FA's AUP drama: 2.7 May 24th Update

General
I'll be brief.
I have questions that probably won't be answered, and clarifications are simply not forthcoming. There is a permanent sense that something is extremely fucked at the center of the administration of this website. More, there is a larger problem: Pornography on the internet, especially in the U.S., is likely to face increasing sanctions. Earlier this year, German Authorities implemented an AI Data-Skimming technique to identify pornography which was inappropriately accessible. This resulted in some shocking features like how Twitter simply did not wall the garden in which the pornography existed, meaning vectors for access by minors that violated German Law became the problem of private German Citizens, not Twitter. Seems bad? Well, we simply cannot get away from the Earn-It Act either. Designed to punish content creators and platforms for distribution of pornography without appropriate (the state's decision on this) protections, it will likely make Furaffinity fold. People went so far as to accuse me of being a pedophile when I illustrated that minors and adults should not be sharing community spaces where-in pornography is accessible or associated with that space.
My receipts, only two mind you, represent the first of many coming changes to the internet. We are not talking about the acceptability of Riolu or Charmander in these instances, we are talking about the fundamental nature of pornography on the internet. I alluded to the ID-Card system that brick and mortar pornography shops must use to keep themselves from punishment. We will be accelerating down this path, and based on the opposition to the very idea of even stipulating a division between All-Ages and Adult-Oriented spaces online, it will be happening on the terms of government organizations, not the communities themselves. Fundamental protections for queer behavior or expression of queer attitudes in certain countries do not exist, and depending on how this transpires it could be a watershed moment when deplatforming reaches a new all-time high. Tumblr deplatformed porn artists in 2018. Visa and Mastercard work tirelessly to restrict the ability of pornographic content to receive funding, often in response to platforms failing to control content appropriately. It has hit Tiktok with sanctions multiple times which seemingly communicates a point about how dramatic the problem is outside of our relatively tiny fandom space. I have been told that there is no possible way to discuss the problem with edge-cases of characters that could be interpreted as minors without "implying pedophilia is queer". This is idiotic. Humanity is doing pedophilia at scale, but Queers disproportionately are blamed despite many reasons to highlight the abuse is often by non-queers. Simultaneously, the spaces Queers occupy often must contend with these conflicts and advocate for safe abstraction along more than one genre of pornography, as one man's questionable body type is another's immoral boundary worse than actual child predation.
Somehow, people have come to a constructed narrative where-in our spaces are the 'at risk' zones for child predation because of fictional works, and not because minors and adults share a social space with pornography as a primary feature of the space. Anyone who knows about models of Public Health relevant Phenomena documented about violence know that a significant portion of human violence is predicted by not only the disposition of individuals, but the room by which an individual can conceivably perform a particular act beyond scrutiny or reprisal. As you might imagine, that link to the CDC contains substantial amounts of literature for your edification. In the US alone, as many as half of all female victims of sexual assault were attacked before the age of 18. These attacks often happen in the home, in private settings, often by an immediate relative (parent, sibling, uncle/aunt, cousin, etc) or the relative of a nearby friend. People who have cognitive deficits or other disabilities are often victims, and as you can imagine, queer neurodivergent kids on the autism spectrum have a remarkable tendency to be victimized by community members in their immediate surrounding. If you start digging, statistics depend widely on certain criteria, but the overall troubling indicators show a desire to associate DIRECTLY IN SOCIAL ENGAGEMENTS with children.. This is why it is inappropriate for Furaffinity to host accounts for minors under the age of 18 in any capacity without substantial changes to their entire policy.
The literature has existed on the behavior of child predators online for a while now. Let's highlight some basic points:
The conventional definitions will break sexual attraction of minors into two primary categories: Offender and Non-Offender. In regards to how we define Minors: A person under the age of consent within the United States, which is age 18.
To become an Offender, a real-life adult person must engage in a sexual activity of some kind knowingly and intentionally with a real-life minor. These activities include not only the sexual assault and molestation genres, but also other forms of abuse like photography/videography, distribution of illegal sexual materials documenting real minors, and/or engaging minors directly in any kind of sexual roleplay or coercive sexual exchange.
The Non-Offender Category involves what you would call the target of current 2.7 stipulations: Thought Criminals. People who take sexual interest in bodies defined as child-like and characters who are not only below an applicable age of consent reasonable within their category of personhood, but also explicitly with immature psychology, sexual anatomy, and decidedly suspect appearance.
You will note that the U.S.'s legal system as of current differentiates Offender from Non-Offender through the direct evidence of harm of a child. Zaush is not innocent, as their use of offending content to create content that would be non-offending automatically renders them as offending. Drawovers do not count as non-offending content. Shadman if I recall correctly has faced lots of accusations, some of them very likely to be true, of using direct references of actual children. Depicting real life people crosses a line that is much, much closer to the real-deal picture. While one may be able to argue that depictions of underaged characters with intentionally underaged bodies that are sexually immature may be Offending by Proxy by referencing visual material which may be based on Offending Content, there is a high level of proof required to show that someone has referenced a artwork depicting a sexualized minor based on an Offending Image of a minor being abused. The same argument would make many people Zoophiles by proxy for merely glancing at a depiction of a horse cock, and implies an omnipotence of all parties regarding material origins, which often cannot be proven in court again without substantial evidence.
So what can we take away from this?
Furaffinity.net's use of the 2.7 policy update and its other pending bans of content that exists within a greyzone of body type, artistic render techniques, and content properties represents a substantial misstep in the battle against child predation online, let alone the broader conflict facing internet infrastructure as vulnerable to a culling, let alone the broader problem of human sexual predation. If anything, the decision to proceed ahead with ANY pornography on this site is as damning as proceeding ahead with ANY people below the age of 18 permitted to make accounts. We either right our own ship by beginning to segregate people by demonstrable age with a legal standard or we will watch it happen for us. I don't even have all of my research notes put together, but this collection of hyperlinks should provide you ample reading material to consider my message.
Something is very rotten at the core of Furaffinity's administration and moderation. It should be evidently clear that major change will destroy Furaffinity's status quo, one way or another. Perhaps if they consulted anyone who fucking studies this shit, they would have contemplated a real fucking solution, and not some hypocritical brush-broadening that will declare to huge swaths of the fandom that even mild levels of ambiguity of body maturity constitutes a thought crime, and somehow that crime is worse than the real shit enabled by this website's very fucking structure.

FA+

Instead in Germany we have several steps of grace periods where age-difference matters and not solely absolute age. That actually matters here since a majority of people are under 21, I'd tend to believe.
As for FA staff, I guess they are just somehow confused q_q' Not very sure what to say...
Whether a result of incompetence, carelessness, or malice, it's pretty frustrating and downright unacceptable. We live in an information age where research is, albeit not enough, more accessible than it has ever been. We have the data needed to make the appropriate problem solving decisions, so failure to do so comes off as pretty damning to me.
In that case, one of two things will happen.
1: They will be (essentially) be fired and replaced by people who ACTUALLY know what their doing.
2: The admins & mods will run this site into the ground and it gets shut down due to lack of activity.
We in the corporate world call the second possibility a "Company Darwin Award". Seem like that's where the site's heading now (at least, as far as I can tell).
TBH, where FA themselves are concerned this will fall on deaf ears, though. I'm pretty well convinced so far that what they're doing has zero to do with morality, fake or otherwise, and everything to do with their ability to keep the operation's lights on being held over their head. I doubt whoever's ultimately pulling these strings cares, where it counts. This rot has been festering for a long time, unchecked.
(The reason is that kids are easily marketed to and are very, very profitable as a target audience, I know that, but still.)
But we really do need to take seriously the fact that this space contains a LOT of porn, probably more people digging into NSFW than those who aren't, and it's not segregated well enough or bolstered by good age-restriction features to allow both an adequate arena to play in. Even if you drop down to SFW only, horny accounts, shouts, journals and even pics (if they're not showing genitals) can show up all over the place. It's really not suitable for all-ages interaction. And the fact that minors can so easily just push the "I'm 18" button and start liking, favoriting, leaving horny comments, RPing... not a pleasant thought.
FA eclipsed other furry sites by, in part, being accessible: familiar to other services in the art space, but also open to everyone. Now it faces competition from other easily-accessible services: Twitter, Discord, Telegram. Some of those are tightening ship, but others are not. If FA locks down, then other more-permissive services will snap up the slack. I will not say this outcome is morally bad or good - just that FA staff has a financial interest in continuing to exist; thus, they have a financial interest in continuing to grow; thus, they have a financial interest in leaving their gates as wide as the law will allow. Damn the long-term consequences to users, to artists. New blood! Fresh meat! Gotta grab them up before they get too invested in other platforms to bother with this old thing.
To be sure, I am not happy about this, or condoning it. It's disgusting. It's also what Twitter and TikTok and whatever comes next - and whatever comes after that - do, and will continue to do for as long, and as far, as the law and society let them. And FA is an outcast community: the laws are only as-lenient to it as they are to larger entities because it has mostly avoided notice by the monsters at the top. The more FA grows, the more it will be seen. This course does not end well.
I would like to see higher walls on this garden, though I'm not hopeful the guys in charge here will come to that same conclusion. Or, if they do, it'll be too late, and there'll be hell to pay for the rest of the queer and furry community. I do not envy being in their position, even if I think they're doing a shit job of it.
