Terms of Service
Now what I do and don't do.
I don't do anything you'd really call a fetish (basically, if you have to shut the bedroom door to do it).
Fetishes here don't include macro, or chubbisation/BBW, but it does include vore/digestion/foot fetish/crushing/etc. and inflation. That gives you an idea.
I will not draw sex/sex acts, or
sleaze (think Playboy poses, doesn't matter what they're wearing)
rape
torture/abuse
general abuse (in case in didn't go under the more nonconsentual versions of the previous category)
bondage/BDSM
nudity (but some people consider that fully-furred characters are naked. I don't, as long as there are no visible nipples or sexual organs. See Dr. Pickell's brilliance http://www.furaffinity.net/view/10012664/. )
gross (mainly ewww-type gags)
gore (blood is OK though)
the occult (bad experinces!)
underage/barely-legal [age]/anything along those lines,
mind control,
making fun of women/felines/foxes/bats,
Hyper (but ask about this one - if it's not grotesque I may not consider hyper what you consider hyper).
I don't draw reptiles, dragons or birds, not out of any dislike but because drawing them is not my thing and I don't want to give a so-so result. I also don't draw dingoes or sharks. Also not interested in drawing humans :), but Nekomini/catgirls/catboys OK.
What I do
Pretty much anything else (as long as it's about an anthro character; not landscapes, humans or mecha).
I reserve the right to refuse to draw themes or subjects I'm not comfortable with. If in doubt, ask me by note (not comment or shout).
I probably won't scratch you so don't be afraid to ask!
Just a note to aviod confusion
If you can't tell if I'll consider your idea sleazy and not something I will draw, ask yourself which is more like how you'd put it:
"This is my character, she is etc etc and has large breasts," That's OK.
or
"This is my character, she's fappable and has HUGE TITS!". If this one, do not commission me.
"Feel free to ask about anything... I will be not angry, maximum you got a no or a yes about what I draw... :)
"I have the right to refuse your idea if I don’t like it or I see this is too hard for me.
I have the right to cancel your requestand pay back your money if you're rude, dishonest or disrespectful."
quoting Aciva, strikeouts aren't hers!
"Customer Rights:
*You can post it on your own site or any account you like, except the SoFurry site (They have 'art' categories like "rape" and "gang rape" - yuk, so I'm not having anything I create there).
*Prints or copies of the art may not be sold, unless I give permission.
*Wherever the artwork is displayed, you MUST credit me for creating it. (and not in blurry writing you can't read!)
*The artwork is for (essentially, see below) personal use only unless discussed and agreed upon before payment is received. Note that I already said you can post it on art sites like FA/DA and on your own site, that isn't counted as non-personal use.
*You may not sell the artwork in any way. Exception to this rule is that if you sell the rights to your character to someone else, you can include the rights to this art of that character in with the sale (it is of the character, after all). But in that case, you are selling your Customer Rights to that buyer-person, and you must make sure they understand these terms - they're under them now!
*You may enter it in art shows, contests, etc. as long as you make it clear that I created it (ie not claim it as your work).
*It may not be used as as watermarks, logos, covers (books, CDs, etc), ads, etc. unless I give permission.
*You can print it on gift things (tshirts, cards) as gifts for people you like (you may not give it to relations you have to endure! I don't want it wasted!).
*You can include it in a commercial project if it's sort-of incidental (eg your autobiography can include the commission in it; a picture-CD of your art can include this commission in it too; but not the cover art of a music CD unless I give my permission). In all cases it has to credit me for drawing it on the same page (not buried in the list of Picture Credits somewhere else), and in this case which site you commissioned me from.
*If you buy a sketch or line art from me, you have my permission to color it yourself or to have it colored by another artist. Please just make sure you and the other artist includes written credit if the image is re-posted to gallery's, colored or otherwise.
*No edits or alterations to the picture! If you want something changed, say so early!
*You do not have ANY rights over the WIP sketch, whether the commission goes ahead or not. (You may keep a copy, just as if you had collected a picture from anywhere else, but may not post it anywhere or aything else.) If you want it, contact me to buy it under the same terms as the commission. But it will cost less.
"My Rights as an Artist:
*I may post commissioned works on any of my accounts on any site. Or onto any site.
*I may put any commissioned works into my art portfolios.
*I may put it in ads (which will be for me/my commissions/my other works/something I'm involved in/my company (if I ever have one)/etc.). I will not put it in an ad for another company.
*I may enter commissioned works in contests and art shows.
*I have the right to decline any commission before money has been exchanged.
*I have full rights to the commissioned artwork.
*If you post something that was previously marked as 'private', I have the right to upload it as well.
* If I custom design armour/etc for you, we jointly hold complete rights to the idea/design (separate from the drawing of it) - ie you can use that design in a work you draw/commission someone to draw and sell that etc. as you like. Same for me (though I probably won't, and I certainly won't claim to 'custom design' it for another customer later!). In both cases, though, the artist (me) or the commissioner (you) have to be credited for designing/commissioning the design (eg if you make a comic with the custom armour on one of the characters, the credits have to include "(Name of it) armour design was a commission by KitKat, http://www.furaffinity.net/user/kit.....elilnine/". If I include it in a request artwork, I will credit it as designed for you.)
"Gifting:
*I am not responsible for any drama or issues that may arise if I am commissioned to draw for someone who is not comfortable with me drawing them.
*If you have had someone commission me for a picture of your character and you are not comfortable with the image, please contact me to take it down.
"Working with multiple clients:
*I don't. In the instance I get hired by someone who wants me to work with multiple people over a single image, I say 'no'. I will work with the person who sent the payment-- this person is the 'lead' in this situation, it's up to that person to talk over WIPs and what they want with each other, before the 'lead' contacts me. This is to prevent clients contradicting each other, not knowing what they, and their fellows want, and often times-- causing confusion and stress for themselves, as well as me, the artist."
Section is quoted from Dr. Pickell, though modified considerably. Thank you!
I don't offer refunds. Check my art beforehand to see if I'm the right artist for you.
Customers who get nasty will get blacklisted and their work cancelled. There will be no refund. This is your only warning.
I will not ignore your messages, if I take awhile to respond please be patient!
The end result will be a .jpg file, not a physical copy. Most other file formats are available on request, and I can provide the commission in several file formats together at no extra cost (unless you want more than 7 different formats, in which case I'll charge another$3 $2 for the click-click-click factor.)
Deadlines: Once I've agreed to your commission, work will be done as soon as possible, which may be within a week, or it may be longer! It depends on the que. Also, unrelated delays occur without my approval, and can't be predicted! State if you need it by a deadline, and I'll tell you definietly yes or no. You can ask for updates as often as you like, as long as you're polite. I will give updates if something causes delays of more than a day or so. Just be patient. Good things take time.
There may be some delays in the near future, please note.
"Disclaimer: It is not my legal responsibility to make sure that a customer agrees to the Terms of Service when commissioning me. It is the customers responsibility to read the Terms of Service in full and agree to it as a whole or ask questions if they are uncomfortable or confused with some things stated.
By commissioning me, on the payment being received, I will assume that the Terms of Service has been read in its entirety and everything stated has been agreed to. The Terms of Service is here to protect the customers as well as the artist and is completely necessary."
Quoting modified Dr.Pickell's disclaimer too. She writes as well as she draws!
All pictures are Portrait orientation. Landscape is available if you ask.
I don't stream commissions. I work odd hours, but I'm not willing to stay up till 4am to stream for you becuase of time zone differences. Plus commissions are not 1-hour jobs.
An exception - if you want a flat-coloured very sketchy sketch, note me about whether I'm available to stream it for you. I may be able to.
