Well, it is BETTER than it was previously, but it's still not to the MSRP value of $399. I also have reservations on ever shopping at newegg ever again. I've been hearing reports of them shipping people broken open-box products, then blaming the customer for them being broken and NOT refunding them the money. GamersNexus on Youtube experienced this personally with a motherboard they bought from them.

Yeah nothing is MSRP right now, hasn't been for two years and probably won't be for two or three more. But it's closer than I've seen a lot of other cards. I just threw it out there because I know a lot of people are struggling to find a decent card.
As far as the NewEgg thing, I'm aware of the issue. Right now it looks like it only effects people that had bought open box products and returned them for defects. The $499 price is for a new card. The whole situation is pretty much common knowledge by now so I'l leave it up to people to decide what they want to do. I haven't personally had any issue with any new stuff I've bought there, I got some defective ram a while back and they replaced it for me without a fuss.
