RA Ink Terms of Service (Revised Oct 13th, 2014)
RA Ink/the artist described below pertains to any and all person(s) involved in the creation of an image. An "image" is defined hereby as the product created by "the artist" or the end result of any or all of the artists time/labor. A "request for hire" is defined as any act or attempt to hire the artist to create an image. The "final price" is determined by total base cost of the image(s) in addition, but not limited to the following: Extra characters, complex character design, backgrounds, and comic panels. Revision(s) are defined as any non-anatomical changes to an image, such as coloration/patterns of an image, they do not include any changes to the pose, relative size, additions and/or subtractions to anatomy. Any revision requiring said changes are at the artist's discretion based off of the accuracy of the information/references provided to create any image(s).
By commissioning RA Ink you (hereafter "the commissioner") acknowledge that you have read and agreed to the following Terms of Service. Upon reviving a request for hire, the commissioner will be contacted and given confirmation for their place in queue. Upon reviving said confirmation, RA Ink will invoice the commissioner for the final price of the requested image(s). Image(s) will be completed upon receiving confirmation of the commissioner's payment. Upon completion of an image, the commissioner will be given the chance to review said image, and request a revision. Revisions are limited to once per requested step. Once the image is finished, no more revisions will be made without possibility of additional cost. An image is finished once the commissioner accepts the completed image, and/or has made their one revision after the final step. Steps will be broken down in the following manner: Sketches/Line Work will have one step, and given the chance to review/revise once upon completion before the image is finished. Flat Color/Shaded/Full Color will be given two steps, one upon completion of the Line Work step, and another upon completion of the image before the image is finished. If the commissioner does not wish to halt the commission process, and chooses to pass on the first steps review of any Flat Color/Shaded/Full Color image, then only one revision will be applicable after the image is completed, before it is deemed finished. The finished image will then be sent to the commissioner in the manner they request, or email by default; Custom image re-sizing is available if the commissioner would like to receive a more manageable sized file along side the full resolution file. All Images will be saved in PNG format (PSD/Sai Files will not be distributed). RA Ink withholds the right to refuse any request for hire at their discretion. RA Ink, and its associates, will not be held liable for any damage, loss, or any other civil/criminal charges upon the completion of an image. The commissioner hereby agrees that any and all references submitted to RA Ink for the creation of an image is their own, and/or they have permission from the owner of said copyrighted materials to use their property. Any and all liability will be placed upon the commissioner in the event that services were sold under false pretense. In the event that the commissioner wishes to re-post an image, RA Ink gives the commissioner (and only the commissioner) permission to re-post any finished image as long as the following criteria has been met: 1. The image can not be altered in any way including, but not limited to, the removal of the artist's signature; 2. The artist receives credit for posted image; and 3. The commissioner dose not gain any monetary value from any re-posted image in any way. The commissioner may, however, re-size or crop the image, as long as the artist's signature remains intact (An exception will only be made at the artists discretion in regards to the creation of personal avatars or the like, with contingency that credit will still be given to the artist). RA Ink withholds the right to amend or modify these Terms of Service at any time without prior notice. The commissioner will be held responsible to ensure that any amendments/modifications have been changed upon the request for hire. No refunds, all sales are final.
