Terms and Conditions
Throughout these Terms and Conditions, “you” will refer to the customer receiving and paying for the art work and anyone who views the artwork through social media, and “me” will refer to blackphantom1412, the artist.
Art Usage:
In creating art for you I retain the intellectual copy right to the artwork, but not the rights to the characters and the designs contained within the piece.
You are permitted to:
- Post the commissioned work to your accounts on FurAffinity, DeviantArt, Tumblr or any other social media website, giving credit to me, as the artist, wherever possible.
- Use the commissioned work as an avatar on social media websites, Instant Messenger services et cetera, giving credit to me, as the artist, wherever possible.
- Print the commissioned work for personal use.
You are NOT permitted to make money off of any art on my page, commission or otherwise, without direct permission. This includes using the art to create any other piece of this includes, but is not limited to; bookmarks, prints (for commercial use), mouse mats, and coasters.
Artwork drawn specifically for a commissioner will not be sold on without direct permission from said commissioner, unless payment is not received for an approved pose. In this case, I am entitled to offer the pose to a new commissioner without approval from the original commissioner.
Reference:
A clear and correct reference must be given. Please ensure all references are up to date.
If no reference images are available, please provide a clear and precise description (for example, if the commission is for a reference sheet).
Any communication between the artist and the commissioner must be written in easy to understand, clear English; poor quality references or miscommunication can lead to mistakes and, despite many attempts, I am not a mind reader, please proof read before sending messages.
Any custom clothing requested on the character must have a clear image as close to the desired design as possible. If no image of the design exists, a clear and detailed description must be provided at the beginning of the commission. If multiple edits are required, a small charge of £2+ may be added on to the cost of the commission, and the art will not be worked on until the charge is payed.
Payment:
Upon agreeing to a commission I will create a rough pose for you to approve. This will be made with bare basic shapes and no precise line work at this point. Once the pose is agreed on, full payment of both the standard fee and the shipping fee must be payed as applicable. There will also be a 50p charge as paypal takes 59p from the final amount. I will not begin work on the final product until all payment arrives, including the waiting time for eCheques to clear. Only payments made though PayPal will be accepted. Special exclusion may be given if you are able to pay me in person at the Liverpool “ScouseFurs” meets.
Refunds:
Within two (2) days of sending payment, and if the art has not yet been completed, you can be refunded for any and all artwork and payments.
After starting the artwork, or after the two days have passed, I withhold the right to refuse refunds to any commissioner and to fully refund and cancel for any reason.
Sketches/WIPs:
Sketches will be sent to the commissioner through notes on FurAffinity to be approved and WIP’s will also be sent this way through. The final image will be sent to the commissioner via e-mail.
Communication:
I am to be contacted via notes on FurAffinity and not by e-mail. This is to keep contact quick and regular as I do not check e-mails while I am out.
I will respond as soon as possible to all notes received. However, if you receive no reply please wait at least five days before messaging again, as I have a sick pet to care for and I am also on a university animation course that takes up much of my time. You may send me notes me on different topics, but multiple notes on the same subject will be regarded as harassment and/or hassling and may lead to the commission being dropped and payments being refunded.
