Subject Matter and Commission Usage Rights
I, the artist, reserve the right to refuse any request under any grounds I see fit or necessary.
Specifically, any subject matter that I feel may be too adult or pornographic in nature will be refused immediately. If you are uncertain if the subject matter of your commission may fall into this and be objectionable, feel free to contact me via private messages or email. This kind of stuff can be tricky to sort out and can go on a case-by-case basis.
I also reserve the right to use the completed, non-watermarked piece on or in anything I see fit. This includes, but is not limited to, posting the completed piece in my online gallery or on my personal websites and inclusion the pieces in art portfolios.
The customer may use the commissioned work for any non-commercial purposes. The image or piece may not be resold in any way, shape, or form unless prior commercial rights were granted. The customer may not attribute the artwork as part of their own work or as an others. Cropping or altering the image for non-commercial uses such as avatars, banners, or to simply upload to their galleries is allowed. I would highly prefer if this was done, that the commissioner would provide a link back to preferably my website ( www.pdsteamworks.net ) or my gallery with proper credit.
Full commercial rights may be purchased if desired. Please contact me about it and we may discuss it further.
Payment and Refunds
I prefer to collect payment at 2 points. The first payment directly before the commission is started, after it has been agreed upon by both the commissioner and myself, and the second payment upon completion of the piece before the final image is sent. This is partially open to discussion as well as how much of the commission price is paid before and after the piece has been completed.
If the first payment has not arrived within one week after we've discussed and agreed on the commission, I will take this as a sign that the commission is canceled and remove it from my work queue.
If the customer cancels their commission before any work is done, they will be removed for the queue and, if it has already started to be paid, refunded.
If the customer cancels their commission after work has begun, they will receive a partial refund depending on the amount of work complete. (IE: Someone commissioned a maquette, then canceled after I completed the rough sketch and the armature, I get paid for the rough sketch and armature and the rest is returned)
Refunds will not be given if the commission has been completed.
The prices shown here are for what is listed here. There may be special offers posted in journals that are not part of this post (IE: Iron Artist, Sketchmissions, etc) that may have slightly different terms or rules then what is stated here. In these cases, rules given with those special offers that may confict with this commission info/ terms of service will be superceded by the special offer's specifications.
A few small notes about commissions involving polymer clay commissions specifically.
Shipping completed pieces can be a slightly hazardous process and can potentially harm delicate pieces. As such, I am extending a form of limited liability on finished clay works depending on how badly the piece is damaged within 3 days of arrival. Depending on the severity of the damage, options may be discussed or a partial refund requested within that 3 day period. Refunds due to damage may not exceed 20% of the initial commission price.
The other article of note about clay pieces is when it comes to shipping. Due to the potentially wide variety of different sizes, shapes, and weights of finished pieces, I will be unable give an accurate estimate beforehand of what the shipping for most pieces may be. Because of this, all polymer clay based commissions will have a small additional fee added to the secondary payment to cover shipping. Unless otherwise discussed at the start of the commission, I will be going with the cheapest rate possible, be it a flat-rate box or other service from the post office (USPS) or a courier service (FedEx, UPS).
As one final word on the pricing in general. I realize it may seem a tad inconsistent, with some of it going at a flat rate that builds up and others going by an hourly rate, but these prices are currently being based on what I feel my skills are worth and what would be a reasonable assessment of value for their worth. If for whatever reason you feel the prices are not reasonable for the services offered, thank you for at least looking through my gallery and considering commissioning a piece and may you do well in your art-collection future.
Acceptable forms of Payment
I currently accept and semi-prefer cashier's check or money orders. Paypal is accepted as well, but not preferred due to their rather flippant nature and usage fees.
