Terms of ServiceBy commissioning me, you are agreeing to the following terms and conditions:
Payment:
All payments are taken in paypal only. All payments must be in USD. Payments are to sent as Services, not gifts or friends/family. No address information is to be exchanged or notes via paypal. Payments are taken upfront. Please refer to my refund policy if desired.
Rules:
You agree that you are 18 years of age or older, or of legal age in your country to purchase and view adult / mature content.
I have the right to use all artwork I produce in my galleries, portfolios, and promotional creations. If you wish to remain anonymous that is fine.
I reserve the right to refuse a commission for any reason:
If I notice disruptive behavior during my commission progress such as: spamming my sites, too frequent sent notes, and other rude gestures (such as offensive language directed at me) I may simply cancel your slot, the image, and refund you depending on its stage. No artwork will be obligated from this.
Using people’s characters
If you are going to commission using someone else’s characters you MUST have consent from that character(s) owner(s). Some exceptions may apply given proof of an active friendship or relationship if the subject matter is simple and agreeable. Characters interacting in more personal or intimate ways will require proof or direct permissions from the character’s owner.
If you wish to involve my characters please ask and discuss with me first. Intimate situations (18+) are acceptable if the characters are either in an active relationship or promiscuous in nature.
Fanart is allowed if the character in question belongs to a commercial product, as long as it is not for resale or belittling of the product.
The following is a sample of a list of what I’m NOT comfortable drawing:
> No animal genitalia
> No gore, assault, or pain with characters. Cruel, unusual, or otherwise.
> Extreme or gross fetishes.
If you are unsure, please send me a note or email. We can discuss what I would be comfortable creating.
Standard Commission Process:
> Please take the time to understand the slot you are purchasing. It’s the buyer’s responsibility to understand the rules, pricing, and product before hand. You are welcome to ask questions before hand.
> After a slot is paid for, the purchaser is expected to provide any reference material or written descriptions. This can be done via email or FA/DA notes.
> A progress sketch will be sent. Timeframes vary. No works in progress (w.i.p) will be colored or inked. Questions may also be sent about the subject before progress is made.
> Once the sketch is received it is expected of the commissioner to review and identify any problems with the image and make sure everything required is present. Once the okay is given the process can continue. Simple pieces such as a sketch slot themselves may skip this review stage unless requested.
> Commission edits are done during the sketch phase before the process continues. Clear communication is key.
> After this, inking and color that are required begins. Complicated markings or patterns will be added late in the process and applied in varying manners.
> The finished piece will be sent to the user in a google/dropbox/imgur/etc link form in high resolution. I may choose to fit the piece into my gallery(s). Gifts made to be presented on a date can have postings delayed, please inform me before hand.
> Technical mistakes or unexpected glitches/rendering errors will be righted at no expense.
> Some coloring can be adjusted if mistaken (eye color, jewelry, etc).
> Any major changes or additions later than the approval sketch stage may result in additional fees. These fees can range depending on the complexity of the addition. Some changes may be larger than the scope of a fix and require a full new commission.
Note: Non-standard commissions (be it the media or the technique) will have different processes and may not follow these processes exactly.
Note 2: Certain commissions (including complicated designs, coded media, reference sheets, comic projects, multi-character pictures, etc) take longer to finish then normal. Durations vary, depending on the content.
Re-Posting my Art:
All commissioned art is allowed to be re-posted and used for personal use by the commissioner. You may not sell or redistribute my art without consent. You must give proper credit when re-posting my artwork. A link to my page or crediting my name is required. My signatures or logos may not be removed. Titles/captions placed on my artwork may not be offensive, critical, or belittling of people or artists involved, they should fit the nature of the work.
Refund Policy:
If for whatever reason you wish to be refunded and no progress has been initiated you are refunded in full. Please contact me sooner than later. As a precaution, pieces that have been given a progress sketch for approval may only apply for half the payment back as a refund.
Pieces beyond this stage will not be refunded and only additions can be made. The money kept is for the time spent on the commission. No exceptions.
Refunds may never exceed the received payments, thus delayed payments have refunds delayed. ‘Charging back’ via your payment service on items is forbidden upon agreeing to my terms of services and may result in blacklisting and the artwork forfeited by the purchaser.
Late Policy:
If the commission is more than 3-4 months later I will offer free or future discount options (such as a sketch or a percentage off) as compensation. I will make a point to finish my artwork as a priority, however it cannot override urgent, dire, or otherwise important factors in my life. A commission is worth only as much the purchased value and cannot be subject to pressures (emotional or otherwise) to be discounted if delayed. Please review the refund policy to see if you are eligible.
By sending your payment you have agreed to the above terms.
