i need to take this opportunity to explain our identification method, as my lawyer requested.
this is being handled by an experienced adult film lawyer. who is treating this 3d cartoon porn no different than any of the real life human porn from the many years past. to him there isnt any difference.
upon ordering one of our videos, a customer must provide their home mailing adress (we wont accept p.o. boxes). this adress holder will be held legally responsible if there are copyright infringements. peach fuzz is legally protected under title 17, sections 501 and 506.
once the request for a film is made, we re-render a brand new copy that will have several "markers" hidden within the film in many places. for example if "roger fox" orders a copy, i will make a new rener that will have a certain clock on the wall in one particular scene, and a little crab way in the backround of another. etc...
if rogerfox decides to make a copy to hand to his next door neighbor, there isnt much we can do. just dont upload it online anywhere, because if we find it, we download it, watch the film, and the film will tattle tail to us which customer it was sold to. even with me explaining exactly how we are doing this, there is no way round it. you wont know how many signs there are, what is or what isnt a sign, where they are, or when they are, how many they are.
lets say two people each buy a film, and work to clip them together to make one film, using scenes from both copies.... both customers end up in court. one at a time O.o
i dont suggest tsting this, if you do i cannot stop you, and at that point, this offending customer will then be contacted by my lawyer, if they cant be reached or found, then a federal agent will do the contacting. and whichever state the offender resides in, will be the on that pays for the fees of our flight and court processing. both opius and i, my lawyer, and an agent, will be present in court. and if the offender is not 24 years of age, the united states will not recognize them as financially independant, so their parent or guardian will need to be present. in the end it wont b a negotiation. the agent will have the evidence that the video was reposted, and a fine will be incurred.
this is not a joke, and i have done this before. i know for sure that some poor guy is gonna call my bluff, i feel kinda bad for that person but it will be necessary. because i promise that after that first event occurs and they end up with a fine (there will not be warning letters, CND's of any kind, just an aperance in court face to face, and a fine) then no one will repeat it. i promise you that ;)
this happened once before. someone who i wont name, offended my copyright, and since the poor kid was only 18, his parents ended up with the minimum 700 usd fine. im sure he had a serious talking to when he got home.
people dont realize that simply writing "copyright me" in the corner of your art doesnt mean anything. not since the late 1970's.

if someone who resides outside of those places, not much i can do then, only the DMCA can handle that.

first one that tests the rope gets to meet me face to face. not that im gonna say anything. my job is to sit down and shut up. while my lawyer talks, then an agent shows paperwork, then a fine is slapped.
it IS gonna happen. somebodys gonna be dumb enough. and it needs to happen. cause then once it does it will never happen again and i can sit back and relax and not have to take anymore plane rides. except for cons of course :P
Just watch out for fake names and address, I've seen people try to do small details like this get blown out of the water, friend of mine gave up because it was a bit too overwhelming for him that he was loosing all this money to people who like to share a little too much, and chances are they might try to do it when you've already posted just over several hundred to different people.
I'm also more then sure all the fur haters out there would love to give this challenge a try...
I am curious as to what you might try to do if you catch one person, but the video he posted on the pirate sites is already getting spread out like a drug/virus/whatever, because of all the other fanatics in the pirating business...it would end up being from ONE person taking the hit, to thousands of people you have to try and track down just to make sure every single copy of that file is not in the wrong hands. it's going to be a tough chase, just hope you don't have to deal with the bull shit like every other company is and stuff.
I'm not going to sit here and sugar coat this and say it's an awesome idea, it's been done I'm more then once I'm sure, I'm just saying be careful of who you trust both in and out of your company and be sure you send it to people who you know for sure the information is correct, just keep in mind that your video will most likely (If you like it or not) going to be posted on a pirate site, the chances are staggering, especially since in a comment i read on this earlier that people are already seeing this as a challenge, so if you want to avoid this, keep on your toes... once they realize that your guard is even down for a second, it's over..

UNLESS of course they say "i sold it to someone else, it wasnt me who uploaded it for public redistribution". in which case the rules change completely, and now the person is tried for a fine of 250,000 and or up to 5 years in prison.
if they say "it was lost or stolen from me" then they are simply tried for the foregoing.

FYI: if you're selling the person a DVD, then this statement is untrue on every level, thanks to that lovely little bit of copyright law known as the First-sale Doctrine.

Basically, if a person buys a DVD of your Peach Fuzz movies from you, then they legally own that specific DVD and are allowed to sell it / give it away to another person without penalty. If you're going to play e-lawyer, DO A LITTLE BIT MORE RESEARCH FIRST.
(If you're selling them, say, a WMV file, then I'm not sure how/if First Sale would apply to wholly digital goods, but I'm not a lawyer and I'm not about to get into that sort of argument.)

Going with the DMCA is a good idea though. Having that extra back up is essential to fighting the tyranny of thieving ninjas and pesky doppelganging pirates here on the internets.
this is a federal copyriught. under title 17. the dmca only handles gaining IP info and such if the person who offended resides in a place other than those i listed.
thats why this is so harsh. it isnt a little 'dmca interweb warning". its a federal investigation warning. it will be handled in real life by real people who will send a letter. which will contain a summons. if you fail to show then a warrant will be issued for your arrest. which allows the state to legally seek any information that will lead to aprehension.
to those who dont underatand i urge you please to look it up.
its the same kind of warrant youll get if you fail to pay a fine for something as simple as a speeding ticket.
they even have the right to show up at your job to take you and put you in the back of a car, bring you in, make you sit and wait for a couple hours, before taking your picture, checking your record for prior warrants and blah blah blah and so on. it sucks trust me. x.X

Maybe in the trailer you've seen some recognizable items or textures, but in the films we're going for 100% Peach Fuzz made content. As for bvh files, we cooperate with animators and inform them personally about what we intend to do with them.

Like someone said earlier this is fairly small time and I doubt the FBI is willing nor able to run down everyone that touches the inevitable internet copies. There are bigger fish to fry. Terrorists, child molesters, and other much more worthy nuts. All they'll do is slap a couple wrists and move on with more important things. I had originally reserved that for Spore and Spore alone. Thought nothing beat having to pirate a game you just bought so you could install it with a cracked iso then use your legit cd key. I'm sorry, but this shit is hilarious. It's as if you have no idea what you're doing. Do you have any idea what goes into creating a final master?
First of all, to have every single copy be unique, means that you can not mass produce the content. Every copy will have to be unique. Rendered individually, encoded invididually, compiled as a DVD ISO individually, then each DVD would have to be burned individually. You couldn't just burn off copy after copy after copy The manpower and resources that would go into such a system would hurt your profits or at least your profit per manhour invested sevrely. Probably worse than piracy would.
The only way this would work, was if you expected to have so few sales that it wouldn't overwhelm you, and in that case, you'd have no need to threaten people with your lawyer with a degree from The University Of Wikipedia. (You know, YOU.)
This idea could actually work if you were distriburting copies to conventions for public showings, to keep the convention staff from pirating the material, and because that would only require a very limited run of unique versions. For the the retail product? Ha ha, no.
And what are you going to do for non-online sales, like those at conventions? Require everyone to give you their name, address and phonenumber? Supply photo ID with their addresses to prove their not lieing? Good luck! Ha ha ha!

there is no peach fuzz website ready yet. we havent had time. the other few methods of identification and anti piracy are standard to adult films. however this one i came up with on my own after consulting with some old friends in the industry.

So you also plan to skip out on any money that can be made though convention impulse buys? Seriously, buying online, you gotta go to the website, get your credit card, order it, wait 4-6 weeks for delivery, then watch your money. At conventions, people can hand over cash and get instant gratification, one can sell a lot in person at a con pretty quickly if they have what people want.
Okay, seriously. There are two possiblities here. 1) You are actually foolish enough to think that this anti-piracy plan will work. 2) You know that this is bullshit but are using it as a bluff, a scare tactic to try and prevent piracy, and are foolish enough to think that people will buy into it.
Not to mention, even if this plan DOES work, ya know, in some world where people wear hats on their feet and hamburgers eat people, all you can do is 'bust' (With legal cost and time that would be particularly lengthy if they try to fight it) the content can still get online and people will download it enmass. Not to mention, furries are POOR, even if you tried to sue someone for lost revenues, they'd be insolvable on account of being unable to pay. You have little chance of stopping any torrents as well. If all the holywood studios can't stop torrents with their real lawyers, what do you think your pretend lawyer is going to accomplish?
as for costs, like i said, everything that needed to be spent. has been spent. and if anything occurs, i dont do any work, im at home, while the state or province that the offendor resides in, has to pay.

Not really. I never had any interest in buying this product (it's Second Life porn, for fuck's sake), so I don't care about defeating the "copy protection" scheme. I do think Ganador's going to great lengths to scare potential customers about piracy and being litigated/prosecuted if they do something as innocuous as give away the DVD to someone else (which, as pointed out above, is perfectly legal). Like any "copy protection" scheme, Ganny's plan is intent on treating his legitimate customers like criminals just for buying his product ("Hi! Thanks for buying my stuff! Now give me all of your personal info so I can sue you blind if even part of this video shows up on the Internet!"), and anyone with any form of common sense (and a good deal of research into past copy protection schemes / DRM) can see just how horrible this plan is because it won't deter pirates at all -- just like the CSS protection system on DVDs, Apple's DRM on iTunes MP3s, and the Blu-Ray copy protection scheme, it'll eventually be cracked or circumvented, and then the product will be out everywhere, while the legit customers will still be treated like criminals by being forced to submit to the scheme or go without the product.
Ganador's plan is hinging on two things:
1.) People being stupid enough to sink money into DVDs full of Second Life porn (on a personal note to people like this: what the fuck I don't even)
2.) People being stupid enough tp not realize that they're being treated like criminals just for buying said DVD
And the sooner more people realize this, the better. Ganador is an egotistical idiot, and I will do everything I legally can to see that sales of his DVDs (if they're ever even released; ten bux says he bails on the project just weeks before it's ready to ship and takes all the money with him) are as shitty as possible.

i should probably add, for the knuckle heads out there, that most of the music in the trailers are not licensed. and again the trailers are not for sale. they are fun videos made to entertain no different than any other machinima. and are used as an example of the kind of art we are capable of. the design of our avatars, the ability of our camera work, and most defanately to also show off our ability to match the right voice with the right face.
but again thats all subjective. whether our avatar designs look good and so on, is a matter of opinion :)

If you sell a DVD of your product to a person legally, they legally own that DVD and they can legally sell it/give it away to another person without repercussions. If you really think this is a good idea, you should defend it against all attacks. You should be able to answer all questions about it and explain how you believe it won't impact your ability to do business. And yet it's the same court decision that's stood since 1908 that sets the First Sale Doctrine above your "contracts". The US courts (specifically, the case NEBG, LLC v. Weinstein Company Holdings, LLC) have upheld that buyers of retail DVDs in the United States are free to sell / exchange / rent / lend them to others without repercussions. Your product would be a retail DVD, and no matter what your (e-)lawyer says, no contract can violate the First Sale Doctrine, since it's a right that's been afforded to all consumers since 1908.

It's funny that a movie made using such a contemporary medium is being pushed out with one the most ridiculous IP protection schemes I've ever heard of. Digital content can't be encapsulated, regardless of whether a single individual or two will get fucked with legal fees --there's one billion people using the internet now. This seems more motivated by being vindictive than anything else. Also, far few people will buy it.

Hey Ganador, heres a little tip: If you actually wanted this to somehow work, it would have likely been a better idea not to scream "HEY GUYS THIS IS EXACTLY HOW I'M PROTECTING MY VIDEOS RIGHT HERE" for people to look for and go around.
There are a lot of things wrong with this...of course I don't expect you to admit them, but regardless:
1. Furries tend to be private people. A lot of furfags don't mix their fandom and the rest of their life...they won't give you their real address. You get less money.
2. People in general don't like having their personal data stored, let alone one that can be tracked back to a porn movie...let ALONE one as weird as this..... LET ALONE data that can be used to sue them. You get less money.
2a. All you need to do is pick a random copy of this "movie" and throw it online and you can sue the shit out of someone. They don't even NEED to pirate it, you could easily frame them. Not saying you would (I have my doubts), but the fact its possible and you could get away with it makes people weary, so they don't buy. You lose more money.
3. 10+ people from a piracy group buy copies using false info. Oh my, you get money! What you don't get however is the money from the movie they make out of it, mixing their copies together to put all your "signs" into a single film, or possibly remove them all together, and all the signs remain lead back to false addresses or stolen russian debt cards. You lose a lot of money.
4. People make a personal effort to pirate this for the reason you're being snobby about it and you say its impossible. *Never* say someone can't get away with piracy, that is seen by some as a challenge. People download that copy for that same reason. You lose a LOT of money.
4a. People download it out of pure spite. You lose no money because they wouldn't have bought it anyway.
...Where exactly did you see the good in this plan? All aggressive anti-piracy does is make someone look bad. Bernal is, again, a good example of that. I hardly hear of SexyFur anymore because people just don't like him, but I hear about Club Strips constantly, a site that is known for its lax attitude of site-rips.

there are multiple methods to antipiracy that are placed when copyrighting an adult film. this particular one is not part of them.

It's actually quite a clever way of tracing illegally made copies, if I do say so, myself. If they are as subtle as you claim, (and I'm not doubting it, for a second), there's no way to tell what's a marker and what isn't. It would take a dozen copies, analyzed frame by frame to even attempt to crack something like that. And frankly, anyone willing to put that much time and effort into it, deserves being hit with the full force of the law.
I don't know if I'm going to order anything from Peach Fuzz or not. For one thing, right now, my computer isn't anywhere near being able to run something that complex. Plus, I'd basically be paying for something, sight unseen, and depending on how much you're planning on charging for these, it might be a significant financial gamble. That's all in the future though, for now. One thing I am dying to know though. Did you really work in the adult film industry, IRL?

as for working in the adult industry irl? yes, for quite a few years. normally you find trolls posting nothing but the least complimenting stuff possible. like gay porn from back in the early 2000. but ive actually been in a variety of things. and im not ashamed of any of it. i enjoyed the job at first, then it started to tax me physically. tiring and getting yelled at alot. you also get told what to odo alot. kinda hard to exp;lain. i guess it feels like your 15 again and have a curfew and get scolded and such.
as for your computer being able to run something complex? im not sure if i understand what you mean. these are videos, that can be played in windows media player. or quicktime player as well depending on the format we render it as.

As for the adult industry stuff, I was mostly curious. If I need any specific background info on the subject, it's nice to have a real person I can ask. If he was planning on just selling a few copies, sure, it'd be something of a neat idea. But I get the feeling Ganny's going to be trying to sell these DVDs in numbers that are larger than single digits, so it's going to make the entire process time consuming and costly if he plans on rerendering an individual scene for each individual DVD he sells. what happens is someone gets fined. a sepena is issued for the person that the federals name and if they do not show then a warrant is issued for their arrest. in court there is no back and forth unless a lawyer is hired by the accused to attempt proving that their client did notcommit the offense. these proceedings so far are payed for by the state or province in which the offender resides. and the fine they pay goes into the pocket of said state, not mine. i receive nothing from these proceedings.
however sueing for damages is something that would cost money out of my pocket, and would be a longer more complicated event.
to answer your question about who is penalized, the person doing the uploading is the only one, and it is up to my lawyer to figure and decide whether the site that was uploaded to can also be penalized.
anyone who has downloaded the video from the site after being uploaded by the offender, cannot be touched in any way. so if one guy uploads a video, and 20 guys download it. those 20 guys cannot be penalized in any way shape or form. unless i were to go out of my way to sue for damages. which requires proving alot of things and a whole bigger mess.
the only person penalized is the one doing the uploading, and possibly the site it was uploaded to.
the sepena is whats given to web sites to force them to disclose all the info on the patron who offended, totally different definition. :)
