The First Amendment (Amendment I) to the United States Constitution is part of the Bill of Rights. The amendment prohibits the making of any law "respecting an establishment of religion", impeding the free exercise of religion, infringing on the freedom of speech, infringing on the freedom of the press, interfering with the right to peaceably assemble or prohibiting the petitioning for a governmental redress of grievances.
Freedom of speech is the freedom to speak freely without censorship or limitation, or both. The synonymous term freedom of expression is sometimes used to indicate not only freedom of verbal speech but any act of seeking, receiving and imparting information or ideas, regardless of the medium used. In practice, the right to freedom of speech is not absolute in any country and the right is commonly subject to limitations, such as on "hate speech".
Freedom of speech does not cover art, people! Freedom of Expression might.
And those cover Government, not personal or company policies. If I have a rule in my home that says you cannot swear, you can't shove the first amendment in my face. Because I can just as soon shove you out the door.
As I stated at the beginning, I am struggling very hard to keep personal opinions on the content specified in the amended AUP and TOS.

Though, as I'm digging to the bottom, the only real cause for the AUP is due to funding for the site. The sponsors who help keep this place alive don't like cub porn, and are now refusing to contribute if its still on the site. So that is why they're having to take down the cub porn.
You can still do anything no adult rated, so you can still draw young characters or even teasing, perhaps even pin-ups, but nothing beyond that.
Cub porn seems to push the boundaries between what is legal and what is not legal.
I do not view pornography to be truly art. It can be done artistically, but it's still porn. Which is why I don't draw much of it myself. Then again, there is a difference still. A picture drawn to incite lust is porn, but a picture portraying a loving couple in a sexual act, where the emphasis is on the emotions behind the act is more artistic.
If a company is uncomfortable funding a site that pushes those boundaries, they have the right to withdraw their funding. And Furaffinity isn't a private site, so they do have to consider the feelings of anyone who views it, as well as who is funding it.
If there are people who are very upset that Furaffinity is not allowing the portrayal of underage Anthros in sexual acts, then maybe they should think about paying Furaffinity what the sponsors would have.
Some of it though, its people just having different takes on age. Seeing it as fantasy, the normal rules don't apply. Like one artist who has a 12 year old girl, but the mind of an older woman trapped in the young girl's body. Mentally, she's all grown up and capable, its just she's in a girls body in place of one age appropriate.
Others do comical porn of young characters, either by request (like
Loli, shota, and such with human characters? Totally agree with having that tossed out.
Anything that doesn't happen in real life is "fantasy". And I honestly don't think that people can really conceive of anything that we don't have experience with some time in our genetic past. Perhaps once what we term as "furry" actually existed. Perhaps, in those numerous galaxies out there, there are planets where some other creature other than a primate evolved into a human-like species? God only knows.
My gripe about underage pron is not the fact that the body is young. It's the destruction of innocence, the abuse of power. Youth is something to cherish, to protect. People can be attracted to flat chested women, I have no problem with that. I also don't really have a problem with adults who wish to be pampered and taken care of as if they were a child. But that predatory nature that overlays most (not all, I assume) people who really enjoy seeing a child of ANY kind in that way... perturbs me. But then, that also covers people who like completely naive and uneducated adult women. It all comes down to tainting innocence.
Well, that, and one picture I stumbled across really bothered me because not only was it cub, but incest as well. And my reaction to that is designed into us to avoid genetic defects through inbreeding as well as a dislike of the abuse of power.
Perhaps it's the Puritan background of the US.
See, that's why it sucks. There are those who draw it not for the destruction of innocence, but because its more along the lines of macro/micro. Nori's character Dr. Gwen is a genius girl who's only like 12, but she's got like medical degrees and such. There are other cases where someone who is vastly older, matured, and intelligent is trapped in a younger body. Then those who do art of popular cartoon characters, but not in horrible, rape like fashion.
However, its got to be all or none, and we gotta go with none due to funding. :P
