Mmm note about reselling adopts + commissioned work
10 years ago
There's been a lot of up-in-arms-ness about this lately, and I just wanted to go over it briefly for my customers to clarify/reassure
P MUCH, as both a commission artist as well as an adopt artist, I am 100% okay with people reselling adopts to include the price of commissioned artwork. My goal, is that no one PROFITS from my work. So long as no profit is being made, I am totally alright with breaking even and regaining back money paid when giving your adopt to another.
That being said, please make sure to respect the ToS's of others. If an adopt artist is not comfortable with their adopt being resold to include the price of commissioned work by me, don't do it. If another commission artist is not comfortable with their commissions being figured into the price when reselling one of my adopts, don't do it.
Another tidbit I'd like to put out there--I've read that ToS changes do not apply unless your customers specifically agree to the changes. (Such as when websites change their ToS, and you have to click 'I agree' to them.) Please be understanding with your customers if they bought an adopt or art while certain ToS rules were in place, that they are only legally expected to follow those new rules if they have explicitly agreed to the changes. To customers, please be kind to your artists and make sure to regularly check ToS changes and follow them regardless. We work hard and make ToS's to protect not only ourselves, but you as well. It's very much appreciated and important that we all work together to respect each other as best we can. : )
ALL THAT ASIDE, I did make a slight ToS change -- last edit I allowed traded adopts to be resold for the price of commissioned work. I was feeling on the fence about this since I allowed it, and given the turbulent atmosphere regarding the subject at this time, I've decided to go back to my only trade/gift rule. Please view my ToS for further specifics: http://www.furaffinity.net/journal/5887907/
I also did some rewording, but essentially everything else is the same.
Anyway that's all! As always, thank you very much for your time and support! ^q^/

But honestly, these are copyright laws that have been around a while, it's stressful to think about how many people didn't know about them and how many people are changing their rules now because I guess they feel like they have to? I think all of this is silly and people should just do what their comfortable with. Sorry. I ranted a little but it's nice to see someone who has my view.
s A-OK with me.
And whenever I have a TOS change, even if it's slight, I always link current customers to it. I let them know that since their commission didn't follow under the new one, they won't be required to follow it. I just kinda feel like it's fair to link them regardless.
But if you buy something, then later an artist changes their ToS, unless you re-agree to the ToS, I'm pretty sure you're only obligated to follow the ToS active at the time of purchase. :O
This is why it is VERY important for artist to keep copies of their past TOS, and have them dated --- if anything like this would ever have to come up.
But I do have to note, an artist has ever right to refuse business to any customer.
So there is a little give and take here.
But if something was alright in an old TOS (like reselling) and the artist's has changed it. Everyone under the told TOS can still resell. So this wouldn't be a legal issue/reportable to something like artist beware.
But yes, exactly. That last thing is part of why I wanted to add in that middle tidbit! I doubt anyone is going to make some huge legal issue about adoptables BUUUT it could be grounds for a huge fight. It's important to know these things, and to allow a little respect to each other to avoid any future issues or conflicts.
As far as Rights go, every artist retains certain rights to their art unless they agree to sell them otherwise. Typically with commissions and adoptables, this means commercial rights and claiming rights; e.i., their customers cannot use their product for profit, nor can they claim the artwork as their own.
