you guys want to hear some shit about Eminent Domain. well where i live there is a dairy farm with cows and milk and all that good stuff a store on the property to sell there products and other stuff. and they are the last and smallest dairy in the county (about 130 or so cows).
now the town or i should say city its in and where i live (it only became a city a few years ago) there just happens to be a city road that goes threw the dairy well the city wants to open that road (its be closed for years because the dairy was the only one to maintain it) because they will be a shopping complex on the back side of the dairy. so the city approached the owner of the dairy and said were going to open that road we want you to give us the 10 or so feet of your property on ether side of the road (by law there has to be a distance between the road and any buildings) the owner said "no if you want it your going to have to buy it form me and move my store and buildings in the way" (because they would have to and have to pay him for the down time) they countered that with "we will just throw a Eminent Domain on it and not even bother"
now if you were to see where the road is its between two other roads about a mile apart, and its not in the middle where it can split the difference its 400 yards from the nearest one.
and my city is willing to plow under not only the oldest business in the city but the oldest buildings too just for a road that wont improve much if anything at all the dairy has been around seance the 50's.
how can you justify something like that?

Wow, that's fucking shit. Can they actually do that as a city? I thought it had to be on the state's level of interest to Eminent Domain property like that.

i dont know, right now its an empty threat but im sure the city can argue to the state that due to the road not being open can be detrimental to the cities economy, the state might just go "AGH more job loss... it no good, burn it all" or some shit like that

well he only employs like 10 people and most of them are his children and grand children. but right now the Eminent Domain threats are as hallow as the public officials heads. im just point out the fact there trying to bully him in to giving up his land, but this can become a real deal thing i just hope not

I just did some research and it looks like cities really are entitled to use eminent domain. It's totally unfair, but it looks like it's legal.

there's a restaurant in Arcadia almost as old as the city itself and it was almost destroyed to make the stupid mercadies dealership bigger. luckily the historical society or someone caught wind of it and it was put to vote. the whole city voted no and i still get to enjoy my favorite place to get breakfast. =3 i hope the same will happen in your case, eminent domain almost never is fair and thats why in most cases ive seen it fails.

well its been here long enough and so many people all over the world (when passing threw) come here, i once met a person at LAX who knows of the dairy and loves it, he was a world traveler
