Terms of Service for Commissions

By commissioning me, you are stating that you have read and agreed to these terms.

Basic ToS:

✪ Payment is expected within 48hrs
✪ Paypal only
✪ Do not send money until I send you the invoice first
✪ Commissioner can re-upload the image with credits given to myself in the form of a link to either my FurAffinity or DeviantArt account (there must be a link in the post/art description)
✪ Artwork cannot be used commercially or claimed as your own
✪ NO REFUNDS
✪ BY ORDERING ANY NSFW/18+ ART YOU ARE AGREEING THAT YOU ARE 18 OR OLDER.
✪ MY WORK CANNOT BE USED FOR AI GENERATORS OR NFTs.

In Depth ToS:

𝙎𝙀𝘾𝙏𝙄𝙊𝙉 𝙄. 𝙄𝙈𝘼𝙂𝙀 𝘾𝙊𝙋𝙔𝙍𝙄𝙂𝙃𝙏


✪ I, the artist, retain full and exclusive rights to the original artwork. The client may not claim it as their own or use it for anything other than personal use.
✪ All commissioned artwork is for noncommercial purposes only. Redistribution of my artwork for use in printed merchandise or as promotion of goods, services or social media pages is prohibited. If you have any questions about this, ask me before commissioning me.
✪ If my adoptables are used unfairly or wrongly (being resold, being claimed as your own design, not being properly credited, etc), I, the original artist, and the CREATOR of the said adopt/character design have a right to take the character back without a refund, and put them up for auction again. You will be notified if one of the things mentioned above occurs, and if no changes have been made, or the client refuses to reach an agreement, the taking back of the adopt will occur.
✪ Conditions for Reposting
The client has my permission to repost the artwork wherever they would like, as long as proper credit is given (a link back to my FurAffinity/DeviantArt page) and my watermark/signature remains intact and unaltered.
✪ Prohibited Actions
Altering my artwork in any way without asking for permission beforehand, with the exception of cropping/resizing the image for an icon or other use.
Using my artwork as a reference for your own, whether tracing or re-purposing parts of the image.
Claiming the artwork as your own.
RESELLING
✪ If these terms are broken, you will be privately blacklisted from commissioning me and reported.
✪ For every reference image sent, be it a pose or an adoptable character sheet, THE CLIENT needs to make sure that they are allowed to share said references and have the approval of the original artist. This is to avoid the risk of myself being accused of using other people's characters/artworks as references without permission.


𝙎𝙀𝘾𝙏𝙄𝙊𝙉 𝙄𝙄. 𝙋𝘼𝙔𝙈𝙀𝙉𝙏 𝙄𝙉𝙁𝙊𝙍𝙈𝘼𝙏𝙄𝙊𝙉

✪ I accept payment in any currency via PayPal ONLY.
✪ All donations via Ko-Fi are just that - donations. They are not a substitution for paying for the commission via PayPal (unless we previously agreed to do so in written form).
✪ 100% payment before I start to work. A 2-part payment is possible for amounts above 300 USD.
✪ Non-payment within 48 hours will result in the commission being canceled. Progress up to this point, if any, will be re-purposed.
It is the commissioner's responsibility to tell me when the payment has been sent. Sometimes a payment will not fall through and I won't know about it. If you fail to tell me that you've sent the payment within 48 hours - and I know I haven't received the payment - then the 48-hour payment term applies to you.
Refund Policy
✪ No refund for adoptables. If a client confirms their choice, sends the payment, and then wishes to "return the adoptable" afterwards, I will not accept that, nor refund, nor take the character back. Please take your time to think if you really want the character, before messaging me, and going through the whole adoption process.
✪ If you aren't exactly sure what you want me to draw (for example: you have trouble deciding which character you'd want me to draw, which pose to pick, which outfit to pick, etc) I will charge a Consultation Fee of $15. This does not apply to custom character design commissions, since the entire commission is one big consultation.
✪ If your character has a complicated design (intricate fur patterns, mecha designs...), you might be asked to pay $15 extra (per complicated character).
✪ If you want your commission done by a certain time that's sooner than the time predicted to finish the artwork (for example: you would like an anniversary artwork done in just 3 days) you will be charged a "Hurry-Up Fee" based on how quickly you need the artwork done.
✪ If your commission has a considerable amount of gore (which includes blood, severed chunks of meat, organs and sometimes piss) a $5-$10 fee will be charged.
✪ If the client cancels the commission during progress: THERE WILL BE NO REFUNDS.
✪ The artist reserves the right to cancel a commission at any time, for any reason, and without explanation.
If I cancel the commission due to my inability to complete it in any state, I will issue a partial refund.
✪ If a client breaks my ToS (or threatens to do so), I have a right to cancel the commission and deny any refund, regardless of the phase the artwork is in.


𝙎𝙀𝘾𝙏𝙄𝙊𝙉 𝙄𝙄𝙄. 𝘾𝙊𝙉𝙏𝘼𝘾𝙏 𝘼𝙉𝘿 𝘾𝙊𝙈𝙈𝙐𝙉𝙄𝘾𝘼𝙏𝙄𝙊𝙉

✪ Discussion of commissions can be conducted via FurAffinity notes, DeviantArt notes/chat, Discord or CRM (ych.commishes domain).
✪ Visual Reference Guidelines
Client must provide at least one clear and concise visual reference; please supplement the visual reference with any important information I may need to know to correctly draw the character.
If you link to a gallery of your character’s artwork, I cannot promise your design will be done with 100% accuracy. Design interpretations may be inconsistent between images and lessen my ability to accurately draw your character. Shading on potential pieces will also play a part in this.

✪ Below is a general guideline for what I will or will not draw. Please keep my art style in mind when ordering; I will not try to match another artist's or company's art style (example: Disney style, etc)

Any sort of hateful content, such as racism, transphobia, homophobia, and characters with Nazi/Soviet/etc. imagery or paraphernalia.
✪ You must be over the age of 18 to commission adult content. By ordering anything 18+/NSFW you are agreeing that you are at or above the age of 18.


𝙎𝙀𝘾𝙏𝙄𝙊𝙉 𝙑. 𝙒𝙊𝙍𝙆𝙁𝙇𝙊𝙒 𝙋𝙍𝙊𝘾𝙀𝙎𝙎

✪ I work best when given some artistic freedom to create an image based on the characters you provide. I am happy to match a scene or pose that you have in mind, but please allow and expect some variation.
✪ Estimated date to completion. If there are any delays in the completion of a commission, I will personally notify the customer.
Completion of most commissions is generally estimated to take no more than roughly 1 to 2 weeks.
If for any reason I cannot complete a commission within 60 days of ordering, I will issue a full refund.
✪ The client is required to send all the references for the commission BEFORE the final calculations have been done and/or the invoice has been sent.
Any additions you'd like to make after invoicing (adding more references, changing something about characters/outfits, etc.) might be charged extra.
✪ Works in Progress (WIPS). I will send any WIPS to the commissioner in a +Note or Discord Chat.
Progress will be paused until the sketch is confirmed.
✪ Revisions and edits.
If the commission type includes a sketch approval stage, any major changes or revisions must be made at this stage; this includes any significant changes to a character’s pose or body shape, or redrawing parts of the image.
After the sketch has been approved, no major edits or changes will be made. If the commissioner requests additional edits after the approved sketch, a price for the edits may be discussed.
✪ If I need to make changes past the sketch stage, it will be charged $5-$15 per change, depending on how complex the change is.
If you let me decide on an element of the artwork (like the color of the outfit, facial expression, accessories, etc) you acknowledge that you gave me the full right to decide on that element's details. If a further change on the said element is needed, the "first change is free" rule does not apply.
✪ I will not to edits after the artwork is finished.
✪ If you do not want me to post your commission online, you must tell me before the order is made and paid for.
✪ I will not share the PSD file used for creating the commission.
