Consumer Terms of Service for Artwork
This document is a physical contract between artist and consumer for purpose of legal documentation of agreements.
Hello, and thanks for choosing CrystalRyuu as your provider for a commission.
Below are listed agreements made to ensure the legal safety of both the artist, and the one purchasing artwork in any form (future or previously made products).
By working with this artist, you agree to:
1. All artwork deemed as “NSFW – Not Safe for Work” must have an age verification. International age of consent for all media classified as “pornographic” or “heavy gore” is the age of 18. A photo ID and documented agreement of this ToS are REQUIRED before payment. The selling artist will not distribute uncensored NSFW images to anyone under the age of 18 or those who fail to provide age verification. Photo ID must show photo, birthday, and full name of the client. This information is classified and stays between the artist and client unless used in a court of law in defense of the artist.
2. The artist will not provide services that depicts topics offensive to the artist. The artist has the right to refuse commissions for any reason. This is case by case basis.
3. Displayed prices are subject to change by artist discretion. The artist may ask for a price higher or lower than a base price based on (but not limited to) difficulty, complexity, medium, and size of each individual piece. If the piece involves a physical product, shipping estimates are included.
4. The client will provide clear visual references and/or description of the commission idea. A quote of estimated price is provided after the commission idea has been given to the artist.
5. The artist is not responsible for stolen or copyrighted images the client has not received permission to use for the commission. This includes anything the client provides in their commission idea description. By agreeing to this ToS, the client relinquishes all liability of the artist to any copyright claims made by another party. These claims will be taken directly to the client.
6. The client provides valid contact information to the artist.
7. All payments $20 and under must be paid in full before the commission begins. If the commission is more than $20, at least half must be paid before the commission is begun and the client will receive watermarked products. The remaining half must be paid to receive colored pieces and the final non-watermarked piece.
8. In the event the artist cannot accept this commission at the time of request, the client will be given the option to be put on a wait list and be contacted by the artist when their commission can be accepted. No payment is required to be put on this wait list. The waiting list is not a separate agreement to the ToS, but a promise to contact when the artist is available to take their commission request.
9. The client agrees that they have full say to make altercations in multiple stages of the piece, but once coloring begins, all work is final. The client is entitled to two complete revisions before coloring. The client will have the chance to have input during the coloring stage regarding coloring and light effects only.
10. The client is allowed the following types of refunds:
a. Before a sketch is provided – 100%
b. After a sketch is provided but before line art – 75%
c. After line art but before coloring – 50%
d. After coloring – 10%
e. The final piece (watermarked) has been given - 0%
The artist has the right to deny a refund if the client does not maintain a professional demeanor (begins to threaten, harass, etc). These refund stages are roughly estimated for physical products.
11. All communication for a commission will be kept recorded in a .zip drive available for the client at request. The client may not request another client’s .zip drive contents nor will the artist provide this .zip drive to any 3rd party without client consent.
12. Clients are encouraged to maintain communication with the artist. The artist will provide the following updates:
a. Sketch (watermarked)
b. Line art stage (watermarked)
c. Flat color (watermarked)
d. Shading (watermarked)
e. Final piece (both a watermarked and non-watermarked copy)
The artist will provide these updates within a reasonable time, but is not obligated to give daily updates. The artist is responsible to give updates involving events that would hinder the timing of the piece such as (but not limited to) injury or immediate family emergencies. If more than a week has passed without communication, the client may request refund for current stage of the artwork.
13. The client is not allowed to remove or cover the artist watermark in any way shape or form unless the unwatermarked version is used as a logo or tattoo. The artist retains ALL rights to the commissioned artwork, including the right to make prints and merchandise as well as uploading to their portfolio. Rights can be negotiated, but must be documented with a clear agreement.
14. The client may not profit from the artist’s work unless specified in agreement. Prints and display are for personal use, and to not be resold or used commercially. The artist will not claim a client’s original character(s) as their own, only claim their creation of the commissioned piece.
15. The exception to rule 14 is tattoos and logos. In the case of these, the artist is only to be credited verbally and in written manner when asked who created the original art. The artist does not require future payment for logos used for profit (i.e. band logos, website logos, etc), only initial payment and future credit during distribution. A visible credit to the artist must be distributed with each copy of the logo.
16. The artist may recycle sketches and preparatory work that were rejected by the Commissioner for other commissions or personal works.
17. The artist has the right to display all commissioned work on any personal media format. If the commission is a time-sensitive gift, the artist can delay public showcase at the request of the client.
18. The artist will discuss rules for previously made art with the client, and all discussion will be documented into the same format listed in term 11 of this ToS.
19. Forms of payment accepted are:
a. Paypal (preferred for all online and international transactions)
b. Cash (if in person)
c. I do not, and will not accept deviantart points....I'm sorry this will not change.
I will NOT do: Scat, Vore, Diaper, Excessive gore, or Vomit! If I think of anything else, I'll add it here, everything else is free game.
My prices are set, do not complain about them please!
This T.O.S is subject to change, by purchasing from me, you are agreeing to all statements above.
I will not be held responsible if you are displeased with your piece after it is fully completed.
I -may- change it for you if I am not swamped in other orders, or feel it needs a change on my own accord. I give 1-3 WIP to make sure everything is okay.
If you give me the okay, that is it. You are getting what I have shown you!
By reading and agreeing to this document, the client agrees to all terms listed.
