At one point, Omaha the Cat Dancer was being printed in Canada, shipped to the distributor in the States, then not allowed back into Canada for sale. Meanwhile, New Zealand gave it the equivalent of a "G" rating.
I think the reason why it's even an issue with this guy is because of his prior convictions of having the real thing, and the fact that he was looking at it on a public computer.
Honestly if it's a private computer, and someone with no past legal history, then I don't think it would be an issue at all.
Drawings and stories are protected. If drawings are illegal, then stories must be illegal, therefore any and every school and library that has Romeo & Juliet, for example, is in possession of child porn. The implications of that are rather staggering.
I'm just saying what the Supreme Court has ruled. Whether or not people use those rulings in their defense is up to them. Besides, how many cases have there been involving purely drawn images and absolutely no real stuff? Maybe one or two, that I know of. Out of the number of loli/shota fans in the US, I'd say that's a very small number.

Whereas US law is more ambiguous, and the Supreme Court has ruled multiple times that art and stories depicting minors in sexual acts aren't illegal, Canada's law explicitly states that these things are indeed illegal. Personally, I'd rather be in a country where the Supreme Court rules it's okay than a country that outright bans it.

Apparently, while cub/loli/shota art is technically legal, obscene material is not. The ruling explicitly states that obscene art is not protected by the first amendment. Furthermore, it seems this obscenity clause can apply to any art.
Theoretically you could be charged with obscenity just by having a large collection of really hardcore hentai images, none of which have any lolis or shotas.
On a side note, I've heard that it is illegal in certain states to use the US Postal Service to ship pornographic material (of any kind). So that's the most likely reason why they followed him from the post office, and why they busted him (Handley, that is) in the first place.
