on TV. they withheld his name and face using terrorism laws...
in my opinion nobody needs to see their faces at all. who knows, they might be innocent after all (wouldn't be the first time), and try and start a new life after prison when your face graced every rampage in the world under the word "murderer!"...

What I don't get is why the WHOLE thing has to be redone. They have a verdict, just not a sentence. And if the prosecution can end this agony simply by letting go of the death penalty and opting to lock the woman up for life without parole, then I would think it was in the best interest of everyone to do so. The worst thing they can do to Arias is take her out of the spotlight. Once this case is resolved, they can do that. Killing her will just leave that spotlight glowing through numerous appeals and other hearing, so I'd just as soon they not kill her, Burying her alive is far more appropriate.
I do agree that the trial should not restarted from scratch, though. It should be made legal in a case like this one that a new jury be seated just for the purpose of determining the punishment instead of retrying the entire case.

It's really not going to be any longer or shorter. She's not gonna just go right under the rug as soon as she's sentenced, nor is she going to be seeing sunlight of her own accord if they delay is...
