Terms of Service
The following are terms of service for SOURMAGIC (also known as "the artist", "me", "myself", and "I").
The client (also known as "you" and "the commissioner") is responsible for reading and understanding these terms of service.
By contacting SOURMAGIC, you agree with all of the terms on this page.
These terms are subject to change without notice.

☝️ The Commission Process ✍️
1. Contact: You contact me on some platform and let me know you want a commission.
2. Confirmation: I'll reject or accept your commission depending on if I'm able at the time and what you want.
3. Discussion & Price Quote: We discuss what you want, using information you provide using Google Forms or on a Google Doc. Once we've solidified what you want I will finalize the price for you.
4. Payment & Queue: After the quote is agreed on I'll send you an invoice. You will be added to the queue. The commission will not be started until payment, either in part if discussed or in full.
5. Work in Progress: Depending on the type of commission I may or may not give WIPs. I often will stream my work, either on Discord or Picarto. I usually give updates, though.
6. Delivery: After completion I will send the final image(s) via the preferred contact method, usually either email or Discord.
✨ My Rights as the Artist 🎨
• I reserve the right to use your image in any other way I see fit, including but not limited to: advertising, portfolio display, and applications. If you wish for your art to stay private or have the Nania Mis treatment, you must pay an extra fee.
• I reserve the right to alter any and all parts of my Terms of Service without prior notice.
• If the commissioner doesn't respond to questions about a commission within 72 hours, I reserve the right to take artistic freedom to finish what I was unsure about.
• The commissioner has a 7 day grace period from the time I send them the final copy of their commission to provide feedback. If they fail to do so I will consider the commission complete.
⚠ ⚠ ⚠ I reserve the right to cancel your commission, refuse future service, and/or block you for any reason. You're most likely to experience this or be penalized if you do any of the following:
• If at any point the commissioner is rude, inappropriate, or there are major issues with communication.
• If the commissioner is found to be a part of any extremist group, participates in hate speech, or any other similar offenses.
• If the commissioner fails to abide by or read my Terms of Service.
• If the commissioner refuses to pay after commissioning me or winning an auction.
• If the commissioner, or someone they've asked/paid, edits/alters my artwork in any way beyond resizing it for icons, wallpapers, banners, etc. for any reason. Especially if it involves removing/cropping out my signature/watermark.
😊 Your Rights as the Commissioner 👌
• You have the right to cancel your commission at any time for any reason. Refunds depend on completion status.
• You may showcase the commissioned artwork on your personal sites, pages, and galleries as long as I am properly credited as the artist.
• You may resize the artwork to use as an icon, wallpaper, banner, etc.
• You, or someone you've asked/paid, are NOT allowed to edit/alter the artwork itself, i.e. by adding objects, changing colors, or cropping out my signature/watermark, no matter the reason.
• You may NEVER use my work for NFTs, in any way. Ever.
• You may NEVER use my work in or for any AI program. Ever.
The commissioned work cannot be used to teach AI nor be completed by AI.
• You may NOT use my work for commercial purposes or to be used for anything to be sold for profit UNLESS you talk to me and negotiate for a CC license and/or copyright transfer form beforehand, at extra cost.
• • Thus, the client cannot profit off of commissioned artwork.
• • • i.e Selling prints, t-shirts, downloads, etc.
💵 Payment 💰
• Payment is in United States currency; USD.
• I collect payments through PayPal, Cashapp, Venmo, or Ko-fi, all found on my Links page.
• Prices are non-negotiable! I will not accept trades, half payments, or bargaining unless otherwise stated.
• Paying the Rush Fee on a commission will push you to the top of my queue and expedite your turnaround.
• • Turnaround should be no longer than 2 weeks, depending heavily on the complexity of your commission.
• • • Needing a commission completed in 1 week or less will be twice this fee.
• Payment on commissions may wait until I get to your commission in my queue. Paying upfront will push you up the queue.
• Payment needs to be sent in full once I get to your commission in the queue and begin work on it.
• Payment plans can be worked out, but should be completed in full before work on the commission begins.
• Payment for auctions have a 24 hour time limit, starting at the time that the auction was won.
• Silver coins given out in my art Discord can be used for a discount of 1 = 1; one coin equals one dollar; for a discount of up to $20 dollars off of $200. If the price of the commission is over $200, up to 50 coins may be used for a discount of $50.
❌ Cancellations and Refunds 💵
• If the artist cancels the commission, the client will be refunded in full.
• If the client cancels:
• • Before work begins, a 100% refund will be issued.
• • After work has begun, a refund will be issued based on the amount of completion.
• The client is no longer eligible for a refund if the work is nearly completed or after the work is completed.
• The artist reserves the right to edit, resell, and reuse cancelled commissions.
🎭 When Commissioning Me 📝
• I do not work with minors. By discussing/purchasing a commission from me you confirm you're at least 18 years old.
• Please be aware of my prices. Art is a luxury that I'm happy to provide, but I don't appreciate people talking to me/getting in my queue without being aware of how much their commission will cost.
• Corrections are free only on the sketch stage. I'll stream the piece or send proofs. Please pay attention to your piece and let me know what I need to fix. If the mistake is my fault, the correction will be free at any stage.
• When commissioning me, please gather all of your information ahead of time. I use Google Forms that should ask for everything I need, so all you should need to do is plunk in the information in the correct slots. When not using Google Forms I utilize Google Docs.
• Please take time to look over the final product when delivered. I review my art personally, but there's always the chance that I've missed something or made a mistake. There's a 7 day grace period after I've delivered the art; if you come to me after that, it probably won't be fixed unless you pay a fee.
• You may be first in my queue for art, but that doesn't mean that my queue will be completed in that order. Upfront payment or paying the Rush Fee will push folks up the queue.
• Any artwork canceled by the commissioner for any reason may be recycled and reused for a future YCH or other work. Your character will NOT be used.
• If you require specific dimensions to your image for any reason, you must let me know beforehand. I work on large canvases and shrink them down to a smaller size. If you require an extremely large file size extra fees may apply.
• If you need your commission done by a certain date, you must let me know beforehand. If you need it in 2 weeks or less, a Rush Fee will be charged. If you need it in 1 week or less it will be twice this fee.
By ordering a commission, I will automatically assume the following:
You read, understand, and agree to all of my terms of service.
You understand that violating these terms may result in a penalty, cancellation, or refusal of future services.
You understand that I reserve the right to refuse any commission as I see fit.
