Soda Roo Drama? No wai.

I've been disconnected from the world for the past 24 hours flying out to Australia. But I hope I misheard this: there's currently drama about the Soda Roos going around?
What I heard: people have picked up on the meme and have been drawing up their own versions of soda kangaroos, and the person/persons who kicked it off is getting uppity because other people have run with their own ideas based on it. And, again, I hope this is just a rumor, but as I heard it, to make a soda roo into a suit you have to get accepted from the original soda roo owner first.
As in, there's an approval process now for the once awesome meme going around. Instead of soaking in the flattery that what's been created has taken upon a life of its own, they've gone Hollywood.
Here's the problem:
The sodas? Intellectual properties. Even the meme starter probably didn't go to Dr. Pepper to make sure it was okay to make a kangaroo fursuit based on the beverage...or even name it that. It's an playful homage, but if Dr. Pepper didn't want to play nice the ol' Dr. Pepper kangaroo could end up seeing a cease and desist note showing up in his/her pouch.
It's a great idea, absolutely, but c'mon, to think you own the rights to soft drink-based kangaroos? How far will it go? If I wanted to create a red/white Budweiser roo, that should be fine, right? It's not a soda. Maybe a Goldschlager roo, with gold flakes all over him.
I hope I'm wrong, but knowing the fandom, if there's the potential for drama...it'll happen. Let memes run their course, it's pretty awesome being a part of one.

I can't see how you'd have to actually get permission from the guy to get a suit done - like you said, soda designs themselves are patented intellectual property, meaning he couldn't actually go and get a patent for soda 'roo suits. Maybe he wants people to think they have to get his opinion...but it definitely sounds like someone's a little to full of themselves.
You've got yourself confused here. The name (Coca-Cola, etc.) is trademarked. And trademark law is based around brand recognition, so to prove any claim of malfeasance Coca-Cola would have to show that the fursuit makers are intentionally trying to mislead customers into thinking they are getting something from Coca-Cola. As I'm sure that's not happening, there is no legal problem there.
The soda "designs" (formulas?) are copyrighted. Patents apply to original physical inventions, and they forbid anyone from making something covered by a valid patent without permission from the patent holder for a period of 20 years. The patent expires after that and anyone may make that thing, even using the designs filed with the USPTO. That's kind of the point of the system, to encourage inventors to disclose their inventions. In return, they get a short monopoly on the profits from it.
Patents have to be for something original. If it is shown that they are not original, the patent is invalidated. This is called "prior art". Very few of the sodas on the market would be eligible for patents, or if they were at one point they have expired a long, long time ago. I'm sure the recipe is copyrighted, but that's a different concept and covered by a different set of laws.
I mean, from me personally I still have the gripe of people that can't distinguish tones of green or note black fur as it's backup. So I bet you did not read that wrong.

Also, all those Simba or Lionking recolours... I don't think people will get that those characters 'aren't theirs' to begin with! XD

There's not really many things that are Original. Many famous artists like Vincent van gogh and Henri Rousseau saw artwork they liked and did there own interpretation of it, lol.
If they did that today they'd have a load of squeaky artist having a hissy fit at them for getting money off some elses idea.

i can understand if its a blatant copy of the same image and using it to get money, but this Meme isn't even for payment, so although i would like to think people are more laid back about thees things and hope that this rumor is not ture too! I'm sure to be disappointed...

As for these so-called "creators" going all Nazi on "WE OWN SODAROO, YOU CAN'T DO IT EXCEPT IF IT'S OK BY US"... That's retarded. ~_~ They didn't invent Soda + (insert furry animal here) and they certainly can't do anything if people want to make their own SodaRoos, Sodapups, Sodaragons, whatever.
