Anyone ever opened a buyer claim in ebay?

I'm curious as to what my chances are here for a refund, which is what I'm now seeking. The details of the interaction are that in Dec 3 I used by it now to order an item on ebay. On the 5th I got a message marking it as shipped. It did not come with a tracking #. The estimated delivery date read from the 16th-23rd.
So althogh I felt concerned by around the 16th and after, I held off contacting the seller because of the 'estimated delivery date'. However, on the 23rd I did contact him and got a message that the delivery date is not always accurate and I should wait. Well I asked for the receipt so that I could attempt to contact the post office. He then gave me a tracking number (At which I was left wondering why he hadn't given me that in the first place!) Anyway, spoke to the postal carrier, but according to the tracking #, it was delivered on the 15th. I know there's no way the carrier is going to recall a package from a week prior, especially considering that I ordered many other things that all came since then.
So on the 24th is when I opened the claim with ebay and it is now under dispute. I feel the seller was not very helpful. His answers were very blunt with no concern or apology or anything. As someone who deals in customer service as an artist, I find his attitude to have been very uncaring and therefore I'm not very inclined to be forgiving. I'm out the item, which was a gift and over $30. It was a very sucky situation. Has anyone else dealt with an ebay claim or undelivered packages that could give me any advice?

Another thing, ebay provides you with shipping labels (I think cuz when you get a package it has the ebay logo along with the USPS stuff) when you have to ship things people have won and if you use that service you automatically provide the tracking number to the recipients purchase history page on ebay. If you use another shipping service like say FedEx then you would normally message the winner the tracking number. Not everyone uses ebays lable prints. Unforunately I completely forgot what my point was... >_>
Have you checked to make sure they sent it to the right address? Maybe they'd be willing to give you a replacement item - though I admit, it seems unlikely :(
