I'm here hitting my head on the table over the probate lawyer we've been working with for Neer's affairs...I have left a lot of the decisions to Rita and basically been there for info, support, and using the GFM to sort out bills/fees involved.
This lawyer though...really just wasted months of our time. He didn't know how to handle most of the issues that came up and I think financially took advantage of us along with giving us bad advice/information. We are 11k in the hole and because I was asking too many questions on the "why"s of him doing things or NOT doing things he ended our contract with him. Which sure. Anyone can decide they don't want to work with a client but it's not like he explained why or gave us any sense of direction. Just cut us off and left us both completely lost in how to move forward with this.
He wanted us to just use the GFM money for any issue that cropped up and I had to keep telling him over and over that that isn't what it's for...it has a direct purpose written out in it that those funds HAVE to be used for. At the end of the day I think he was hoping for an easy open shut probate case (if that's even a think) and having to put this much time and work into it, even if paid, he didn't want to put the time into hearing our concerns...
I'm just...grrrrr...seriously...I don't care what kind of health you are currently in. Make a will. Probate sucks ass...

You're all doing great, and I wouldn't let this lousy lawer get you down. This community is lucky to have you all. I just hope it isn't to draining.

It sounds like the lawyer was trying to violate the GFM rules, which, I think would make you lose the funds, no? (I've never done a gfm.) It's a waste of money and time to be dropped like this but, sounds like they weren't really serving your best interests here. Might be for the best in the end.
Given Neer didn't have much time, it wasn't so much a thing that he, or you, could have forseen. Wills always will go to a probate court, unfortunately. All of Neer's assets, if it was ahead of time, would have been placed in that trust, with trustees (like yourself), to ensure that it never went to probate and ensured a fair and accurate distribution of his assets following his passing.
I always will recommend an estate planning lawyer, because not all estate lawyers know better. The GFM funds are set up like a trust, and he doesn't understand it, very clearly.
That being said, I'm sorry you are having to deal with it. I wish there were more I could do, but all I can offer is my sentiments and hope that it all resolves soon.

I would get a different lawyer. It sounds like he's being dishonest. A report to the bar isn't a bad idea as someone suggested.
