📜 TERMS OF SERVICE

1. Payment & Booking
Upfront Payment: Payment is required in full before sketching begins.
Timing: You DO NOT have to pay while waiting, just before I begin to draw for you. It usually takes me 1-3 weeks to finish a pic.
Commitment: Taking a slot is a preliminary purchase decision. Cancellations without a valid reason may result in a permanent ban from future commissions.

2. Service Classification
Under Finnish and EU VAT law, custom digital art is classified as an intellectual/intangible service (not an automated electronic service) due to the significant human creative effort involved.

3. Refund Policy

3.1 Digital Art
No Refunds: The right to cancel an online purchase does not apply to "goods made to order" (artwork commissions) or clearly personalized items.
Digital Goods: Other electronically supplied services (such as art prints, art packs, or PDFs) are considered "consumed" upon delivery. By accessing or downloading these files, you acknowledge and agree that they are non-refundable.
Stability: Please ensure you are financially stable before paying. Cancellations are only considered in extreme cases.
Breach of Terms: I reserve the right to cancel commissions if terms are broken. A partial refund (minus transaction fees and work hours spent) may be issued within 14 days.
Unfinished Work: Any sketches or unfinished pieces from cancelled orders remain my property and may be repurposed (e.g., as YCH bases).

3.2. Traditional Art
In accordance with EU law, original physical artworks are subject to a 14-day withdrawal period. You must request a return within 14 days of the delivery date.
Condition: To be eligible for a refund, the artwork must be returned in its original, undamaged condition.
Exclusions: This right does not apply to custom commissions, "made-to-order" pieces, as these are created to specific customer requirements.
Shipping & Liability:
Damaged Goods: If the artwork arrives damaged, please document the damage (with photos of the packaging and the piece) immediately. In this case, I will cover the return shipping costs and provide a full refund.
Standard Returns: For "change of mind" returns, the buyer is responsible for all return shipping costs, and the original shipping fees are non-refundable.

4. Process & Revisions
Preparation: Please have your concept and all references ready before booking. Planning/concepting is not included in the base price.
Revisions: Minor mistakes are fixed for free. Significant changes requested after the initial sketch phase will incur an extra charge.
Right of Refusal: I reserve the right to decline any request for any reason.

5. Usage & Copyright
Artist Rights: I retain all rights to the artwork, including process shots and the right to post WIPs and full-resolution finished pieces to my social media and portfolio platforms (e.g., Patreon, BlueSky, etc.).
My copyrights are monitored and managed in accordance with the Finnish Artists' Copyright Association, Kuvasto: https://kuvasto.fi/en/
Personal Use Only: Commercial use, reselling, or printing for profit is prohibited without an additional commercial license or permission. Please keep high-resolution files private, you may share them with your friends privately.
Adoptables: While I retain the copyright to the illustrations, you retain the rights to the character’s intellectual property. You are permitted to sell the character design as an "adoptable," and my original artwork may be included as a reference for the new owner. However, my artwork may not be used for any other commercial purposes, such as merchandise or mass printing, without a separate commercial license or permission.
🚫 No AI/NFT: My artwork may not be used for AI training, incorporated into AI-generated images, or minted as NFTs (Non-Fungible Tokens).
Monetization: I reserve the right to use or monetize commissioned work in art books, prints, or portfolios. I also reserve the right to reuse elements such as poses, backgrounds, or themes in future works.
Special Requests: If the commission is a surprise or requires a delayed posting date for any reason, please inform me in advance so I can adjust my posting schedule.

6. ⚠️ RISKS OF USING PRIVATE PAYMENT PROCESSORS
Disclaimer: Payment processors are not banks. While they provide similar services, they are not subject to the same strict banking regulations. You acknowledge that using these platforms is strictly at your own risk, as they may enforce arbitrary or discriminatory terms.
To ensure the safety of our payment accounts, on payment sites please DO NOT include any references to "NSFW Art / Adult Content" or descriptive terms (e.g., "sexy art / muscles," etc.) in any payment notes, documents, reviews, or feedback.
Instructions: Please leave payment notes blank or use the neutral reference "Digital Art Service" if a note is required.
Risks of Violation:
Account Seizure: Payment processors may permanently freeze or terminate both the sender’s and the receiver’s accounts for violating "Acceptable Use" policies.
Loss of Funds: If funds are locked due to a violation of their terms, I cannot guarantee recovery or a refund, as the third-party processor holds the capital. If your account is banned, you must resolve the matter directly with the processor or your local consumer affairs office.
Liability: I am not legally obligated to fulfill an order or absorb a financial loss if the funds never reach my account.
Violation of these instructions will result in:
Immediate Cancellation: Your commission slot will be forfeited.
Refund Limitations: A refund will only be issued if the payment processor allows the transaction to be reversed.
Permanent Ban: You will be permanently blacklisted from all my future services.
Note: If a ban or hold was not due to your actions, I may, at my discretion, offer a gesture of goodwill to maintain a positive professional relationship.

7. ⚖️ Statement on Artistic Freedom & Financial Neutrality
As a professional artist, I only create content that is fully legal. While adult art (NSFW) is a legal form of expression, many payment processors act as "moral gatekeepers" by applying arbitrary and discriminatory Terms of Service.
Under EU law, discrimination is prohibited. Despite this, many private essential financial institutions, holding monopoly-like power, enforce global censorship by labeling legal adult art and LGBTQ+ themes as "high risk" or "brand-unsafe." This restricts legitimate creators from accessing essential financial infrastructure.
I stand for these principles:
Neutral Access: Payment processors should provide non-politicized access to all creators of legal content.
Accountability: Institutions should not bypass anti-discrimination laws via private terms.
Artistic Integrity: I refuse to let financial censorship dictate the boundaries of legal artistic expression.
By commissioning my work, you support an artist who stands for fair and neutral access for all legal creators.

8. Final Provisions
I reserve the right to change or update these terms at any time without prior notice.
Changes will not apply retroactively to active, already-paid commissions.
Agreement: By sending payment, you confirm that you have read, understood, and agreed to the full Terms of Service outlined above.
