Okay, so this kid is really pissing me off. He tried to claim that he would return the payment to me, but
nope. He's had his 7-10 days to send the money back to me and nothing. I've messaged him several
times over the past 3 days with intervals of 1 hour in between each message. So I'd just like to give a
warning out to you guys. I can't really put an Artists Beware since I was using Steam when we worked
out the details and like an idiot I didn't screenshot anything. :/ But this is the first I've been jipped for
a commission. Anyways, if you have someone approach you(FA name being Emagiwana; Preferred Steam
name being =pb= Professor Oak; Email leerentas@yahoo.com) by any of those contacts, please avoid and
ignore them completely. They will tell you lies about their accomplishments, with no evidence supporting
such accomplishments. He claims he is trying to be anonymous, yet a simple search of his email brings up
his very public and informative Facebook. He has also claimed that he paints art and refused to give me his
FA name for no reason. I found it with the help of
that the image was actually by the artist

him about it, he remained silent, then went offline. Next he logged on, there was a meme image of Spongebob.
Please guys, watch out for this kid okay? Spread the word, keep an eye out, etc. He's just looking for
freebies. I'm honestly about to put out the commission he "bought" for anyone to use/edit/rape/poop.
Regardless, I'm almost out of the negetives and thanks to his public full of information Facebook, we
found out where he lives, where he goes to school, his age, full name, and even his mothers name.
We plan on pressing charges after a bit more research on what we will do.
I know I had planned a sketch stream a while back, but I haven't been able to touch the net for a while.
We've been fixing up the house to sell and I've been trying to arange a place to live for myself since I can't
move in with Haru. I'll possibly be able to tomorrow. I can't make any promises. A journal will be posted
if I do. Thanks for not coming to my house and murdering me for not posting anything. ; w ;

Reason: its not really worth taking it to small claims court if the amount does not cover the court's fees.
I am glad Crobat isn't taking this sitting down- This will set an example I hope others will follow.
But you may be able to tack on a reasonable amount for the time you spend preparing the case and going to court, too, for instance.
Also, if you really want to go nuclear? Stealing money via the internet is wire fraud. That's a federal felony with some serious penalties. Without the screenshots, you may not have enough evidence for the "beyond a reasonable doubt" standard... but just pointing out the relevant laws, and their penalties (large fines plus jail time) might get you your money back.
Now I sound like a asshole telling Crobat not to take it to the court.. xD

But seriously, thats fucking low. I cant believe dumbasses are allowed to use the internet, this is why we cant have nice things.
I also agree about posting to A-B anyways, so long as you have your story straight and your paypal history you might be able to slide.
LEGAL ADVICE::
In all honesty, I don't think small claims court would help you. A PAYPAL DISPUTE on the other hand WOULD. Not only would paypal rectify any negatives you had/credit the account, but it would forcibly pull the funds from his/her account or card to pay you back.
Small claims court varies by state, and while there IS a waiver, you have to have substantial proof to qualify. Since Steam cannot be logged and you have no screenshots of the agreed upon amount/eta for the piece, it's going to be hard to get a claims judge to rule in your favor. THAT BEING SAID with paypal's screenshots, and especially if you 'note' your invoices/they noted the payment as 'x on fa for x' like a lot of customers generally do, then you MAY be able to plead 'theft by deception' in small claims court.
WITH THAT PLEA, you will still have a hard time dodging the 'was a verbal or written agreement made and may we have a copy of said agreement'. It's why it's good practice to send your clients 'you agree to my terms and conditions, price, and if a deadline is stated said deadline' note or email just for records keeping purposes just in case you do need to escalate something.
You may/may not be out the time/money/work. Though in that case, I'd say the artwork is yours to do with as you please, so you'd be well within your rights to resell as a premade or re-purpose, or just post like you said above and let people use it as they will since it doesn't have an honest to goodness owner without payment. It sucks, and I'll certainly make sure to block them because the warning is helpful, but it may just be a nasty lesson learned.
But I understand, and I do. I've been thinking of ways to "cover my ass" as you've put it. A Google document that requires them to agree to the terms and such of a image/etc.
So this guy's basically wiped out his entire gallery/whatnot. *nods* Looks like he's cutting and running.
