*side note* Sorry to everyone, I'm not too sure how the original TOS was deleted.
Terms Of Service!
[1] Commission prices as shown are subject to change based on complexity or difficulty of desired piece.
[2] Clear and full visual reference and/or description of desired commission is required to be provided by the client. A quote will be provided by the artist.
[3] Payment for commissions will depend on the individual piece. Larger scale projects will be paid in half once the sketch is made and agreed on. Smaller pieces such as sketches and inked projects will be paid in full once the initial sketch is complete. Large projects are considered as any project worth $100.00 and over.
[4] Once price has been agreed on any extra work done by the artist will not have any additional cost. Commissions may be upraded at an additional cost in coincidence with the price of desired change (such as upgrading from a sketch to an inked piece).
[5] USD only and must be paid through Paypal. Additional forms of payment will not be accepted.
[6] The client may request up to 3 changes during the sketch stage of a piece and give help with desired composition. Changes may not be made after the coloring stage (unless minor errors, which will be corrected; though only to an extent).
[7] The artist retains all rights to reject any critique on a piece pertaining to artistic skill or style (such as anatomy and shading style), or if any given critique reduces the quality of a piece.
[8] Refunds work as follows. The client may ask for a refund at any time during the sketch stage. If a refund is requested during the sketch/ink stage there will be a 50% refund, and the artist will retain all rights to the sketch/ink. No refund will be issued after the coloring stage and the painting has begun. If the artist cancels the commission for any reason, there will be a 100% refund.
•8a- The artist does not retain any rights to any character(s) in piece post refund.
•8b- The artist retains rights for any designs created by the artist post refund.
[9] The artist reserves the right to cancel a commission at any time and issue a refund due to bad communication, rude or innapropriate behavior, or inability to clearly communicate with the artist in English.
[10] Communication about commissions varies from private chat (such as a livestream or Skype) to notes and email.
[11] The artist will send messages through desired form of communication regarding commission updates to client. Clients should check in when they feel it is necessary for any updates, comments, questions, or concerns with the commission.
[12] The artist will not deal with any depictions of illegal activities, hateful imagery, or trademarked characters that the client does not have permission to use commercially. Certain fetish material are not considered for commissions, or must meet certain artist specifications. Fetish material that will not be drawn include baby fur, vore, macro, micro, hyper, inflation, muscle, watersports, transformation, and pregnancy. Other fetishes may apply, reference artist gallery for what is and isn't acceptable.
[13] The artist retains the right to display all commissioned work on any personal website, gallery, or journal. If the desired piece is time sensitive, public display may be delayed at the client's request.
[14] The artist retains all rights to the commissioned piece. This includes the rights to make prints and merchandise. As well the artist retains the right to make any changes to the commission afterwards to make changes for prints at the artist's discretion. Exclusive commercial rights to the image may be negotiated with the client for a fee.
[15] The client reserves any rights to their original character, but not to the commissioned piece itself.
[16] The client may not use any commissioned artwork for commercial purposes. With the sole exception of reselling merchansdise and physical prints. Any digital product may not be used commerically in any way.
[17] The client may create prints for personal use (displays and decorations within a private home). The client may also resize/crop the artwork for use as icons, wallpaprs, and other such, as long as it is not used in any commercial manner. All artwork must be accreditted to the original artist if shown in full or mostly full. High resolution or unwatermarked version of artwork may not be used.
[18] The artist may use any unused or rejected sketches/artwork for any future artwork.
[19] By sending any payment to the artist, the client must read and agree to the Terms Of Service listed above (and below).
Auction specific:
[1] Auctions are time specific images that could be a YCH, character designs, or one time sales.
[2] Any bids must be made within the given time frame. Bids have a minimum incriment and must be made within the given space (such as the comment section).
[3] Bids place an hour before the given deadline will bump the auction deadline to four hours from the comment's creation. Such as to prevent auction sniping.
[4] If no bids are placed at the deadline, the image will be posted as a flat-rate image for a one time sale. The base price will rise as a result.
[5] Winner must pay withing 24 hours to gain any rights to the image/YCH. If no payment is made the auction will go to the next highest bidder.
[6] The client may make no special changse to YCH auctions post auction.
