TERMS OF SERVICE


Commissions on FA are NON-COMMERCIAL and should be treated as such.


I reserve the right to refuse service to anyone I see fit. I also reserve the right to refuse service to a commissioner under the age of 18. Persons under the age of 18 may not commission or contact me for adult subject matter or for any reason what so ever.




PAYMENT

Paypal is the only acceptable form of payment. USD only. NO E-CHECKS. Send as a Purchase of Services, NOT Goods or a Gift.
I will hereby only be taking payment upfront. Commissions will NOT begin without payment.

Slots may be held for up to two weeks. But if the person below you pays before you, they move ahead of you on my queue.


REFUNDS

Commissioner may request a full refund only if the commission has not been started. Commissioner can request to be removed from my queue at any time before the sketch process has begun. Because of the time frame I work in, refunds will not be given on work past the sketch stage. Commissioner may request a refund if they're not happy with the sketch presented or they may ask for small edits until satisfied. Commissioners who are unresponsive for at least three days after the sketch has been OK'd will not receive a refund on finished art.

I reserve the right to cancel any commission for any reason, at any given time. A refund will be given, minus any work already done if applicable.


COMMUNICATION

PM's on FA are the best way to contact me and is the preferred method of communication. Commissioner may contact me at Miss_Zoe(at)live com for immediate cancellation. This e-mail is not to be used for any other form of contact.

Besides the sketch stage, work-in-progress shots will be shown to the commissioner if asked. I am not obligated to provide WIPs by default.

If there are any delays, the commissioner will be notified.
Larger projects/commissions may result in delays and the commissioner will be notified if any further delays happen.
Questions regarding commission updates are welcome.
Continuous messages and/or harassment for updates will result in a cancellation of the commission with a refund minus work completed.
Rude or abusive commissioners will have their commissions cancelled with a refund minus any work completed.


STREAMS

Commissions can be streamed if requested by the commissioner at no extra charge.
The commissioner and I may work out a stream schedule and the commissioner can opt for the stream to be public or private.
Private streams require no extra charge. (any harassment during streams is unacceptable and will result in cancelation of the commission and refund accordingly)
Commissioners are expected to point out errors and changes with their commission during the stream via the chat box.
Changes are implemented best during the SKETCH stage. Failure to do so will result in a fee being charged for any changes.

SUBJECT MATTER

Please be aware that I will only draw in my style.
Have in mind what you want before requesting a commission, or requesting a slot in my queue.
Be concise with what you want, and include every important detail before the sketch stage.
Persons under the age of 18 may not commission me or contact me for any reason. Because of the nature of my work I am very strict on this policy.

EDITING AND PRICES

I will do edits to a commission only if the mistake is on my behalf. I will not "re-do" any commissions. Make sure all information that you give me is clear and correct. Asking for an edit for something not included in your request after the sketch stage may result in a fee.

Example prices do not always apply. Complexity and time are determining factors on a commission cost and prices may change accordingly.

Commissioners WILL NOT receive a PSD, AI, or any other file containing the layers of the work.

Commissioners will only receive work-in-progress (WIP) sketches, and the final, flattened image. All images will include a watermark. The water mark may not be removed by commissioner.


RIGHTS AND PERMISSIONS

Requesting a commission of your character allows me the right to draw your character. Commissioner retains the rights to their character. However I retain FULL RIGHTS to the artwork unless the commissioner arranges to pay for the full rights. The commissioner DOES NOT have full rights to the artwork unless paid for and specifically stated by me, and me only.
Private commissions for users who wish that the finish work not be posted online may be requested for an extra fee.
Private commissions are not permitted to be posted on public websites by the commissioner. If I cannot post it, no one else can.
Commissioner IS NOT permitted to make any physical edits/modifications to my artwork. This includes, but is not limited to: Recoloring, vectoring, tracing. My watermark may not be removed or altered in any way.
Any commissions that are NOT colored (sketch, lineart) are not permitted to be colored by another artist under any circumstances. They may be by the commissioner only with explicit permission by me.
With permission the commissioner may post the completed work to their personal gallery as long as the work is unedited and FULL credit is given to me.
The commissioner IS NOT permitted to edit, sell prints, redistribute without permission, claim credit, or use for advertising in ANY fashion, profit or non-profit.
I may recycle any of my sketches rejected from a commissioner for later use.
