By commissioning you are agreeing to the Terms of Service as stated below.
1. General
Art Style
Like all other artists, the style is unique and hopefully one of the reasons you have chosen to commission. Please check the gallery beforehand to make sure you are happy with it.
Will Do's
Ferals, Anthros, SFW, NSFW.
Won't Do's
No Extreme Fetishes, Humans.
References
As standard, we request a visual reference for all commissions. However we will happily work from text descriptions and images, but please note this will incur a design fee with all except Reference Sheet commissions. We do reserve the right to decline extremely complex designs if we feel we would not be able to do the character or commission justice.
Commission Freedom - Including Artistic Freedom
We have 3 ways of doing each commission as listed below, pick which one best suits what your after.
Detailed Description: This is if you have an image already formed in your mind of what you exactly want, please fill out as much information as you can, even if you feel like you're repeating yourself. We will ask as many questions as possible to help get its exact placement.
Assisted Information: This is the more common input, you have an idea of what you want but are having difficulty visualising it, give us information and we will pose you with possibility questions (i.e. would you like scene A or B, pose 1 or 2), this could mean a lot of back and forth and many notes but honestly we don't mind if you don't!
Artistic Freedom: Pretty much as the title says, we will ask you for a rough theme/scene and possible pose, then go on our merry way into imagination land. But please only choose this if you honestly don't mind what you may get! We work best when we feel that we can't go wrong.
As a final note! We will always ask as many questions where required to get as much accuracy as possible, but sometimes we have to be strict and if you don't directly state a detail or want a change on something given Artistic Freedom to, we may require an additional fee for the extra work. That said if we make a mistake on our behalf or there is a failure in communication we will happily make the change with no charge and our deepest apologies (we are only furry after all!).
2. Payment
All payments will only be taken through PayPal via invoices.
Payment must be paid in full before we start work on the commission.
We regret that we cannot deviate from this for any reason but this provides protection to both us as Mithfuril and yourselves as Commissioners from fraudulent activity.
The only exception to this is if we decide to do an Initial Concept Sketch to make sure we can do your commission idea justice. In this case we will hold off payment until you have approved the Initial Concept Sketch.
3. Productivity
Initial Concept Sketch (If required) - We normally require an extra 3-5 days to complete.
Otherwise once a commission idea has been discussed, agreed on and payment taken, the commission will be added to the queue.
Normally commissions will be worked on in order (this is not 100% as art requires inspiration for the best quality and smaller commissions that can be finished quickly). On average we aim to finish each commission in about 2 weeks of payment, however this can vary depending on size of the commission and our current queue. If we expect this to take longer then we will inform as soon as we know, whether at the inquiry stage or during the commission. If there is a delay please do bear with us and will keep you updated throughout, after all sometimes life just happens.
Rush commissions are happily considered, with a minimum timescale of 3 days and +50% additional charge of the final price. Please note if you delay with information or approving any sketches, etc. we cannot be held responsible if the deadline is missed. If you wish to get a rush commission please feel free to drop a note and we'll get back to you ASAP.
4. Personal Rights
MithFuril retains full rights and permissions when it comes to Initial Concept Sketches. This remains the case even after the commission has been paid for. Under no circumstances do we give permission for Initial Concept Sketches to be posted anywhere or used in any way. This includes but not limited to; copying, claiming ownership, completing the sketch yourself or by another artist, etc. This is mostly to prevent fraudulent commissioners attempting to gain free sketches/work by commissioning us, then cancelling before payment.
Commissioners have the right to use, post, print their commission, pretty much do anything with it on a personal level, however credit must always be given to Us and the watermark must not be removed. The image cannot be used for profit or business use.
MithFuril retains full rights to the image, including but not limited to; posting, advertising, portfolios, etc. Credit will always be given to commissioners and their respective characters.
5. Process & Revisions
If an Initial Concept Sketch is done it will be sent to the Commissioner for approval. This can be altered/redone up to 2 times for free. After this additional charges may be added, or the commission being questioned whether it is right for the Commissioner and Us.
WIPs won't normally be produced unless the commission is a large or very complex one. This is to help reduce the time taken to finish, however feel free to request one at anytime and we will happily send you one if available. If any changes are requested during a WIP we will allow one small revision for free.
Ideally our commission process from detailed information, Initial Concept Sketches and WIPs will hopefully mean that the end result is exactly what you are after. But if at the end of the commission if you are unhappy with any details, please let us know. We are more than happy to make a small revision or two to produce the best result we can for you. However please note major revisions may incur additional charges due to the extra work. Please also note, as stated under '1. General', changes under Artistic Freedom or that contradict original commission information given, will likely occur the additional charges and any changes that occurred due to miscommunication or error on our behalf will always be done for free.
6. Termination of Services & Refunds
The Artist reserves the right to refuse any commission, a reason will always be given where appropriate. We also reserves the right to terminate a commission at anytime due to any inappropriate behaviour or communication (as deemed by us). Wherein a refund may be given upon our discretion, based upon level of completion of the project.
Refunds requested by clients will be considered on a case-by-case basis, if accepted, the amount refunded will again be based on the level of work completed. Refunds will not be given after a commission is completed.
If a refund is given or a PayPal charge-back is done, you agree as the commissioner to relinquish all rights to any and all works done whether it's a sketch of fully completed commission. As under Initial Concept Sketches, you will no longer have permission to post the commission anywhere or to use it in any way.
7. Final
If you are unsure, concerned about anything or wish to possibly discuss a one off change in the ToS, e.g. an image for business use, please feel free to drop a note and we will happily discuss it. At the end of the day we wish to produce you the best possible commission for you to enjoy with the best possible service, that protects both us and yourself.
