Commission Terms of Service (05-16, 2025)

As I want to expand my commission sales this year I'll be implementing the following terms of service to make things a bit more stable. Please note that you are subject to these ToS whenever you ask for a commission quote.
1. Commissioners must be over 18 years of age to enter a contract of any time and thus can't contract me to make a commission. Attempts to circumvent this will be reported to local authorities as best as they can be contacted.
2. Commission pricing and quotes: I use event pricing and an estimation system (quotes) for all other commissions.
Event Pricing: If a price is listed on an advertised service (Such as a YCH) that is the price you will pay in United States Dollars Via paypal or cash if a physical handoff is possible. I do not accept other payment methods currently. If the event is a YCH the sketch has already been provided for you, and is due up front in full. If no sketch is already provided one will be created and provided to you. If the sketch meets approval payment will be due in full. If not I provide up to 3 rounds of revisions on sketches.
Custom Quotes: If instead you are interested in a custom commission you can send in a description or fill out this form of what sort of image you want me to create for you. Include a description of the content and any artistic styling you're looking for (greyscale, colored, painted, just lineart, ect.). When you do I will return a non-committal price quote to you which will be good for 3 weeks. This price is non-negotiable, but can be adjusted by altering the piece. Please note, if you withhold significant information and try and get it included later in the process the price will be adjusted up. Once you agree and commit to the quote you will owe 10% of the cost upon delivery of the sketch. If the sketch does not meet approval I provide up to 3 rounds of revisions on sketches. If none of the revisions meet approval to continue you will be charged the 10% and our business will be concluded. Once the sketch is approved though I will finish the piece and send a watermarked version for final approval or up to 3 more revisions about the new work. Once an art piece meets final approval the remainder of the full amount will be due, after which the unmarked files will be delivered to you.
3. The right to refuse: I maintain the right to refuse any commission on any grounds at any point. If you have already paid for your commission and I am unable to finish it I will refund 100% of your commission and you will be free to keep the sketch.
4. Ownership:Artwork I make for you is still under my ownership. You are not paying for the rights to use it for commercial, political, or non-designated purposes unless otherwise negotiated.
4.1. You may display the art in any number of places so long as I am properly accredited as the artist and the site is not AI friendly.
4.2. You can make unlimited digital copies for the purpose of storage, safekeeping, and display, but not for the purpose of distribution or sale. Physical copyright remains with the artist however.
4.3. You may make the following alterations to my art without contacting me, so long as I am credited as the original artist where applicable. Other alteration rights I may grant on a case by case basis or as negotiated.
4.4 Under no circumstance will nor can my works, or alterations of them, be used to train AI. In compliance with this, uploading to twitter, instagram, or Deviantart (known AI training sites) is prohibited.
5. Other people's characters: I will not draw art with other people's characters unless you have their express permission, which I will personally confirm. The only exception may be if you and them seem to have a continuing repor (multiple examples of the characters together with the other person's seeming approval in their public reactions). That said I will not do so if any sort of bullying or harassment is even hinted at.
6. Characters from media: I am willing to draw "fanart" of characters form certain properties, but take this on a case by case basis.
7. Style shift: Unless otherwise asked for I will be doing all comissions in my own style or a style stated. That said if you'd like me to attempt another art style I will do my best to accommodate, but make no promises.

Your rights as Commissioner4.1. You may display the art in any number of places so long as I am properly accredited as the artist and the site is not AI friendly.
4.2. You can make unlimited digital copies for the purpose of storage, safekeeping, and display, but not for the purpose of distribution or sale. Physical copyright remains with the artist however.
4.2a. Exception: You as the commissioner may make physical reproductions of character badges as needed to have one good quality print available for use as a character badge. Damaged or older duplicates should be safely retired by fire.4.3. You may make the following alterations to my art without contacting me, so long as I am credited as the original artist where applicable. Other alteration rights I may grant on a case by case basis or as negotiated.
4.3a. Clipping, cropping, and resizing for Icons, display, and banners of personal accounts.
4.3b. Colorization or full piece recolorization (noted and described)
