[NOTICE] Changes to ToS
Going through exam cram, noticed I was missing a few things.
Added Clarification
It's fandom industry standard that the artist keeps all rights to the image, but now there is more accurate legal wording.
Added Section - Shipping
Mostly this doesn't apply because my work is digital and my prints are sold in person, but my stuff is FOB shipping point. Once it goes to the post office/fedex, it's not my problem. Buyer assumes risk of loss or damage during delivery.
Changed Terms - Refunds
I have a general six month from payment due date for commissions, unless otherwise negotiated. I have never actually missed a deadline before, but exam cram has filled me with horror stories of substantial performance getting thwarted by a bad contract. So, it now says in the ToS that the refund for late commissions will be for the work not already completed. If I have not started, you automatically get a full refund. Nothing changes. If I have pretty much finished the work and it's a ton of nitpicky details that essentially amounts to the buyer preventing performance by deliberately withholding satisfaction on substantially complete work of reasonable quality, small refund.
Of course, none of you would ever do that because the fandom art industry is generally honest if not very professional and doesn't often seek legal remedies, but I'm paranoid, okay?
