Regarding Gezaks in General. [FAQ]

Hi-
Over the past week or so I have had two instances where people have made their own gezak behind my back.
One of these people went on to actually PAY someone to DESIGN A GEZAK /FOR/ THEM and make a ref and all that.
So below are some FAQs about gezaks. This journal will constantly be subject to change.
WHAT IS A GEZAK?
A gezak is a species of my own creation, derived from my original fursona, Servadile. The gezak species itself was founded late 2012. Basically a monster with a giant spiked gecko tail, wiggly mouth and sloth arms.
WHY ARE YOU SO CLINGY TO GEZAKS? [WHY ARE GEZAKS A CLOSED SPECIES?
They are very personal to me hence why I want to design them all. I enjoy designing them and using palettes that I myself find attractive.
SPECIES GUIDE???
People have asked me to make a species guideline, but knowing now that people are not willing to come in direct contact with me, I do not want to give out a resource to aid those in just making one by themselves and OR give people the false assumption/approval to just make one on their own.
HOW CAN I GET A GEZAK?
Through auction/adopt format OR I give you strict permission for you to make one. If I give you permission to make a gezak, I trust your design skills enough I know you won't botch a design, but regardless I might tweak anyway.
WHY ONLY ADOPT/AUCTION FORMAT? CANT I JUST COMMISSION YOU?
Auctions gets my species demand up, making them exclusive. This is my own marketing strategy that I prefer to use.
I get to design ones that I want to put out to the public. Occasionally I will post a custom auction design auction, but even then I have the right to deny certain patterns, colors etc based on my own comfort level.
That being said, I do not do design commissions for gezaks, other than custom auctions. .
BUT AUCTIONS MAKES DESIGNS SO EXPENSIVE AND IT'S NOT FAIR TO THOSE WHO CANT PAY!
That's a shame. Try waiting for set price designs, but other than that, it's not my problem.
WELL SINCE IT'S $$$ CAN I GO COMM SOMEONE ELSE TO MAKE A GEZAK FOR ME?
Absolutely not.
SO I HAVE A GEZAK....WHAT CAN I DO WITH IT?
You MAY alter it slightly, such as I designed a black gezak with a purple cheekspot, but the owner changed it to freckles. [Just for example].
-You may use it as a fursona
-You may use it as a fursuit character
-You may draw adult artwork of it.
-You may change the gender
SO I HAVE A GEZAK....WHAT CAN'T I DO WITH IT
-You MAY NOT alter the design so much that it is pretty much a new character
-You MAY NOT resell the design for MORE than what you paid for it.
BUT SERVA IS A HERMAPHRODITE????
Genitalia of gezaks are cloacae that have a reversible inner core. Such as they can choose during intercourse what they want to be. Breasts and phalli of gezaks are purely filled with blood.
If Serva were to get aroused and would want to penetrate, her blood would flow into her lower organ, making the chest area flat since the blood flow is now down there. Male gezaks are sexually aggressive, needing a lot If she wanted to receive, she'd get aroused but not fully 'dominant' since female gezaks are more submissive.
If you send me hate or distress over this, just remember that this is MY species and I am not obligated to comply with any outside party that has differing opinions.
oh and GEZAKS ARE A CLOSED SPECIES.

Sorry that people are stealing them.
In my opinion, that would make it less special and significant than getting one directly from you.
Yeah, idk why people are stealing them...almost like buying a fake bag or something.
I mean what if someone really wants to have a design you made as their fursona and felt their own gender identity would make it feel more personal I guess...? There's also the fact that gender identity doesn't have to do with parts.
I dunno it's not my choice and it's just a character, just take note that some people might probably get offended. It really sucks that they are getting stolen, and I don't know why some people feel entitled to certain things.
Gezaks are really cute and some of my favorite designs ever come out of you. I really hope everything gets sorted out.
However, as much as I want to push 'yo they are animals, not people, so they go by literal nature or boy, girl or both', some people will be using them as personal characters and I need to put that into perspective, especially when they are the ones with the $$.
But in the long run, I did not intend to offend anyone with my species 'guidelines', so I'm sorry if I did.
They are a really cool species and it seems like you put a lot of time and care into them. They're your work and it's worth the price, I would love seeing more gezaks in the future and I agree with other people that ripping them off just makes them less significant. I would love to own one from you someday, and hopefully one day lots of people will bring your designs to life. I feel like every character I see lately has the same expression and are kinda lifeless. A character has gotta have... well character. A lot of artist and people have trouble making well devolved designs, that just feel real. I totally know where you are coming from in saying you want to have gezaks be well devolped characters, I would too if I put that much time into something. I would have pretty high standards.
Yeah Im pretty high maintenance myself, and I just want everything to be perfect for me and whatnot.
It's totally understandable, I don't blame you and it's your creation after all you make it however you want it to be~

Companies have copyrights on their designs/species/characters (think Nintendo with Pokemon) because they have the weight of merchandise and recognizeability of their designs.
I'm not saying that you can't SAY your species is closed and hope that others comply - I'm saying that you can't force others to comply, with any sort of legal threats. You can't even stop them from making money off of commissions or auctions or anything. They can't sell your artwork, of course, since you do have copyrights to that, but without any kind of trademark, or "weight" behind gezaks (think merchandise, recognizeability - think the dragons of Pern, think Pokemon, think Mickey Mouse), you really can't stop people from making or even selling their own gezaks or very similar critters.
It does suck, and I know how it feels to be protective of our little headbabies. But we really can't do anything at all to protect our "closed species" except ask that people respect our rules. If others make money off our critters (it's happened to me before), there's not much we can do unless they're outright stealing our artwork itself.
Im not trying to copyright my species in any way. Howevee, I do not want people making money off of my species. Thats my main concern, yet if people make them, then ill get kind of hmphhg and tell them to not do so lol. That is the extent of my power, other than being whine whine and resporting said "offender" if they didnt do what I have asked of them the first few times.
Yet the demand of gezaks are so high that people have been willing to comply design wise. If someone were to just get a gezak and botch it, then that beats me. My disappointment and your waste lol.
But yeah, in the real world you can never expect people to comply with anything, however people who show genuine interest at wanting to succeed at said task (in this case, getting a bab fair and square so no bad blood between us) will do the necessary steps to get it done right.
Dunno. I cant speak for the people that have made their own, but I am in no way offended or livid over them. Almost bluntly complemented because they liked it to much that they just decided to grab at the chance.
But who knows, maybe I'll make them open and make guidelines for them, soon enough!
I was actually really confused when I saw Gezak fursuit pics and Gezak customs flying around from artists that weren't you, but I've been in the middle of (literally) a month-long migraine that brought with it being blind in one eye, so I just kind of figured you'd given it the seal of approval - I didn't know things had gotten out of hand! From now on I will help be your watchdog and enforcer >:D or at least help keep an eye on things (haha since I only have one eye left... ahaha sob)

Basically it boils down to - you have to become a famous author, scriptwriter, comic writer, etc. in order to get your critter trademarked here in America XD
And I know you weren't trying to negate my post, no worries XD I love to debate/discuss stuff and talk and I don't get butthurt easily. I love other peoples' perspectives and insights and opinions, especially if it's something that I don't or can't have perspective on, like being from Canada! :D
