Help me??? (Advice time?)

OKAY SO I won an auction about 3 months ago from an artist I won't be naming. Some stuff went down with them, they lost there account for reasons I wont go into... but anyways I found them via tumblr and got their email so that I could give them the auction information, and they told me that they retired the character that was starring in the auction due to some events, and can't give me a refund. They offered me something else that i'm not super interested in but I mean its something right? I replied trying to ask about maybe doing a different kind of picture with less characters and no background so it would be easier, and they have not replied for about two weeks I think? It would be no big deal except.. i can see that they are online pretty much every day posting stuff. Its starting to get extremely frustrating. I don't mind waiting for art but I can't communicate with them, and how can they think about doing the art when they don't get the info? Its impossible. I have waited almost a year for a commission in the past, and I honestly don't mind as long as the artist is kind and says that they are going to do it eventually. Any Ideas on what I should do? Or if there even is anything I can do. :ccccc I feel as though they are ignoring me completely and just don't want to have to do the art or give a refund. I really just want to be done, but I feel bad because I don't have a lot of money to spend and I did decide to spend my art money that I make very slowly $10 a commission doing. It just kinda sucks to not have communication and not know whats going on.

I would send a follow up message asking if your picture idea would be alright. I`m sorry that this happened to you :( I hope that you get something you`re happy with <3

Ah, I have sent a few follow ups one of which was saying that I was getting a little frustrated and I didn't want to be mean about it. No luck yet but i'm hoping for the best. Thank you! <3
