Commission Agreement and Terms

This is commission terms and agreement journal entry. Slots and discussion entry will be posted a bit later (~15 min)
I - General
- this is an agreement between me (artist) and you (commissioner);
- by ordering me a commission you confirm that you've read, understood and agreed with these terms;
- I keep all commercial rights for my drawings: I may upload them to my galleries and portfolios, print them, use them and/or their parts for advertising, art examples and Patreon rewards, unless the opposite is specified personally. I may not resell any commissioned drawings to 3rd persons;
- you keep all non-commercial rights for the ordered commissions: you may upload them to your galleries (or wherever you want), print, use them to make badges and avatars, etc;
- you may not make any physical changes and/or remove copyright text from finished images (excluding making wallpapers, badges and avatars for your own purpose, cropping allowed);
- I may upload WIPs and stream drawing your commissions, unless the opposite is specified;
- you confirm, that all characters to be drawn are either owned by you, or neutral (random), or their owners allow using the characters. I won't request any confirmation, but if something goes wrong, I will always take side of character's owner;
- if you're about to order adult content, you confirm that you're of legal age in your country;
- I reserve the right to reject any commission or commissioner which/who I don't feel comfortable to work with. At any reason, any time;
- if there are going to be any changes in these terms, they won't affect active commissions;
II - Queue, timing, technical info
- you may get into my commission list via special journal entry (commission status is always available at my front page);
- if there are several contenders to a slot, I reserve the right to choose the one I'm more interested to draw for;
- no deadlines. Usually it takes me about 15-35 drawing hours to do an art from blank. Split into days, this may take several days to few months;
- commissioner gets HD and web sized png files, all the WiPs and speedpaint video (if there is any);
III Execution order, payments
- approximate price is estimated on your requests. Once all details are settled, I make a really rough sketch for you to approve;
- I keep ALL the rights for my sketches, meaning they are for discussion/approval usage only;
- once you approved the sketch, I request payment and start working on your commission;
- you may split the payment in 2, however I need at least 50% prepayment to start working;
- no arts will be finished and published until fully paid;
- if customer fails to make rest of the split payment in 3 months after request, the art is considered to be cancelled with no refunds;
- I reserve the right for a full artistic freedom while working on commission, meaning all changes you want to make after the sketch was approved are discussed individually, major changes may also affect the price;
IV - Cancelling a commission, refunds
- you may cancel your commission at any time;
- I may cancel your commission at any time;
- I may use cancelled commissions as my own arts, including making YCH auctions. In this case all personal character details will be deleted;
- customers, who cancel their commissions, are removed from the queue. However, they may try their luck in the future;
- if commission is cancelled by you, you will be refunded for as much as possible according to the work done, but no more than 75% of the whole price (or half of prepayment, if using split payments);
- if commission is cancelled by me, you will be refunded for 100% whole price (excl transaction fees), regardless of the work done;
V - Content, style.
- style, content and pricing are described in my official comission description;
- realistic or adapted character scaling, all creatures belong to their weight categories*;
- no sex between species of strongly different size/weight categories (may be discussed individually);
- How can I get a slot?
Keep your eyes on my updates - I will always announce new slots with a journal entry and a visual ad.
- What about macro? What is reasonable macro?
Well, a stallion in a mice village is a reasonable macro. A really big dragon in any village is reasonable too. If macro is caused by magic, I'd like viewer to know that. For a better undestanding of macro and micro I recommend you to watch Disney's Zootopia.
* - What about drawing well-known characters?
If you mean characters from movies, cartoons, games or stories, I consider this as a fan art, which usually has no problems with copyrights... Characters created by furry community are often for a free usage.
- Can you draw a background in 3D?
Yes, I can. But I have no experience of mixing my latest style with 3D. My style is actually hard to be mixed with (unlike drawings by zaush, which are made specially for such mixes)
- You used to work with no prepayments. What happened?
Fuckup happened. Now only work with prepayments.
- Can you do ref sheets?
I've been experimenting with flats for a while, so I may give it a try. May be discussed individually.
- Can you do sketch arts or flats?
Unfortunately my sketching takes lots of time, and I find selling my sketches to be either unprofitable or overpriced.
- You prices are so high! Didn't you think of lowering them?
I set my prices, according to the drawing time spent, and I feel them to be quite reasonable. Nobody forces you to work with me, you have lots of artists to choose from.
- I've found an artist, who draws faster and better than you!
If he's willing to give me a shelter and access to his fridge, that's wonderful. Otherwise, I've got my own bills to pay, so it's all about money and timing.
- You used to have a big queue with lots of slots. Are you going to make another one long queue?
No. The thing is I forced lots of peope to wait for their queue. Even with no prepayments this feels pretty bad. So, now I'm gonna open few slots only, refreshed after the art is done. Thus I won't have anybody waiting in queue - it's "first come, first served", which makes much better chances for anyone.
- Are you going to make a special form for commissioners?
Yes, but I've got to figure technical side of it, so I'll start with oldschool journal thing.
- When are you going to open new slots?
~ 15 minutes from posting this journal.
- I have a question...
