Terms of Service Terms and Conditions of Commissioning Artist: Nyxseris 47
!!!! PLEASE READ BEFORE COMMISSIONING !!!!
Age Requirement: You must be 18 years or older to commission or bid on an auction.
Currency: Prices are in USD unless stated otherwise.
Payment: Preferred payment method is Paypal.
If you prefer the commission to be private or not used elsewhere, Please notify me at the start of the commission process.
I work with artistic freedom, which means that my interpretation of your idea may not be the exact thing you envisioned.
I do not do deadlines.
Payment Terms:
A 50% deposit is required upfront.
The remaining 50% is due upon completion of the sketch.
No further work will proceed beyond the sketch stage until full payment is received.
Invoices will be issued upon agreement of the sketch.
Payment plans for large commissions can be discussed.
Commissioner's Responsibilities:
Provide specific or general descriptions of desired artwork.
Submit necessary reference photos.
Ensure all character owners are aware and consent to the art being drawn. No surprise gifts allowed.
Files will be provided in high-resolution PNG or JPG only.
Must complete the commission form for each commission, regardless of previous commissions.
Must confirm ownership of characters not owned by you. Failure to do so may result in blacklisting.
Content I Will Draw:
Furry/anthro, human, monster, aliens, and more
Characters of any sex and sexual orientation
Certain kinks (BDSM)
Fluff Pieces (hugs, kisses, romantic scenes)
Violent situations (wounds, war, fights, etc.)
Military themes
Nudity
Currently my NSFW content is limited to cis characters.
Exclusions:
I do not accept commissions involving the following:
Hyper-inflated fat characters/Hyper muscles.
Extreme fetishes (e.g., diapers, baby furry, macro/micro, coprophilia, necrophilia, vore, etc.).
Satanism.
Other's closed species and sergals (unless permission is given.)
Centaurs (and porn with them).
Pokémon.
Underage characters (and them in sexual situations).
Alternative versions of the same artwork (unless paid extra).
Hateful/offensive or otherwise harmful content, including the use of slurs.

Commission at your own risk:
I do not draw the following very well, please look at this list thoroughly before asking to commission me.
Vehicles (cars, bikes, etc.)
Architectural Elements (buildings, interior design).
Big Mechs or Machines.
Super Detailed Backgrounds
Edits/Revisions
Feedback on sketches and progress images is encouraged.
Up to 5 edits are allowed per picture during the sketch phase.
Edits beyond this limit may incur additional charges.
No edits are permitted once the commission is completed.
Rights Retained by the Artist:
I reserve the right to determine if a commissioned piece is suitable for my portfolio.
I retain the right to repost the finished artwork for self-promotion and in my portfolio, giving credit to the commissioner.
I reserve the right to refuse services to anyone, including known scammers or offenders.
I reserve the right to cancel a commission at any time, with a refund as outlined below.
If the initial sketch is rejected, I reserve the right to keep, modify, and use the rejected sketch in any way I see fit.
Rights Retained by the Commissioner/Client:
The client can upload a watermarked version of the artwork for non-commercial use and edit it for personal use (e.g., as an icon or banner).
The client retains all rights to their own original characters.
The client may use the artwork as a reference for other artists, with appropriate credit.
The client may cancel the commission and receive a refund as per the refund policy below.
Refund Policy:
Full refunds are available if no work has been done beyond the initial sketch, minus applicable fees.
Partial refunds may be given based on the amount of work completed if the commission has progressed beyond the sketch.
No refunds will be issued once the commission is completed.
If I become unable to draw to issues that arise that render me unable to complete the commission, you will be refunded in full. |
