A art thief is:
Using a character from a original pic/art from a other artist without permission.
Using the same signature hair/clothes from a pic/art from another artist.
(Except if you do a lots of modification to make it looking new and different is fine. Also cosplay is fine since it more of a fan art.)
Using the background from a original pic/art from another artist without permission.
NO-art thief is what I din't say up here, as like:
Using a POSE from a pic/art is NOT an art thief.
(Just don't do the same character and exact same pose.)
Using a NAME is not an art thief.
Example: If I say "Krystal", you would suppose that I talking about that famous blue fox girl from the Starfox's series. But, I have a character that has the name "Krystal" and many other artist too.

A lot of musicians do something like that:
The musician can use the same tempo of a other music from a other musician, but, he can't use the same notes/lyrics from the original song.

An artist can use a pose from another art, but he/she can't use the original character/hair/background from the original.
