Commission Terms of Service v.1

So before I set up a commission sheet and all, I want to write a few pointers here for what you will get:
-I will do my best to provide high quality artwork.
-Commissioned artwork will not be started until at least half of the payment is received, after a sketch has been approved by the client to be painted, I will require the remaining amount if full payment wasn't done upfront.
-Payment will be done through paypal only
-Commission slots can be reserved without any payment upfront.
-Waiting time for commissions may vary, since I will try get the best results I may take some extra time working on it.
-When I finish a commission I will upload it to FA* in a FA size friendly format (around 800-1200 pixels) you can ask me for a high-res jpg (around 2000-3500) and I will send it to you by email.
-There are no hard rules about what you can't commission, I'm very comfortable doing NSFW artwork and a variety of fetishes, most of the times I will be at least willing to discuss any type of content/fetish.
-I reserve the right to use the commissioned artwork for any purposes, personal, commercial, or otherwise unless previously discussed*
*If you require a private commission/ want discretion or ask for artwork that can't be uploaded you will need to tell me in advance and i will charge an additional fee of 20 USD
-If the artwork needs to be done quickly by a certain deadline, a rush fee of (40%) of the price will be charged.
-A client can post artwork they commissioned from me anywhere as long as I'm given credit for the piece.
-Refunds are only provided at my discretion, and as long as the artwork hasn't been started.
-Artwork commissioned can't be used for commercial proposes unless previously discussed.
-The client is not allowed to Alter or change in any way the finished work or the sketches received as part of the commission, if an edit is required it will be discussed and I may charge an additional fee.
-If I missed something that is in the brief/ reference I will provide the changes to the finished work without any additional fees.

That doesn't sit well with me, being a fellow that rather enjoys making after-the-fact edits on my commissions. That said, considering your style and how difficult it would be to emulate for additions or changes, one probably wouldn't do so anyways since it would almost certainly stick out like a sore thumb. Still, the limitation would make me balk at commissioning you, even if I had no intention of testing its limits, since I should expect that which I pay money for is mine to alter in whatever ways I see fit and, should I choose to, re-posted (with credits given to the original source, of course). This is all besides the fact that it is a rather difficult (read: impossible) rule to enforce, what with the proliferation of image hosting sites and the use of dummy or proxy accounts. If you were to go after someone doing as much you would be more likely to lose them as a money source than gain any new ones for it.
This actually goes into copyright laws, when any piece of artwork is created (commissioned or not), unless it's stated to be Work-for-Hire, the owner of all the copyrights is the artist and only that person can use whatever he/she created.
Most of the times when people commission artwork they also buy the rights to use that image, how many rights they get, (for example if they can make x amount of prints and sell them) and how long they last depends on the agreement.
What I include with my commissions are personal use rights, so people can show it, print it, upload it as long as they don't get commercial gain from it.
So even if somebody pays for the creation of an art piece and gets rights for personal usage, the copyright holder is still the artist and altering the artwork needs the creators permision or the possesion of the rights to alter it.
Anyway after some of that legal stuff...
The reason why I discourage modifications to my artwork is because, as you stated above, an edit would require painting knowledge, light, composition, and a lot of other things, I wouldn't like somebody changing something on top of a painting without knowing what they are doing, and if that image gets reposted, while it may be obvious it was altered, potential clients may think that that modification in the artwork was made actually by the artist herself and if it's too bad,be discouraged from commissioning that artist. Thus actually damaging the artist's reputation.
This is why I state that edits will be discussed, because I know what will work and the best way to implement those changes in the piece, also most of the time I won't mind doing small edits, I will only charge a fee if they are too many or the change is complicated to do.
Also you are right, in the end, as every other copyright law, enforcing it at all is practically impossible.
Fair enough. Worrying about your picture's quality being reduced due to amateurish edits is an understandable fear, as is the potential damage to your reputation. I would argue that allowing edits to take place as long as the original is shown beside it/clearly linked to would alleviate such concerns but, in the end, it's your work.
Since my interest lies in the MLP fandom, which plays host to simple designs that make for quick and easy editing, I place more emphasis on the rights to edit my commissions since I often like to tweak colours or make different versions (for example, I happen to have a fondness for pacifier gags >_>).
I'm VERY excited to see you're re opening commissions. In the past I've always adored the extreme amounts of detail that you have put into your backgrounds. You even posted a very realistic diaper painting with one of your characters modeling if I'm not mistaken; which was extremely impressive in terms of realism and detail. I have seen many deals, many artists opening and closing their current schedule for commissions, and several several YCH's come and go. Either a lack of inspiration, or a lack of funds has thwarted any commitment I could give towards an artist for a commission. However, recently I've been given an Idea that I WILL see come to life. With this inspiration several respectable artists that I admire came to mind, but your background detail and style stuck out the most in my mind for what I'm wanting to have done. I await eagerly for commission sheet and the green light to note you the details for what I have cooking up. Can't wait to hear from you, but please feel free to respond at your own lenience.

Well that sounds like it's gonna be a very interesting commission to work on!Also I swear I will open slots soon, I just want to finish what I'm working on before!
Do you have certain content you'll refuse to do for commissions?
