As I predicted, US District Chief Judge Walker ruled that banning homosexuals the equal right to marry violates the Equal Protections and Due Process clauses of the 14th Amendment.
This ruling is a victory for those of us who support the Constitution. Unfortunately, there are many who oppose this ruling, and want to destroy the Constitution to deny civil rights to people they don't like.
The ruling was immediately appealed, but the defense has absolutely no case. Should the US Supreme Court choose to hear the case, Judge Walker's decidion will certainly be upheld. The supporters of these Unconstituional bans on same-sex marriage have yet to provide one good reason why gays should be denied their Constitutional rights.
Some of their arguments include:
"Marriage is a religious institution." You don't have to set foot within miles of a church to be married. Point invalid.
"The Bible says homosexuality is a sin." The Bible also says that divorcing and remarrying is adultery and an equal sin. Furthermore, the 1st Amendment guarantees that the Bible is NOT America's law. Point invalid.
"The word "marriage" isn't in the Constitution." The 9th Amendment clearly protects rights not specifically listed. Point invalid.
"Marriage is for procreation." Infertile couples marry, and unmarried couples have children. Point invalid.
"The people have spoken." The people cannot supercede the US Constitution without passing a Constitutional Amendment. Point invalid.
"Marriage has always been between a man and a woman." There was a time where blacks couldn't marry whites, and those laws were found Unconstitutional. The same arguments were made back then, and they're still wrong now. Also, the Mormon church, one of the biggest supporters of Prop 8, supports poligamy. Point invalid.
"Children need both a mother and a father." Should we take away children from single parents? Point invalid.
I'm sure you can see the pattern. Those of us who hold our Constitution dear should be deeply offended by these blatant attacks on the freedom our Constituion grants ALL Americans and fully support a speedy trial to do away with Proposition 8 and same-sex marriage bans once and for all.

I was surprised I didn't see this journal sooner, I heard about this from some other journals. Still, it's good to hear that gay rights have prevailed over predujiced views.
