Customs/Commissions TOS (Terms of Service)

Please make sure all conditions and rules are read before buying from me.
By purchasing from me the buyer agrees to all conditions and rules stated within this journal.
I will not take responsibility for those who don't read the conditions and rules.
This TOS is valid for all customs and commissions made and posted by me.

-Section 1-
Payment Types
Accepted:
Deviantart Points
Paypal
Full payment is required to be paid up front before a commission will be started.
Payment must be sent within 7 days upon agreeing to the commission. If payment is not received within 7 days then I will cancel the commission.
If any issues arrive where a client cannot pay within the 7 days period, then please inform me.
If sending payment via paypal then please send it as 'goods and services' with 'no shipping address'. And please add your username as reference so I know who it's from.

-Section 2-
Please note I use bases when designing customs.
If wished, the commissioners can pick from those I have collected, or they can supply a F2U (free to use) base that is permitted for custom use.

Will do:
-Character designs.
-Clothing designs.
-Mature clothing designs.
-Weapon and some other items designs
-Any gender.
-Most species. (Anthro and animals are not my strong point, but I can draw them.)
-NSFW (nude reference only)
-SFW.
-Ask if something isn't listed above.
Won’t do:
-Draw copyrighted material that doesn't belong to the commissioner.
-Design characters or clothing based on copyrighted material that doesn't belong to the commissioner. Eg. Pokemon, Star Wars, Naruto, etc.
-Draw characters that don't belong to the commissioner. Eg. Ash Ketchum, Princess Leia, Naruto, Yami Yugi, etc.
-Anything I don’t feel comfortable with drawing, or not in my skills range. I will say if this happens.

Custom/Commission Progress Steps
Step 1:
I begin with a sketch using the information supplied.
Once something is sketched out it’s sent to the buyer for approval.
Any adjustments can be made to the sketch at this stage.
Once approved I’ll begin step 2.
Step 2:
Sketch will be lined, and step 3 begun.
Step 3:
Flat colours will be added, and sent to the buyer for approval. Once approved I will begin step 4.
Step 4:
The design will be finished and a copy forwarded to the buyer for one last approval. Once approved the un-watermarked version is sent to the buyer.
(Please make sure you’re happy with the sketch, lines, and colours before I begin step 4.
Any sudden major changes wishing to be done during and/or after step 4 will come at an extra cost.)
(Any rejected sketches or rejected parts of a sketch remain under my ownership and can be used by me as I please- unless they were a particular detail provided by the buyer like crests, logos, characters, etc- which remain under the buyer’s ownership. Effort will be made to insure that any rejected details similar to the buyer's final design will be altered as to not look the same.)

Timeframe of commissions being completed
Upon starting a commission:
-Please allow up to 2-3 weeks before any sketches are sent for review.
-Please allow up to 8-12 weeks before a commission is finished.
Commission are done around real life, other commitments, and the making of adoptable designs.
If any unforeseen circumstances happen then I have the right to postponed or cancel commissions.

When Ordering Commissions
Customs
When designing I need information to work with.
What I need:
-Gender- male, female, neutral, etc.
-Any particular details that needs adding- like a hood, no shoes, no left sleeve, three belts etc.
-Base to be used.
-The theme of the design- steampunk, fantasy, futuristic, noble, rogue, street, disco, etc.
-If a character is involved then it helps to know and see that character, but if there isn't any or the client wishes the character to remain private, then I can design without it.
-Any other relevant information.
-I'm happy to use references provided, as they help give me an idea of what the commissioner is looking for.
(Any references provided that don’t belong to the commissioner, will only be used as a general guideline.)
What doesn't help when giving me information for the commission.
"I want a fantasy outfit with a hood."
(This gives me no direction to start in. I don't know if the design is to be noble, rogue, assassin, mage or what?)
What does help when giving me information for the commission.
"I want a fantasy outfit for a male character who is a mage. I would like the design to have a hood and to look noble."
(This description gives me a direction to go in, and I know where to start.)

-Section 3-
CANCELLATIONS AND REFUNDS
Cancellations
Clients may cancel the commission only before the payment has been sent.
Refunds
I don’t offer refunds, so please make sure the commission is still wanted before any payment is sent.
If a client has cancelled up to three commissions with me, then they will no longer be dealt with.
Rules Regarding Chargeback
If a chargeback is issued against me by a commissioner then I will NOT deal with that person again, and any designs that the chargeback amount was associated with will be forfeited by the commissioner and will return back into my ownership to do with as I please, regardless of who issued the chargeback.
I have the right to cancel any and all commissions for whatever reasons that may arise.
If I'm the one that cancels a commission, then I’ll refund the payment for that commission in full (excludes cancellations due to lack of reply from the commissioner.)

Completed Customs Rules
Commissioner/current owner can change any details, colours, species, gender, etc. they wish.
I must be credited at least once when the custom is drawn. More than once is preferred but not required.
All customs/commissions are for non-commercial use only.
Custom/commission belongs to the buyer- unless buyer resells, trades, gifts, or returns the design.
I retain all rights to the artwork that I have drawn.
Reposting of my artwork is permitted, but only with full credit.
Unwanted completed Customs Rules
If a commissioner no longer wants to keep a custom design they’ve purchased, then they are free to:
Resell it -for no more then what was paid. Unless extra art has been added.
(Feel free to ask me for the price paid as I keep records)
Trade it
Gift it
Ask me if I want it back (Some adopts I’m fond of and may be interested in buying back.)
If a custom is sold, traded, or gifted to a new owner, please tell me who it was given too, so I can keep my records up to date.

-Section 4-
Notes and Replies and General conversations.
Please allow up to a week for me to reply.
If I send a note asking a question, then I’d appreciate a reply.
If a reply is not gotten after two weeks then the commission will be put on hold.
If a reply is not gotten after four weeks the order will be cancelled. A refund will be issued for the cancelled order, but will be subjected to a non-refundable fee.
Please don’t give me the silent treatment. I’d prefer a reply, positive or negative rather then none at all. If a person can no longer pay, are no longer interested, or just don't know what to say, then just tell me- I would prefer to be told then not have a reply at all.
