Have I got an update for you guys!
People on my discord were following this as it developed.
I've been busy this summer! Some was planned and some was... erm not planned.
We had been looking for a house for a year when we decided to forget about bidding wars and just have a house built.
We put an offer on a piece of land back in April and it was accepted. In May we put our condo up for sale. Our plan was to have a house built before xmas on that land. The catch? The land was not officially split yet. No big deal, we had time, our builders gave us until mid-august to get permits.
We sell our condo, got a great price thanks to the crazy market. All the dates fall into place, mid-july we will move our PCs and bed to the in-laws to stay with them until the house is done. late july we will move all of our condo stuff into a storage, then I'll go to CanFURence, then on august the first we sign the condo to the new owner and finally we should, by then, be able to apply for the construction permits.
By the end of june, the bank is okay with the land being split (if you have a mortgage on your property and want to split it, you need their permission!) so we rejoiced. I try to book a date to go see the land with the builder, since the land is not ours yet but the seller... says he's put the land back up for sale.
what? we have a signed agreement.
He has a new buyer who will pay more! so he tells us we have to move quick if we want the land. We've been waiting on him since April. We are ready to pay for the land, we just need him to do the splitting work. We have signed paperwork, two realtor, one on his side and one on ours and i got a notary ready to get this done.
This was the first signs of trouble. We had to go drive 4 hours there and back to go speak to him for whatever reasons, the realtor on his side said he's just worried about who are his new neighbors going to be.
thru July we heard almost nothing. Come august, we have confirmation from the government that the lot is ready to be sold. we have a notary date... and he doesn't show. We had to send a formal notice and he got a lawyer to try and bully us into accepting new conditions that were never part of the deal. i argued back and forth with the seller and then his lawyer for most of early august until i couldn't take it anymore. I got a lawyer too.
The seller has just been lying thru his teeth, making up new conditions, trying to bully us and being a psychopath. We were done. We didn't want the land anymore. So last week our lawyer sent a letter explaining that following the multiple missed deadlines we were not bound to the agreement anymore and he can do whatever he wants with the lot. We are not buying it. It also listed the events and the extra costs we are going to incur from all this...
Looking at the costs of all this, it's almost made the house building idea out of reach. I need to work harder or get a stable job to make up for all this. We can't just sue him because that's 10k up front and then he could still refuse to pay. also in quebec you don't get your fees paid for by the loosing side. We have three years to decide to sue and I don't know right now.
We found another piece of land that we are inspecting this week, for around the same price. We can't build before xmas anymore because of the delays. (in canada you can't pour concrete in winter) so our new date for the delivery is may 1st. We are going to stay at the in-laws longer than planned... with our cats, plants and aquariums.
It's been very emotional... we never expected the land acquisition to be problematic, and it was hard to let it go. This new land is perfect too. Very big, in a nice area in the countryside. It took me some times to not be worried that the same thing was going to happen again. Both my husband and I reached our breaking points a couple of times during august. I don't wish this on anyone. I'm also glad we won't have that guy as a neighbour.
So I am now able to get back into working on art and my portfolio. It's been a very busy summer and we are both super tired and in need of a holiday (we didn't take any, just took days off to move)
I don't like falling behind and having people wait. This became so big it caused delays and I thank everyone for their patience.
