Though there is a small part of me that hopes Santorum wins the Republican primaries. As long as the economy is at a continual rate of progress and the GOP keeps avoiding financial debates, it would practically guarantee Obama 4 more years in the White House.

When prop 8 got passed here in Cali 4 years ago, the marriages that had happened while it was legal weren't magically nullified, the couples remained married.
Pretty sure the supreme court would stop his ass immediately if he even made it into office.
The judicial branch however, can overturn this veto with a majority vote if they think its unconstitutional or an abuse of power? Something like that.
i'm trying to remember that whole triangle of process from the house, to executive, to the judicial branch...
if i'm wrong about which branch it is, i'll accept that. but my point still kind of stands :'(

When it was voted in, the act of marriage was deemed illegal, but they had no right to nullify the marriages that had already happened.
IF they were being suddenly nullified within the state, there would have been a much larger public outcry on top of the fact that it was voted in period.
The marriages that happened prior to prop 8 happening are still valid.
Though, many of the articles i have found on it have stated that it would make it so "only marriage between a man and a woman is valid or recognized in California." That to me would imply that all previous marriages are no longer considered valid, but i may be interpreting that wrong.
The Gay marriages that already happened are still legal, there is NOTHING that can overturn that. Gay marriage is simply illegal, therefore the only one that will continue to be recognized by the state are the unions between man and woman.
Gay marriage is still not legal in California just yet, despite it being overturned.
