Terms of Service
Art Usage
In a commissioned piece, I own all rights to the artwork (but not the character).
You, as the commissioner, are permitted to:
- Post the commissioned work to your FA or other website, giving credit to be as the artist wherever possible, with a link to my FA profile.
- Use the commissioned work as an avatar, giving credit wherever possible.
- Print the commissioned work for your personal use.
- Use the commissioned work as a badge, credit card background, or other personal item.
- Use the commissioned work commercially IF this has been discussed with me and I agree to it/have given permission.
You, as the commissioner (and anybody else) are not permitted to:
- Use the work commercially in any way without prior permission. This includes selling prints, merchandise, books, CDs, featuring the art. A licensing fee may be required before you can use the art commercially.
I will never use commissioned work for commercial purposes (prints, merchandise, etc) -- except when I have permission from the commissioner, or for "collections" of work (both commissioned and non-commissioned) in the format of a portfolio or art book.
Payment
Payment is to be made upfront for commissions under £20. Commissions worth £20 and over have the option to pay all upfront or half upfront and half after the sketch has been shown.
At the moment I only accept Paypal for all clients. I will send you a paypal invoice upon accepting the commission which must be paid within 24 hours or your slot will be given to someone else. Please have payment ready at the time of commissioning me.
Deadlines
If you have a specific deadline you need the work done by please let me know at the commissioning stage and I can complete it by the deadline. However this depends on my current work load.
There is a list in the footer of my journal on the status of each commission. University work is more important than commissions and will always come first which may create delays.
Refunds
Refunds (full or partial) will only be given if:
- The commissioner requests a refund after 1 month of waiting for their commission to be completed. (the exception being if there is a que of 5 or more people in front of them.)
- The commissioner is genuinely unhappy with their commission (a partial refund will be given, or the work re-done) (specific reasons must be given)
- I cannot complete the commission for whatever reason, whether it be personal, lack of skill, or a difficult commissioner to work with (a full refund will be given).
I have the right to cancel a commission and give a full refund at any time for any reason.
Sketches/WIPs
Unless absolutely necessary, WIPs will not be sent to commissioners as this slows down production. The exceptions are - if the commissioner requests, or if I am unsure of something. I can take WIPs while I work and send them in bulk at the end. I prefer making changes once the piece is completed.
I will only send sketches for approval before payment.
Fixes
If you are genuinely unhappy with your commission as a whole, please discuss this with me before giving negative feedback and I'll see what I can do.
On Sketches:
When I show you the finished sketch you MUST tell me about any mistakes, additions or other things you need to.
You can have ONE total restart. This means that if you really don't like the sketch I can re-do it completely but only once.
On Final Images:
In final images I can do MINOR colour revisions only. I can not add extra props, lineart or tattoos.
Communication
I can be reached via notes, or emailed at orewakei[at]gmail.com (note that this is NOT my paypal address).
I am usually very prompt with communication, however if you do not receive a reply straight away, please wait at least 5 days before emailing again (unless you have something to add or wish to speak about a different subject).
