why would he get a DMCA notice anyway? Fan art isn't copyright infringement. It falls under fair use and even people who don't understand fair use at least get that part. Unless he's making money from drawing established characters. Pony made ups don't count though. Only mane cast and well known characters like Celestia and Luna. And further along fair use is derivative works which means he's not infringing copyright if any of those existing characters are made into anthropomorphic versions.

I haven't had the chance to see 0r0chi's tumblr while it was available but I'm fairly certain what he would have put up would be in line with the TOS.

Besides I've seen so much violation of the rules go unchecked by others it's obvious to me that he's being singled out or even maliciously targeted. It fucking sucks!

"Fair use" is a phrase grossly over-used. If you're not making money off it, most IP holders won't pursue you but having a gallery/tumblr full of original artwork of MLP characters or derivatives of such characters is a bit beyond "fair use". Derivative works are still copyright infringing. And a quantity of derivative works will exceed "fair use" quickly.

If tumblr has an auto-"X reports = ban" feature then this should be removed since it's so prone to abuse. And if tumblr is reviewing Oro's blogs and deleting them without notice, they should be giving notice of the exact infringements.

Hmm. I was fairly certain that derivatives were fine. I guess I'll have to look that up at some point. But like I said I never got to see what he had up on tumblr. I agree though he should have been receiving notices or warnings if he was in violation. Sounds like tumblr has really lazy and unfair administration practices.Maybe what he needs is his own site where he has more control.

Derivative works are covered, preventing like fan-fiction (or "my character in a parallel-Potterverse story arc") from being published. This is why 50 Shades of Grey is derived from a derivative work (making it so unlike Twilight {in every way except literary standard [since you can't get a lower literary standard]} that is was safe to publish).
