PROTECT act gets its legal test

I guess we'll find out once again that congress's latest attempt to ban artwork is unconstitutionally broad:

The last thing they tried to make it constitutional was to apply the Miller obscenity test to artwork in order to put it in its own "category", the same kind that governs obscene pornography. However, by definition, pretty much anything drawn with a pencil to paper has legal "artistic value" and thus either the courts will most likely rule that the comic books did not pass Miller or that PROTECT is unconstitutional.
CBLDF should be familiar to any of you in a certain artist's guild.

But comic books? I'm sorry, but people getting locked up over fictional characters is bullshit. It's a slippery slope that will eventually ban guro comics because they count as snuff, which will lead to banning other mediums where you see gory violence...
Pedo or not, the first amendment must be protected, despite all the efforts being made to undermine it.

I mean, yeah, he's an obsessive otaku, but the entire land of Japan would go to jail for this, leaving it a barren wasteland. It's just dumb. It's not like, y'know, a real child predator case. It's CARTOONS. It's like getting tested for bestiality when you're just some lowly furry artist. As long as your not into touching animals in obscene ways (god forbid you are), you are an upstanding citizen with a couple of screws loose (and that's ok, that's what psychiatrists are for) who wouldn't dare 'eat the forbidden fruit' so to speak.
Before this guy gets thrown in jail, I want to see some goddamn proof of his misdeeds. Not just a pile of cartoony pictures. If he has, well, may god save his soul, I can't hope for him at that point.

though really, this is one of those issues where if you compare us to many other industrialized democracies, japan's the only one who seems to be lax on the issue (hell, in many asian countries which you would think are otherwise tolerable, ANY form of pornography will get you tossed in jail!)
