something ive been wondering the MHC

so id like to know what everyone else thinks about this, i want to join the mile high club and take my soulmate 
kiba there with me. however does it have to be a public airline? or can we charter a private flight and breed on the private flight and it count as getting in the MHC?
google hasn't really helped, some comments said yea its above the flight requirements so it counts, others say it dosant count unless there are other people on the plane that could catch us in the act. its a rather confusing determination and i have enough trouble with stability on subjects as it is without having trouble hoping that something special and intimate i was to share with my mate would be called fake or not qualify just cause there weren't a bunch of rude strangers right outside while we had our fun.
