T.O.S. (Terms of Service)

Important: By ordering a commission/placing a bid you automatically accept and agree to the following terms and conditions.
You must be at least 18 years old in order to request my artistic services, I don’t work with minors. Also, if you're a minor, you shouldn't be following my FA in the first place!

────────────────── Mandatory rules (A) ──────────────────

A1.- By commissioning me, you automatically agree to allow me to repost and/or redistribute your commission as I see fit, with no exceptions. I retain all rights to my work, as if it were one of my own drawings.

A2.- I reserve the right of artistic freedom. This means that as a client you give me the general idea of what you want, and I as an artist choose the most appropriate execution. Respecting my artistic vision guarantees the best possible work of art from me.

A3.- When winning a slot for a commission from me, you must contact me in a maximum of 2 days, otherwise I will consider the slot abandoned. Also payment (at least the first) and details must be sent in a maximum of a week (this does not apply to reservations), otherwise the commission will be canceled, the client may be blacklisted and the slot will be opened again.

A4.- Payment will always be through PayPal invoices, no exceptions. Offering unconventional means of payment such as crypto currency will put you at risk of losing the commission slot and/or getting blacklisted.

A5.- I will start working in the commission immediately after receiving the corresponding payment, never before it. Payment can be given in full immediately or 50% at the beginning and the remaining 50% before receiving the lineart stage. If you are unable to pay the second part of the payment, the commission will be put on pause and if after 3 months it doesn’t materialize, the commission is canceled, and the drawing becomes my property.

A6.- Once work has been started no refunds or discounts will be available.

A7.- If the commissioner becomes rude, over demanding, or harassing at any time during the commission, I will cancel said commission, blacklist them from doing business with me again and blocked from having any interaction with me.

A8.- While working on a commission, once the “Lineart with shading” stage is approved, any additional changes, add-ons or edits will be charged at an extra fee (I can also refuse to make changes if I believe such demands are beyond my ability or excessive)

A9.- Changing or editing the final product by someone other than the original artist (Clerian) is prohibited. But if you need to change/adjust minimal things such as: color tone, file size or recover the file in case you have lost it, you can consult me without problem for a period of 3 months after the commission is finished. After that time, any order will be charged at an extra fee.

A10.- Deleting my logo from any version of the drawing is prohibited. My logo represents my copyright by law and its removal is a serious offense. In the event that this happens I will be forced to make a DMCA and the drawing will become my property.

A11.- When republishing my art (in Furaffinity and any other platform), you must put a link (and icon in the case of Furaffinity) to my Furaffinity page in the description. No exceptions.

A12.- I reserve the right to refuse a commission for any personal reason, this also applies if I have already started working on the artwork. Full refund is only applicable for this instance.

A13.- Resales of adopts/artwork are not allowed. The commission cannot be used for commercial purposes and/or projects out of the scope of the commission.

A14.- After the commission is completed, I delete all references and information pertaining to the commission in accordance with the ICO guide to data protection. You MUST do the same.

A15.- I won’t work on commissions about characters you hold no copyright of, or to make fanart of them. You must be the owner of the character or have permission from the original owner. In the event that you want me to draw someone else's character, the person who owns that character must send me a note to FA saying "I consent Clerian to make art of my character".

A16.- If I find out with solid evidence that a client (or client I worked with) is using AI to generate fake art. I have every right to blacklist them and make them disappear from my gallery (I don't want to be associated with people who commit crimes). The art also becomes completely my property and I may request removal from their gallery.

A17.- People on my blocklist and blacklist who want to take a commission from me will have to pay a fine and may not receive the full benefits that an ethical client always receives.


────────────────── Not mandatory, but highly recommended rules (B) ──────────────────

B1.- You must be one of my watchers and have interacted with my art to commission me, that way we avoid misunderstandings if later you “don't like my style or themes”

B2.- I’m a hard working and serious artist who is deeply dedicated to his work. I prefer to work in peace and quiet, therefore I kindly ask you to see this as a strictly professional relationship and not try to force a friendship with me and maintain sobriety in our exchanges.

B3.- No rushing. My work time is between 1 or 2 months (depending on the complexity and the priority), there is no use in rushing me, otherwise it can make me uncomfortable and make the work painful and slower.

B4.- You have the right to be an anonymous commissioner if you want, but you can't stop me from publishing the drawing in any of its versions (See mandatory rule number A1). I will not mention your name/identity or put links to your platforms to respect your anonymity.

B5.- I’m not responsible if the commission or the final artwork generates drama on your part, for whatever reason. If I see the situation gets out of hand, I will be forced to file complaints on the respective platforms and in extreme cases make a DMCA. Just don't harass the artist!

B6.- I don’t recommend posting clippings of the artwork, especially as it may conflict with the mandatory rule number A9 & A10.

B7.- Once the slot is assigned, I will open my FA notes so that we can exchange commission data there or suggest any other means of communication that are more convenient for you. (I accept: FA notes and/or patreon/subscribestar chat). I will not use twitter, facebook or any social network chat.

B8.- If you promise to make a payment (or reservation) in a date proposed by yourself you must keep your word. If you find it impossible to meet the date or you want to cancel the slot you MUST notify me otherwise I will consider you an unreliable client. There's no problem comunicating that, things happen but not notifying me puts you at risk of being blacklisted and losing the trust you have gained from me. Doing an art commission is something serious for me.

B9.- I strongly advise you to check your FA notes at least once a day when you are commissioning me. When I work for you I leave whatever I was doing and dedicate myself entirely to your artwork. I always like to ask for feedback because I really want you to like the artwork for which you paid. If you leave me too long without an answer, more than 3 days for example, it may happen that I continue with the art without your feedback or put the work "on hold". I work intensively and the time I spend waiting is time wasted not drawing.

────────────────── I can draw ──────────────────

-Themes and things you have seen in my gallery.
-Moderately or heavily muscled characters (but not hyper)
-Musclegut and moderately fat characters (but not obese, slob or fat fetish)
-Males, females and femboys (I may also draw herm but with exceptions)
-Anthro, quadruped, humanoid, monster characters.
-Complex musculature and details of scales, tendons, and skin.
-Beautiful water and open natural landscapes.
-Accurate vehicles, tools, weapons, and animals.
-High quality and precise hands, also strong and solid feet.
-Mouths and headshots.
-Genitalia (like the ones you see in my gallery)
-I prefer to draw artistic nudity, but I can draw precum and messy situations.

────────────────── I won’t draw ──────────────────

-I will never draw minors, scat, watersports, cubs, rape, fart fetish and offensive/hateful content.
-I will not draw zoophilia and/or porn involving real animals.
-I will not draw characters that are or look underage. If it looks underage, it's underage and I will refuse to draw it.
-Horse cocks and other types of real animal genitalia (but there may be exceptions)

────────────────── Explanation about commission priority ──────────────────

- People who join the "Dragon emperor tier" on patreon/subscribestar or contribute the same through ko-fi monthly. These people receive high priority, with preferential treatment. The commission delivery time is short, without interruptions.
- People who contribute through patreon/subscribestar, ko-fi or shinies at least one time In recent months. These people receive normal priority. The commission delivery time is standar.
- People who don't contribute in any way but want a commission. These people receive low priority. The commission delivery time is long and I may work on other drawings in between.
