my concern is that this now allows people to pick and choose who to lock up, and it's very easy now to do that in any artistic community, you know, try and turn in somebody you don't like for whatever reason on some trumped-up charge. Reminds me of that court in the renaissance (sry, I forget its name; somewhere in vienna?) where you could just drop a note in a box on the facade of a big square building and in the night they'd send the authorities to throw you in prison 8)

Drawings and stories are protected by the first amendment. The US Supreme Court has ruled that several times already.

I think the reason why it's even an issue with this guy is because of his prior convictions of having the real thing, and the fact that he was looking at it on a public computer.

Drawings and stories are protected. If drawings are illegal, then stories must be illegal, therefore any and every school and library that has Romeo & Juliet, for example, is in possession of child porn. The implications of that are rather staggering.

I'm just saying what the Supreme Court has ruled. Whether or not people use those rulings in their defense is up to them. Besides, how many cases have there been involving purely drawn images and absolutely no real stuff? Maybe one or two, that I know of. Out of the number of loli/shota fans in the US, I'd say that's a very small number.

The US Government has gotten far too into the "prevention" of "future unlawful acts". I wonder if any of them has seen Minority Report. None of this is about him having dirty images, of adults or children, it's about them trying to prevent child abuse by assuming that all people who look at it are going to become child sex offenders. I mean hell include the judges, and those handing these sentences down. after all if they in the future decide that those with no background of illegal acts have this stuff and they get sent to jail, then can you say the judge and jury should be sentenced too, after all ironically they are the ones seeing said materials of that nature. so doesn't that make them the same as everyone else who draws, writes, reads, views, and buys such stuff? The US is treading a fine line and it will come back and bite them badly someday. hopefully sooner than later.

it really all depends on the miller test. Whereas US law is more ambiguous, and the Supreme Court has ruled multiple times that art and stories depicting minors in sexual acts aren't illegal, Canada's law explicitly states that these things are indeed illegal. Personally, I'd rather be in a country where the Supreme Court rules it's okay than a country that outright bans it.

Apparently, while cub/loli/shota art is technically legal, obscene material is not. The ruling explicitly states that obscene art is not protected by the first amendment. Furthermore, it seems this obscenity clause can apply to any art.

Theoretically you could be charged with obscenity just by having a large collection of really hardcore hentai images, none of which have any lolis or shotas.

On a side note, I've heard that it is illegal in certain states to use the US Postal Service to ship pornographic material (of any kind). So that's the most likely reason why they followed him from the post office, and why they busted him (Handley, that is) in the first place.
